Questions- 1- Will doing a search at the USPTO, google or other search platforms for a phrase, term, or word(s) that one wants to trademark make it vulnerable for others to see what you are searching for and allow them to steal it before one has applied for the trademark? 2- If one is already selling products using a trademark they want without approval by the USPTO, with or without first applying for the trademark, allow others to use and steal their trademark idea? Or, would it be better for one to already be established in selling products with their trademark in order to show proof of use? 3- Once the trademark application has been applied for, is the trademark idea then protected from others being able to use/steal it? Jim, in a USPTO search, I found the same name but in a different industry and the name is considered Dead by the USPTO. Would this now be available to use? Thanks, love your vids..
If a company trade marked a product name but say they sell coffee and someone in the health supplements field wanted to use that as a company name would that be trademark infringement. I saw 3 different company's with the same name all trademarked and live. So that's a little confusing.
Really stupid question... Do I really need to file a trademark, or be worried about it, as a sole proprietor working locally? I ask because it sounds like registering a trademark costs a lot of money, and has a lot of hoops to go through, so I doubt someone who just wanted to jump in on my little business's name would be bothered or could even succeed. That was my main worry, that someone would see the name of my little business, file a trademark, then come after me. Just general laziness and maliciousness on their part. But it sounds like this trademark filing process is not cheap or easy, so maybe that alone protects me, as long as I am not using a registered name. Would that be a fair assumption?
I don't know enough about your business or your name to make that call. But you can look up the Burger King in Mattoon, Illinois to see what happens when you don't protect your intellectual property.
@@jimhart It has become a moot point, because it seems no matter where I turn, I am required to have a business address, and because of my renter's agreement, I can't use the address of my residence. Since it all requires money to get started, I can't get started. Sorry this isn't clearer. Again thank you for the reply.

It depends on what is included on the trademark registration.
