She applied for Asylum but her case is still pending. My mother might have overstayed her visa before filing for Asylum so am in limbo as to whether she can adjust from within the USA if I proceed with her I-130 application? Please advise on how I can address my dilema? Thanks.
You'll need immigration attorney with experience in litigating USCIS, normally board certified in immigration law attorneys would be your best bet, otherwise you might consider hiring immigration law attorney who is willing to "fight" USCIS on your behalf and gets you what you should be getting without litigation.

hi! i would like to ask if a k2 visa applying for AOS need to submit also form I-130? since k2 visa is applying at later date...but the k1 and petitioner got married within 90 days? k1 visa has already a greencard but the k2 is applying at later date..k2 packet was returned and rejected for the reason of : priority date could not established, and asking to submit I-130...please advise! thank you
