There is but one man to look up to in this debate... Prof. Githu Muigai... You, Sir, are the reason I went to law school. A master at articulation! Advocacy at it's best!
It's very apparent Willy Mutunga cannot express himself well despite having immense knowledge and great Ideas. Public speaking and oratory skills are God given talent that cannot be acquired or taught anywhere in this world.
Prof Githu is real teacher. I have no background in law but I totally understand hi argument very clearly. I remember his submission at the Hague. He was excellent and very eloquent.
What a beautiful thing to see experts/veterans engage young people in intellectual discourse like this. I'm not a lawyer but I can appreciate this. You never get see this in this country.
Pro. Muigai displays exceptional intellectual ability with great universality in genres, typically to a degree that can be associated with the achievement of new advances in any domain of knowledge.
Both! Prof Githu and Dr Mutunga are intellect. But Githu seems to be more articulate and eloquent maybe due to his legal professional application in teaching! This debate to me is one of the best Deliverances ever recorded! Similar debates deserve to be held on for public acknowledgement! A job well done!
@@pn2074 , well you cannot discredit his articulation on the basis of failure to pronounce a single word, more so given that he has probably mentioned the word constitution his entire lifetime. i still hold my position, he is a great legal scholar.
The debate was robust, a share of the country's, continent's and world's best legal minds. An understanding of the Kenyan jurisprudence as by practice on the bench in Constitutional interpretation. Thank you Chief Justice (Emeritus), thank you Attorney General (Emeritus)
Prof Githu Muigai is one eloquent man and Dr mutunga though brillinat lost this one due to lack of cohherence! in my opinion. Now give us Prof Githu Muigai VS Dr Otiende Amollo. This will be a quite something interesting.
I am here 😂😂 I was only interested in Prof Githu's sentiments...very interesting and educative 💪💪. To mutunga I only here, "you know...aaah..you know " very boring from him. 😯😯😂😂😂
You skipped because as an African I believe, we always think someone who is speaking fluent English,French or any colonial language fluently and with "desired accent" sounds more intelligent and desired.
AG. GM's line of thought is spot on. My take form GM's arguments - it is down to a combination of prudence, progressive transformation and being pragmatic whilst shunning away from wishful thinking, over excitement and the textual approach to the interpretation of the constitution.
Hahaha...i wasnt going to comment...but many people are only seeing coherence to the detriment of substance....CJ Mutunga is brilliant...and so is Muigai....a person who has appreciated CJ's gifted scribbling hand would attest to it.
Somebody mentioned something to do with local tribunals. Can any of them comment on the same because I believe that is a Very important issue, beyond the theory of the law. Somebody said that the law is an ass, please explain. I believe that the law is not always fair and I can elaborate if I were to be requested to explain my position.
A great debate. Surgical review of the Constitution as to whether we have a theory of interpretation or not in implementing it. "Doctrinal' is a theory 'Purposeful ' is an approach! To quote Prof Githu.
Prof you are right. We have no theory of constitutional interpretation in our constitution. No philosophy, believe etc contexualised from our history and experience underlines our constitution. I agree that it was a reactionary as opposed to a living document.
This is very informative debate about Constitution that i ever watched.though i'm watching this Video on 28 October 2024 that's is 5 years later after the interview 😂 Kudos to the great debaters and i want to appreciate the intelligent and brilliancy of Prof.Githu Muigai i think he should become our next Chief Justice after Martha Koome.
Very refreshing debate here. It takes us forward to a situation where universities are leading in promoting a culture for decent dialogue. It takes me many steps forward in understanding Constitution and Law as foundations for Sustainable Development.
With all due respect for this intelligent educated two people of our own I hereby raise my own question did you leave the judiciary and the arm of the law in a better position than you found it
This is brilliant, for once i am listening to this discussion on you tube instead of ussual stuff of comics on viusasa or football.I am happy by the presentation we really need more discussions and deliberations.Thank You,from Baraza La Taifa with love.
Prof Githu Muigai is an amazing lawyer and he has come from far but he is eloquent. My brother too is doing law at Riara University and he lastly studied abroad for three years
I respect both legal minds and their views regarding our contitution. However, Prof Githu Muigai's presentation skills that hit differently and right - regardless of whether you have studied law or not! This is making law accessible to other technocrats and the layperson.
Infact I admire prof Githu arguments, it reminds me of Ogola a lecturer who took us through commercial law then. He said the constitution is the skeleton and statutes are flesh.
Broad based GNU is a good proposal. For gender equity, let the electorate vote parties then the parties nominate representatives based on 50:50 gender rule.
UON students just attended this discussion and did not take notes including their lectures seated at the front? Get serious next time in order to engage meaningfully.
A great debate. Surgical review of the Constitution as to whether we have a theory of interpretation or not in implementing it. "Doctrinal' is a theory 'Purposeful ' is an approach! To quote Prof Githu.
Brains at work, I salute the two gentlemen prof willy Mutunga and Prof Githu Mungai. However prof Mutunga is very intelligent but prof Githi is more eloquent and colds his words very well my take.
The former AG and mortician Githu Muigai prof is articulating the spirit and language of the Kenyan constitution very passionately and with great insight .Bravo prof .
As a Kenyan I think we need such publick forums ,to educate the normal mwanainchi in this very important issue of the constitution ..so that anytime we have any amendments kenyans can be aware and a part of those changes rather than always finding this issue a s a very strange killer enemy.. Coz this is what happens just an opinion from a Kenyan
Pro Githu has the nitty-gritty of the constitution of Kenya 2010. He should take the initiative to educate the Kenyan masses on the same. He will be a hero if he goes to the level of Wanjiku. Former CJ Mutunga is brilliant, but age has caught with him. More mentorship from these learned friends should be enhanced.
If law lectures can't agree my conclusion is that we shall always be having conflicting judgments...mainly biased towards who your lecturer and mentor was.
You shouldn't contemplate reviewing the constitution every 5 years... that is not in the interest of economics of justice and certainly not in the interest of the country. Constitution must be let to mature in my view... things must be done mos mos.
I honestly can't get what Mutunga is saying. He is all over the place and barely answering the question asked. Githu on the other hand is simply brilliant!
The media should bring Prof Anyang Nyongo to the fray...the deep thinking therein is a treasure trove of monumental proportion... Good discourse by the two intellectuals...👌👌
amazing debate, but the camera man was only interested in capturing ladies or was it the editor? I would have loved to see who asked the first question.
Great debate indeed . Although I tend to think the threshold of 50% + 1 was to advance that every vote (including minorities) counts unlike in the past. At least it recognizes broader appeal and effort in the first round. Broader base to accommodate national leaders is legitimately a different issue and quite relevant given the outcome so far. But how far will that proposition go if the progressive values in the constitution were entrenched properly. An audit , also arising from the experience of a different political leadership, may establish and inform a change to the supreme law.
Who came here after the BBI ruling? Am afraid what Githu Muigai said about judicial activism came to pass. With our current judiciary it's impossible to change our constitution.
I struggle to understand him.
Absolutely
Very True. Eloquence is a gift!
Prof Githu is real teacher. I have no background in law but I totally understand hi argument very clearly. I remember his submission at the Hague. He was excellent and very eloquent.
I'll always be excited to a attend Prof Githu Muigai's class if I was his student. Brilliant Teacher
What a beautiful thing to see experts/veterans engage young people in intellectual discourse like this. I'm not a lawyer but I can appreciate this. You never get see this in this country.
Prof muigai is an intellect....ur coherence sums it all
Prof. Muigai stands out like a ten-fold beacon in the night!!
I can listen to Prof. Githu Muigai all day.
Being Loud does not mean you know the Law. These two gentlemen are really great.
This is what university was about. Debate is a great platform for intellectual growth
Cj Mutunga is one of those genius who's ain't eloquent and fluent but he will give an answer in sentence and silence the whole essay of the other
Prof. Githu Muigai and former CJ Willy Mutunga are great sons of Kenya. What a refreshing debate.
Pro. Muigai displays exceptional intellectual ability with great universality in genres, typically to a degree that can be associated with the achievement of new advances in any domain of knowledge.
Professor Gitu was my jurisprudence law lecturer at uon. Great intellect
Both! Prof Githu and Dr Mutunga are intellect. But Githu seems to be more articulate and eloquent maybe due to his legal professional application in teaching! This debate to me is one of the best Deliverances ever recorded! Similar debates deserve to be held on for public acknowledgement! A job well done!
as always Prof. Githu Muigai was on point, articulating complex constitutional matters in a way that a non-lawyer could understand.
ICC
I don't think so, but respect your opinion. He can't even pronounce the term constitution....he says condition☺️😊☺️😛
**constion
I agree he articulates well. He is gifted and well learned. However the debate was btn living law and theory. Which one you take is upto you
@@pn2074 , well you cannot discredit his articulation on the basis of failure to pronounce a single word, more so given that he has probably mentioned the word constitution his entire lifetime. i still hold my position, he is a great legal scholar.
Githu muigai is very wise and smart very learned , not some jokers we have in Kenya , who think they know the law
The debate was robust, a share of the country's, continent's and world's best legal minds. An understanding of the Kenyan jurisprudence as by practice on the bench in Constitutional interpretation. Thank you Chief Justice (Emeritus), thank you Attorney General (Emeritus)
prof githu muigai argues in the most acceptable way...i always like his wisdom
Exactly... In a factual, brutally honest but in the most polite and honourable manner.
Prof Githu Muigai is one eloquent man and Dr mutunga though brillinat lost this one due to lack of cohherence! in my opinion. Now give us Prof Githu Muigai VS Dr Otiende Amollo. This will be a quite something interesting.
A splendid and informative environ this debate. I also share your query on the whereabouts of the brilliance that is Amollo!!!
Who else viewed Muigai's parts only and skipped Mutunga's Parts, the later is boring like some lecturers do
I am here 😂😂 I was only interested in Prof Githu's sentiments...very interesting and educative 💪💪.
To mutunga I only here, "you know...aaah..you know " very boring from him. 😯😯😂😂😂
Kumbe am not alone
I did 😂
You skipped because as an African I believe, we always think someone who is speaking fluent English,French or any colonial language fluently and with "desired accent" sounds more intelligent and desired.
AG. GM's line of thought is spot on. My take form GM's arguments - it is down to a combination of prudence, progressive transformation and being pragmatic whilst shunning away from wishful thinking, over excitement and the textual approach to the interpretation of the constitution.
I never get enough of this debate
Only a professor can deny knowledge of advanced words and their meanings and make the person that uses them appear unlearned.
Hahaha...i wasnt going to comment...but many people are only seeing coherence to the detriment of substance....CJ Mutunga is brilliant...and so is Muigai....a person who has appreciated CJ's gifted scribbling hand would attest to it.

These are very brilliant minds, am deeply humbled.
This two guys are a treasure of knowledge and experience......maraga and team should emulate
A great debate. We should be seeing, watching and having more of such debates. ALL Kenyan Universities should pursue this line!
A great debate. Surgical review of the Constitution as to whether we have a theory of interpretation or not in implementing it.
"Doctrinal' is a theory 'Purposeful ' is an approach! To quote Prof Githu.
Very heavy presentation by the two big minds

Prof you are right. We have no theory of constitutional interpretation in our constitution. No philosophy, believe etc contexualised from our history and experience underlines our constitution. I agree that it was a reactionary as opposed to a living document.
I wished the debate would have been between Prof Githu vs Prof PLO Lumumba
This is very informative debate about Constitution that i ever watched.though i'm watching this Video on 28 October 2024 that's is 5 years later after the interview 😂
Kudos to the great debaters and i want to appreciate the intelligent and brilliancy of Prof.Githu Muigai i think he should become our next Chief Justice after Martha Koome.

With all due respect for this intelligent educated two people of our own I hereby raise my own question did you leave the judiciary and the arm of the law in a better position than you found it
Prof Githu is a genius. Period!!!!
Kenya would be better if Dr. Willy Mutunga was still CJ. He always looked at the greater good.
That's why I love "POETRY' I beg to support. I love this debate.
The brilliance of Githu is astounding, well spoken.
These are just great Minds and Kenya is blessed with Great minds like this and the upcoming ones.
Indeed
I can listen to Sr. Counsel Githu Muigai all day!!!
The greater Good 👍. 😊
@44:05 “ I then went to parliament where the “PIGS WERE “, very telling.
This is brilliant, for once i am listening to this discussion on you tube instead of ussual stuff of comics on viusasa or football.I am happy by the presentation we really need more discussions and deliberations.Thank You,from Baraza La Taifa with love.
Prof Githu is too eloquent yet a conservative yet I trust our constitutions is progressive, Githu needs to debate Dr Otiende Amollo.
Listening to Githu you realize just how brilliant the man is. wow!
Bonny Bonny vhfvgf
Two great minds imparting to us great knowledge and experience
The setting is good, conversations very objective, information conveyed with clarity.
Prof Githu Muigai is an amazing lawyer and he has come from far but he is eloquent. My brother too is doing law at Riara University and he lastly studied abroad for three years
A length introduction does not add any substance to a debate. It is waste of time.
You should change the title to include the subject of the debate so that this content can be easily accessible through key words in search engines.
I agree
I respect both legal minds and their views regarding our contitution. However, Prof Githu Muigai's presentation skills that hit differently and right - regardless of whether you have studied law or not! This is making law accessible to other technocrats and the layperson.
For purposes of argument, this debate should've been between Githu Muigai and PLO Lumumba.
Githu and PLO have a closely similar view
simeon nyachae 100%
I do find PLO to be very eloquent, but technically shallow. He's a preacher kind of person
Githu is amazing and great communicator.
its genuinely a decent debate
E?sSaqqr
These guys have both been CJ and AG, so why do we still have so many issues with the rule of law?
Lack of independence of the Judiciary is the problem
Great minds differentiated by personalities in the two legal intellectuals.

African audiences ha ha.
Make notes on RUBBISH SPEECH
A great debate. Surgical review of the Constitution as to whether we have a theory of interpretation or not in implementing it.

The guy who lost the ICJ??? what A PROFESSOR ???
can we av a similar debate in place to be proff Githu and Proff lumumba. over to you the moderater
I understand willy mutunga once taught githu muigai at u.o.. it turns out githu muigai is more brilliant than his teacher
Pluto verses Aristoteles, students are by default better than their teachers with the passage of time
The former AG and mortician Githu Muigai prof is articulating the spirit and language of the Kenyan constitution very passionately and with great insight .Bravo prof .
I love law because of Prof Githu. If am done with the PhD in statistics, then I should think of a law degree.
This guy Githu Muigai is brilliant
This was very Informative
The Reason I became academic is bcoz of Prof. Githu Muigai.
Increasingly the sagacity in Prof. is of unique rank
As a Kenyan I think we need such publick forums ,to educate the normal mwanainchi in this very important issue of the constitution ..so that anytime we have any amendments kenyans can be aware and a part of those changes rather than always finding this issue a s a very strange killer enemy.. Prof. Kivutha Kibwana should be the third debator.
Prof very articulate and convincing.

What is the topic of the debate? Is it a discussion or a debate? Who is proposing and who is opposing?
Watching and listening from Isiolo County
If law lectures can't agree my conclusion is that we shall always be having conflicting judgments...mainly biased towards who your lecturer and mentor was.
if only Prof defined 'theories of interpretation' and 'judicial activism'

Good discourse by the two intellectuals...👌👌
Kaikai kip up
Is professor Mutunga really really coherent?. It is n9t easy to put together what he is saying. Professor Muigai is a very clear man
Amicus curiae aka Prof Githu is just brilliant
This is the Battle of legal minds.
I really admire the way the two learned guys are articulating the speech.
I loved the humour in this...building bridges to nowhere.
A Debate worthy the watch!
At 1:20:00 he was attacking Uganda directly
amazing debate, but the camera man was only interested in capturing ladies or was it the editor? I would have loved to see who asked the first question.
me too
Prof. Githu Muigai is an excellent thinker and articulates his submissions with great clarity. The other one bloviates a tad too much...
How i wish if Prof. Githu Muigai were to become our CJ .
Great debate indeed .
