ROLE OF THE COURT
67.The rate of conviction in criminal cases in India is abysmally low. It appears to us that this factor weighs on the mind of the Court while deciding the bail
applications in a negative sense. Courts tend to think that the possibility of a
conviction being nearer to rarity, bail applications will have to be decided
strictly, contrary to legal principles. We cannot mix up consideration of a bail
application, which is not punitive in nature with that of a possible
adjudication by way of trial. On the contrary, an ultimate acquittal with
continued custody would be a case of grave injustice.
68.Criminal courts in general with the trial court in particular are the guardian
angels of liberty. Liberty, as embedded in the Code, has to be preserved,
protected, and enforced by the Criminal Courts. Any conscious failure by the
Criminal Courts would constitute an affront to liberty. It is the pious duty of
the Criminal Court to zealously guard and keep a consistent vision in
safeguarding the constitutional values and ethos.

Yes, I read, The judge clearly wrote in the order that I have not enough time to read all the documents which was presented by ED.
If the order was meritorious then HC would go with the lower court.
It was a question of merit which was not considered in Rouse Avenue court by judge Nyay Bindu. Pehle Jake order padho ,, aise youtube pe dher vakil banne aa jata hy ,, video dekh ke influence mat huo , order padh kar aao. Aur lower court ka judge ne duty kiya acche se to HC ke judge ne bail reject karke lower court ke judge mrs Nyay Bindu ko unki asli duty ko yad dilaya ki evidence, docs,etc ko padhna bhi hota hy

Kish baat ki salute mar rahe ho, vo mentally unstable judge ka parichay diya. Usko future me ishki kimat chukani padegi politician ke dwara. She proved herself that she can't be impartial. She will give judgment not based on the facts rather what she will think or what she wants to be. It can't go far and the ramifications will be fall on her by other law experts as well as jurists.
