How Japar Dimaampao became a CA Justice with his communication skills that sound not accurate to be heard and inarticulate sounding. As a lawyer, he /she must have good communication skills in terms of fluency and articulacy. It seems that this candidate as a muslim has a certain purpose and agenda why is he applying for the post of CJ , and that is quite intriguing.
He was impressive! But I disagree on his opinion of the Bondagjy case. I have read the case (GR No. 140817) decision penned by Justice Pardo and I believe it has been decided justly and fairly. The Shari'a Law (as embodied in PD 1083) is not applicable since one of the parties (the wife) is no longer a Muslim at the time of the litigation. Hence, the Civil Code should be operative in such case. The wife (a Filipina) originally, is a Catholic who converted to Islam four months before her marriage to Bondagjy, a Muslim Saudi national, but reverted to Catholicism after they separated. The children have also been Christianized. And they were minor when they separated, so custody should belong to the mother. Bondagjy questioned his estranged wife's fitness to be the custodian of their children. Let me quote Justice Pardo's prologue: "Is a wife, a Christian who converted to Islam before her marriage to a Muslim and converted back to Catholicism upon their separation, still bound by the moral laws of Islam in the determination of her fitness to be the custodian of her children? We apply civil law in the best interest of the children."
