    If you live in California and someone breaks into you’re home, you have to retreat to the next state to defend yourself.

    I pray everyday that I never have to use deadly force, but in my home I will not retreat! I will defend my family, myself, & yes my property. There are some things that just can't be replaced! Those inherited items. No matter who much insurance you have, there are things money can't buy or replace.

    Like you said in several videos. It's not can I shoot, but SHOULD I shoot. 30 yrs as a LEO, drew my weapon on duty more times than I can count yet never had to shoot. Praise God.

      Yogi and Booboo I’ve had mine for about 2 years now and absolutely love it! Very concealable and comfortable in all weather. Not too snappy and has run flawlessly. Trigger is good and sights are good too. Easy to break down and clean as well. 7 and 8 round mags and I put some talon grips on it too. Lots and accessories and choices for holsters. I’m a south paw and haven’t had any issues. Reasonably priced and lifetime warranty. Get some good quality hollow point ammo and you won’t be disappointed. Always feels comfortable in your hand😎

    Hey John, thanks for the info. Seems like another great space for your situational awareness line: Awareness gives you time, time gives you options! Making reasonable moral decisions seems a whole lot more plauseable if you're responding to a something that you noticed before it started than if reacting to a threat that you didn't see coming.

    Lots of good lessons learned in here. Curtilage, 4th amendment analysis, castle doctrine and no duty to retreat in stand-your-ground states, how the legal world only enforces the minimum moral standards, and the 3 guidelines that define a libertarian. Great stuff!
    Admittedly, trying to look up the meaning of curtilage (let alone how to spell it) distracted me initially, since I wasn't familiar with that term, despite scoring high on the SAT verbal ages ago... LOL. I am humbled by learning something new everyday and look forward to it. Fortunately, GOOG knew what I was getting at... lol Thank god for AI...!

    So, defendant, you say you retreated from the street to your yard to your patio to your porch to your front hall, up the stairs to your bedroom to the closet. Why didn’t you retreat to the closet shelf?

    I COMPLETELY disagree with Mark about retreating from your home. As for John’s rationale for not to retreat, it’s irrelevant that when you are inside your home you no longer have the “ability to retreat.” Most of us actually do have the physical means to run out of the house, but in reality, it all comes down to the question of: What is the most prudent thing to do to stay alive? If you cannot actually physically retreat, then the answer is simple; you stay and fight. But if you can physically run out of the house or escape in some other manner, then I believe you are legally justified to stay inside your home and to defend yourself with lethal force, if necessary, It’s not about protecting your material belongings from being stolen; rather, it is about protecting your life. How do you know that when you run out of the house the intruder will not have an accomplice waiting to spring an ambush on you? Or, what if your neighbor heard the break-in, called the cops, grabbed his gun, and then saw someone running out of your house and started shooting at you? Or, what if the responding cop saw you running out of your house with a gun in your hand? The cop doesn’t know you are not the bad guy. Any self-defense attorney who cannot make a strong argument for a homeowner who choses not to retreat from his home is deserving of a second look.

      Just be sure to check local laws. In most places your home abrogates the duty to retreat, but that's not universal.

    5:36 I get the idea, but just keep in my mind (and as John often points out) there could be trailing accomplices. Chances are, from inside your home at 3am, there's no way to safely determine if that's the case or not.

    If someone breaks intro your properly closed private property with someone inside (including car, there should be a refutable presutnion of a treat 2 the life, making legal 2 use lethal force even from outside the place

    Ok if my wife and I are in bed sleeping and all the sudden someone breaks in what do you think I should do,, let me know, I can tell you that my mother that has passed always told us kids that if someone comes and breaks in,in the middle of the night that they are not there to shake your hand, shoot them, now let me know what you think.
    I'm pretty positive that if someone breaks in, I'm not going to wait to see what happens, I will shoot to kill, thanks John, I appreciate your videos and watch all of them,✌️ N ❤️ brother 💯

      Not really. It's not a question of whether you have to retreat, but whether you have the presumption of acting reasonably to immediately shoot a home invader. In Arizona, for instance, ARS 13-418 and 419 give a presumption of acting reasonably in using physical or deadly force against an unlawful intruder in the home...but presumptions CAN be rebutted with other evidence and there are limits. Your state might be different in that arena. The best course is to take a legal use of force class specific to Missouri.
