The neighborhood seemed to have gotten a kick out of it, according to the defendant. It didn't help that the flyers were poorly printed when they were distributed. The effect should've been more negative in order for the judge to consider his counterclaim.

Defamation is when someone says something about another person(s) and it has a negative effect on their life. What she did was put a piece of paper that probably got some giggles and a bit of confusion from the neighbors. But it didn’t impact him in a negative way that would’ve cost him a trip to the hospital, or lost wages, or made him depressed, etc. Defamation lawsuits are mostly thrown out because people don’t really understand what the causes are about. She plastered flyers about her opinion of him. Nothing more. If we all could go and sue someone for an unwanted opinion that someone has of us then let me tell you, everyone in the world makes opinions about someone at some point throughout all of social media. The courts would be flooded with people getting their feelings hurt over someone else’s opinions.

I understand her reasoning for wanting to sue him because he called the police over. Had he not done that then her car would not have been towed. That said, the plaintiff sued the wrong party. She should have sued the city as their cops are supposed to know what a LEGAL driveway is before they had her car towed and ticketed. Since the city threw out the ticket then they are liable for her towing bill since their cops weren't adequately trained in this regard. But good luck winning that battle. LOL.

This berm/driveway issue is a HUGE problem in New York. Where the defendant parked his car is NOT a driveway nor is it a legal parking space. A LOT of people buy houses with "driveways" and are later pissed to find that the driveways are not actually considered driveways. It is INCREDIBLY rare to find a home with a driveway on that sort of city block in NYC. Police are NOT good indicators of parking laws because they don't care. They're looking and making a personal judgement just like any other person with no knowledge of parking enforcement rules. That's why her ticket eventually got thrown out, because someone with actual knowledge of the street there knew that she was right. That said, her beef is with the police, not with the defendant. He did what any normal person would do who believed he had a driveway, called the police, and the police had her car towed. After that, she should have gotten surveys of the area, made both the defendant AND the police aware of the fact that he does not legally have a driveway and therefore does not dictate who can and cannot park there, and then if the defendant took any action against her after that, it would be on him. Right now, he's just a man who thinks he has a driveway. I understand Judge Milian's reasoning for not ruling for the countersuit for defamation, but I don't agree with it. Just to distribute someone's full name and personal address on flyers alone is worth some sort of punitive damages. Right now, she believes that doing that was okay. She needed to have been punished for doing that.

If the judge found in favour of the defendant, which means that he was telling the truth, then the plaintiff distributing flyers with his name and address saying he is a liar, is defamatory, therefore he should have been awarded the $500, but in dismissing his counter-suit means that the judge upholds her flyers claiming he is a liar, in which case, the plaintiff should have won her case, since he lied to the tow company. Either way the judge can't say to the plaintiff that he wasn't lying and then turn to the defendant and say, she hasn't said anything wrong. The judge doesn't seem to follow the law as much as she goes by how she feels on that day. She is NOT CONSISTENT in her rulings...
Wrong decision. The plaintiff is a dingbat but at the end of the day there is no legal easement at the location and the defendant, by putting down his own markings indicating that there is, gave the cops the wrong impression which is really false information. They towed on the basis of that false information and that's why the tow was refunded. The whole case is pivotal on that false information and the right of the defendant to restrict parking in front of his property. He doesn't have that right given that he has not sought permission from the appropriate authorities. He should have been held to account for this. He hasn't been.
She overreacted with the signs, but tbh this is why they have permissioning for driveways. Too many, and it reduces public parking spaces. IF it was actually not a permitted driveway, then the defendant would have known that and actively lied to the police. Its not practical for the police to check the depths of city permits etc on the spot, and so just go off what they can see, but the traffic court can check more carefully - that's not luck, but just enforcing the need for permits. So if the driveway was not permitted then the plaintiff's car was towed as a direct result of the defendant lying to police, and should reimburse her costs.

I work for a building maintenance company. When tenants make off-the-wall request I always say no even though they say it’s a one time deal. When the tenant goes over my head to my supervisor to get permission to do something, they shouldn’t be doing that day. Weeks later that same tenant will come up and ask or do what they did before and then when I confront them about it, they always say. They let me do it before. He should never let anyone park there and he's needs to go to the city and get all that carp straighten out.

Driveways have a very specific requirement in NY. It isn’t a legal driveway.

That is not his call like some public street-owning tyrant. Now that he has been on national television, he cannot claim he does not know it is not a legal driveway anymore. They brought up the prior court case with the plaintiff where it was determined his driveway is not legal and the plaintiff's parking ticket was dismissed. If he calls the police in the future the taping from this episode should be used as evidence for a lawsuit against him.

This berm/driveway issue is a HUGE problem in New York. Where the defendant parked his car is NOT a driveway nor is it a legal parking space. A LOT of people buy houses with "driveways" and are later pissed to find that the driveways are not actually considered driveways. It is INCREDIBLY rare to find a home with a driveway on that sort of city block in NYC. Police are NOT good indicators of parking laws because they don't care. They're looking and making a personal judgement just like any other person with no knowledge of parking enforcement rules. That's why her ticket eventually got thrown out, because someone with actual knowledge of the street there knew that she was right.
That said, her beef is with the police, not with the defendant. He did what any normal person would do who believed he had a driveway, called the police, and the police had her car towed. After that, she should have gotten surveys of the area, made both the defendant AND the police aware of the fact that he does not legally have a driveway and therefore does not dictate who can and cannot park there, and then if the defendant took any action against her after that, it would be on him. Right now, he's just a man who thinks he has a driveway.
I understand Judge Milian's reasoning for not ruling for the countersuit for defamation, but I don't agree with it. Just to distribute someone's full name and personal address on flyers alone is worth some sort of punitive damages. Right now, she believes that doing that was okay. She needed to have been punished for doing that.

the plaintiff needs to PROPERLY Explain her case - 1st off it was ruled the CURB WAS ILLEGAL - the homeowner cut the curb to create an illegal driveway entry, he also painted the curb yellow - so yes to the officer it LOOKS like a driveway, but after the city researched, they found this was an illegal driveway and is why the court DISMISSED her ticket.

That driveway is an illegal driveway and that man has no business using as a driveway. So then you ask well if its illegal driveway why would the cops ticket and tow the car? Well the answer is simple. The cops dont know its illegal. The cops dont walk around with a blueprint of legal and illegal driveways so anything that even half looks like a driveway and a car is blocking it they would tow if its requested by homeowner. If the judge found in favour of the defendant, which means that he was telling the truth, then the plaintiff distributing flyers with his name and address saying he is a liar, is defamatory, therefore he should have been awarded the $500, but in dismissing his counter-suit means that the judge upholds her flyers claiming he is a liar, in which case, the plaintiff should have won her case, since he lied to the tow company. Either way the judge can't say to the plaintiff that he wasn't lying and then turn to the defendant and say, she hasn't said anything wrong. The judge doesn't seem to follow the law as much as she goes by how she feels on that day. She is NOT CONSISTENT in her rulings...

She overreacted with the signs, but tbh this is why they have permissioning for driveways. Too many, and it reduces public parking spaces. IF it was actually not a permitted driveway, then the defendant would have known that and actively lied to the police. Its not practical for the police to check the depths of city permits etc on the spot, and so just go off what they can see, but the traffic court can check more carefully - that's not luck, but just enforcing the need for permits.
So if the driveway was not permitted then the plaintiff's car was towed as a direct result of the defendant lying to police, and should reimburse her costs.

I work for a building maintenance company. When tenants make off-the-wall request I always say no even though they say it’s a one time deal. When the tenant goes over my head to my supervisor to get permission to do something, they shouldn’t be doing that day. Weeks later that same tenant will come up and ask or do what they did before and then when I confront them about it, they always say. They let me do it before. He should never let anyone park there and he's needs to go to the city and get all that carp straighten out.
