If you're an American non-citizen resident (Non-Lucrative Visa), you don't pay income taxes in Spain, unless it's over something like $120,000 or Euros. I can't remember the exact amount. That's because the US and Spain have some sort of agreement and Americans will still have to pay taxes in the US. Correct me if I'm wrong.

The non-lucrativa visa forces you to become legal & tax resident in Spain. As you well say, there is a double taxation treaty between the US & Spain, so depending on the type of income you will pay taxes in one country or the other.
Taxation at source: rental income from investment properties, capital gains from selling properties, public subsidies...
Taxation at residency: interests, dividends, private pension...

My partner and I have a domestic partnership in the U.S. Can I be added to the golden visa application with the domestic partnership agreement or do we need to be legally married? Thanks

USA give the golden visa for $250,000 USD.

If you already have an EU passport you do not need the Golden Visa.
