‘I did not exonerate him’: Special Counsel defends findings on Joe Biden’s memory

- Joe Biden’s mental fitness was on trial in Congress today.
The special prosecutor, who described the US President as a “sympathetic, well-meaning, elderly man with a poor memory” in his report detailing the investigation into Mr Biden’s handling of classified documents, gave evidence to a congressional hearing.
The hearing went for about five hours, with questions towards the special prosecutor, Robert Hur, about whether he should have included the descriptions of President Biden’s memory as being “failing”.
“I could have written my report theoretically in a way that omitted references to the President’s memory, but that would have been an incomplete and improper report,” Mr Hur told Congress.
Mr Hur also denied claims from a Democratic Congresswoman that he “exonerated” President Biden in his report.
“I did not exonerate him,” he said.

Not in any way. For example, you find a typed list of murder tools in a building shared by a murder suspect. The document does not by itself allow for prosecution because you cannot prove that it belongs to the suspect. But that is not exonerating. Or here's another one: a man commits theft in front of witnesses, but the DOJ produces a document proving that he has diplomatic immunity. You cannot prosecute him, but he is neither innocent nor exonerated. In fact, his immunity can be revoked to allow for prosecution. In short, exoneration means “proven innocent”. Merely because someone cannot be prosecuted does not prove him innocent. Even the idea that one is innocent until proven guilty is probative only; the probativrly innocent person must be treated as innocent, but he cannot be exonerated until he is proven innocent. A congressman should know the difference.
Oh, I should add: the Special Cohnsel document does not even preclude prosecution. It only does not recommend prosecution, because he felt that a jury would be too sympathetic to convict him. The DOJ can still prosecute Biden if they choose and have Congress's support. The document wouldn't even hold up as evidence of innocence in court, but would rather be used as evidence of guilt.

But if Democrats want to play that game and say Trump is also old and losing his memory, then give Trump the same sentence you gave Biden regarding the classified documents.
