    Given that I have my final exams in May and PCT will be part of it this might be a nice way of studying it as it is a more complex patent system than EPC or German patent law. So thanks for posting!

    Hi, There is a total 30 Month period for PCT filing/process, it is been 19 months from my local priority date application, can I still file for PCT in bound to 30 months period and move to process the requirements within the remaining months?
    If ever I could no longer file due to lapse of the 12 Month period, can I still apply in other country such as the Korea or Japan personally, to grant patent protection even I had my Patent in my own country?
    What is the effect/(is there a conflict) of filing in other country wherein I already have patent application(or granted patent) in my country?

    Is it mandatory to file a national application in the country of origin prior a PCT application ? or can that be done post the PCT application ?
    Additionally, So post PCT one has to pay for each individual national IPO in that grease ? what happens if that period has run out would it be considered prior art while filing an application in a PCT country ?

    What is the procedure to get a patent through PCT application as quickly as possible to enjoy the maximum patent term to derive commercial benefits?

      Thank you for your question. For an overview of the PCT procedure you are kindly invited to refer to the brochure “Protecting your Inventions Abroad: Frequently Asked Questions About the Patent Cooperation Treaty” at www.wipo.int/pct/en/faqs/faqs.html . Its paragraph summarizes the advantages of the PCT procedures.
      For additional information on the PCT please refer to the page www.wipo.int/pct/en/users/summary.html.
      The international phase of the PCT procedures generally takes 30 months, calculated from the filing date or, if a priority has been claimed upon filing. During this period the formalities are checked and the international application is published (generally at 18 months from the priority date or the filing date, as the case may be), and an international search is performed by one of the International Searching Authorities. In order to accelerate the international phase, applicants may ask for early publication or their application and they also may take the necessary steps for an entry into the national phase earlier, i.e. before the end of the 30 months’ time limit.
      Applicants should consider that patents are of a territorial nature and that the time it takes until a patent is granted on a PCT application after national phase entry, depends on the administrative and examining procedures within the national Offices of the countries where protection is sought in the national phase.
      As to the duration of the protection provided by a patent, please note that the current international standard for patents provides for a term of protection of 20 years from the filing date of the application, provided that annual fees or maintenance fees are paid throughout the whole period.
