- The plaintiff claims the defendants’ son dragged her out of her car at a gas station and ran her over during a carjacking. She says the vehicle was badly damaged when she got it back, so she’s suing for repairs, plus pain and suffering. The defendants claim their son was an innocent passenger in the car, so they owe nothing.
Case 29-036
I wish people would come to court prepared. I would have every document on deck. Research similar cases and take notes to help my case !
Facts
Seriously! You're going to court to sue and don't have documents or proof of anything. I understand she was traumatized but a sob story can only get you so far in court.
I never understand this when they don't lol 🤣
That's why you will never come before the peoples court 😜 and doug won't get to belittle you ... Back to you harv...that's right doug

Theft is so violating. Imagine going to work 8+ hours a day to support that lifestyle, and somebody just plans to take it away without regards of how hard you worked.
Going to graduating to more violent crimes......
Unfortunately the mum is making excuses for her child so it’s unlikely to be the last time he gets into trouble
@L Cam True, but doesn't excuse the defending the mother is doing of her child. She is making it hard on herself as a parent. Denial is a killer
Not an excuse clarification
Not surprised he has a coddling Mama and Dad that looks to just breaths. I guess that’s contribution. Yep, life a crime a head of him.
@@marriejames01 ?
Glad you said it cuz you Tube only gone block me if I say it 😒
This mother minimizes everything about her son which is exactly why he got in to trouble in the first place,
She is so proud she was able to give him orthodontics and no shame that she was unable to impart values to not be a criminal
What if the shoe was on the other foot?
She didn’t minimize. She clarified. She admitted that her son was apart of the robbery but didn’t partake in the actual “stealing” of the car.
A child participating in criminal behavior doesn't always mean the parents failed them. Sometimes peer pressure can overshadow good decision making. The defendant is well spoken and acknowledged her son was wrong. I believe she's a good person and maybe her son's a bit much to handle. I hope he gets on the right track before it's too late.
The plaintiff may need to seek counseling. The car jacking was traumatic, however she can't live the rest of her life owning a car and not putting gas in it.
Soooo true. 💯
While I agree with you for the most part I found the plaintiff’s actions before and after seeing the judge to be a little strange. I know stress reactions can present in a variety of ways but she seemed a little off. I would need to do an in person assessment to get to the root of it though. I also noticed the plaintiff did not ask for any reimbursement for mental health care (past, present, or future) which she could have added on for a larger judgment.
She said she waits until it gets on E because she is so hesitant to go to the gas station because of this traumatic event. It's understandable.
She "needs" to GROW UP!
That alone is worth more than $5000
I never understood mother’s who run to the rescue when their child is in the wrong . Being in denial is going to cost you as a parent
These are the same mothers these boys run to after they rape and murder and beat women.. It's mothers like this!!!!
@@ayyboii8108 Yebo! These mothers enable their sons to become more and more vicious, and are just as guilty!
Screw costing the parent! It's going to cost the child the most! I've seen with my own eyes how being the "not my child" type of parent can harm a child their whole life. I would get my child a lawyer so that they can have the best outcome for rehabilitation. Locking the child up isn't the only answer. A young child/teen needs intense counseling of some sort and needs to get involved with youth groups. I've always believed having kids involved in sports, studies, youth groups, and volunteering, 1; keeps them busy; 2 teaches them morals and values; 3 helps build their character. Letting your child sit idle and not choosing who to let them hang around is no good. You can't choose your child's friends, however, you can have a strong influence by putting them in better situations.
She’s a Mammie.
It will cost your child more.
The mom is delusional with all that talk of her son.
Exactly, she wouldn’t admit he was a carjacker. She will only admit to him being in possession of a stolen car. 🤦🏽♀️ She tried to act as if one is better than the other. Her son was wrong and she should accept the reality that her son is big time trouble.

Your lack of not understanding what happened is very apparent
All she did was ask the plaintiff to prove that she hadn’t been fully compensated with restitution. How does following the law equate to a lack of sympathy?
Are you referring to the defendant or the judge
Zero compassion from the dumb Mother.
I'm surprised there wasn't video footage of the incident happening at the gas station. That may have definitively proved the defendants son was involved from the beginning. Glad she's ok and justice was served.
There probably wasn’t video. Since it was outside
I was thinking the same thing

The plaintiff didn't get pain and suffering because she didn't have any EVIDENCE to prove it. Had she brought medical bills, statements from a Psychologist, etc., Judge Milian would have awarded it.
Exactly!
She got $500 for pain and suffering.....
@@fairymermaid9013 yea but should could have gotten more if she had proof that was more of the point.
the fact that she was robbed and thrown off a car entitles her to pain and suffering. but i don't know why she didn't go to emergency right away.
I don't think the back problems are as bad as she claims them to be. I can sympathize with her for going through the trauma. Her English made me cringe.
When I was 14, I was held at knife point by a group of three men in a stolen car (it was found abandoned several weeks later). They kept saying they had a gun too, but I know they didn't. I was raised and trained to use firearms, so I knew they wouldn't be using a knife if they actually had a gun. I was able to fight off the one trying to pull me into their back seat and eventually managed to slam the car door he was half way out of into his hand/wrist. Out of anger, he lunged at me with the knife but he missed, and before he could retaliate again, a woman pulled up in a car and they fled when they realized there was a witness. I hadn't even realized I was holding a rock ready to strike him had he come at me again. I must have picked it up after falling. When the woman took me to her house to wait for police, I realize I was bleeding and he had in fact cut my arm with the knife. It was a shallow wound. I know exactly how this poor woman feels and I'm happy the perpetrators are being held accountable.
I hope you're alright now. I hope it doesn't hurt anymore. I wish it didn't happen to you. Thank you for sharing. ❤️
God bless you, I couldn’t even imagine the sheer fear of this incident. So happy you’re here to share your story.

I would sell the vehicle because its emotionally tainted.Sell it and move on with counseling. He was with his "friends" in a stolen car. Guilty by the company you keep. Better friends, better lives.
My car was stolen and that’s exactly what I did. I felt violated and unsafe when the police brought my car back to me. I’m extremely paranoid now. It’s sad these kids nowadays haven’t a care in the world and doesn’t care about violating others who work hard for their money.
The father stood there and didn't say a word. That is troubling. He is standing there like nothing is going on. No wonder the boy is in trouble. Look at his family. The family need to stop making excuses for him.
its because the parents are like that too, I'm sure the father is also a criminal,
@@Palmstreet-u7x
That comment isn't fair....you can't judge someone without knowing them.
Sometimes parents try their best with their kids and still fail!
@@Palmstreet-u7x Your comment is ignorant.
Maybe the father's silence was the best thing for him and his family. The important thing was that he was there.
What was there for him to say? This isn’t an interview. This is court. The mother answered the questions of the judge. This is an unfair and quite ridiculous comment.
I would make my child pay back every cent that I had to come out my pocket no matter how long it took. I feel bad for the parents, they seem like really nice people but as most parents they are pleasantly naive about their son's involvement. Make him pay y'all back mom & dad!
My daughter, although not perfect herself, was bullied and traumatised at school from about 7 years old, and still at 26 suffers from the trauma and mostly due to parents who refused to accept their little darlings are little horrors and that it is their idealisation of them being little darlings that makes them the little horrors. They get away with it and so continue, there needs to be consequences.
@@lisaparrey1343 I understand how kids are. I was what I thought was what they call bullying, bullied as a kid in elementary school, kids would gang up on me,surround me after school and sometimes even the kids I thought were my friends would be in on the plan. One time I got a big hambone thrown at me by an older kid it knocked me off of the bike I was on and had to get stiches, another time my "friend" flicked a broken beer bottle at me with his hockey stick and got me on the other side and I needed stitches for that too. Kids will be kids, that same kid was in my yard one day and picked up one of our lawn darts ,I was talking with him and another guy. So I didn't pay much attention to what he was doing until after...but now that I now know, he was trying to actually hit me with it. He threw it up into the air then he stood there and watched me and then he would look up and try to gauge the darts distance from me as it apparently was heading down close to me,well all of a sudden it came zinging past my head straight down deep into the lawn. He then said oops. Back then I had no idea he was actually trying to hurt me. But my snap to it ness me 40 or some years later thinking back to all the things this guy whom I thought was a friend, was actually trying to kill me. I'm almost sure of it. Anyway he was standing with the older guy that I had never met before then that threw the bone at me. And I recall several other instances where he was in the crowd as bullies surrounded me to fight. I thought back then that I was protecting him. I wasn't gonna even talk about this when I came here., I was thinking of my older sisters experience with what she called bullies. She thought because the other girls would point and laugh at her dress that that was being bullied, And oh in the washroom they would giggle when she peed and it made a sound when it hit the water. Oh girl you don't have a clue ,my sister that is.
Heck yeah!!! Mathis would have given her more money and he would have called the father a "crackhead"!!!

I love Judge Milian but I don't understand why she was kind of dismissive about her PTSD from this incident.
That’s what I said! “Well you gotta stop for gas, I don’t know what’s that’s about.” It’s ABOUT her almost losing her life and being traumatized. She’s being rude and dismissive like you said and I don’t like that.
I agree 100%
Perhaps it would have helped if she had some evidence.
Lee Takamiya i don’t see how it’s not evident she’s traumatized. If I had to change one thing, instead of pain and stiffening (although she should gotten it), maybe if she labeled it emotional distress it would’ve gone better. I just don’t like the judges dismissive attitude.

I’ve seen a case Judge Mathis dismissed without prejudice. He instructed her to sue the auto insurance company. She had permanent damage that prevented her from working in her industry and framed her disable
Judge Blackthis is a blatant racist.
The defendants should take more responsibility for their son. He’s TROUBLE! It doesn’t matter if he “stole” the car or not, he knew the car was stolen and is responsible! He was convicted for stealing at minimum 2 cars!

@Living Lyphe it doesn’t matter what they said at the end. I really admire how respectful the defendants and plaintiffs were with each other. They are all so professional and left their own biases out of how they answered the Judge’s questions. If that was my son that was caught with the car and didn't actually steal it, I would have him pay for all her damage and have him do all the leg work to recoup his money back from the real theft. It's clear the parents aren't taken the proper steps to help this woman become whole.
He's done it before and will do it again since the parents are making excuses for him.
Wait, so the son is involved on another car jacking and she's defending him and minimizing his responsibility?!? Punishment would've been severe if it were my mom.
