7 Likely Changes in Social Security Disability Because of the COVID-19 Crisis

  • When you understand how the coronavirus pandemic has changed the Social Security disability process you can increase your chances of winning by adapting to new practices and procedures.
    In this video, I share with you seven (7) major changes that I have seen over the past few months. SSA is still open but due to the pandemic Social Security employees are working remotely, which means longer wait times and no more in-person service.
    In my practice I have completely overhauled how I prepare my clients for hearings, and how I interact with SSA on a day to day basis. I also look for different types of evidence since many of my clients can no longer visit with their doctors in person.
    The good news associated with these major changes has been that more cases are being approved. Many judges recognize that the job market in the midst of a pandemic is extremely difficult for a young, healthy person, and that it is almost non-existent for an older claimant with chronic health problems.

    Good insight! We've seen an uptick of approvals as well at the hearing level during COVID-19. I'm sure it's got everything to do with judges feeling much more comfortable (and grateful) to be able to continue doing their job from home and the stark contrast to the plight of claimants in desperate need for financial help.

      I had a phone hearing on September 9th and the judge found me fully favorable before the hearing and said he’ll get it out as so as possible. My attorney notified be before the hearing that it was approved but judge didn’t want to pay all of the back pay. Now the waiting period.

      I’m scared because I’m only 29 but a long work history of 13 years and I’ve had my disease for 15 years while it’s gotten worse over time it’s just now getting to a point of not being able to work . I’m praying

      Feel the same... ESPECIALLY if some has been on SSDI for over 10 years...with how much has changed in technology in the job market and now Covid reducing jobs I would pray they make it permanent.

    When I was getting ready to apply for disability I did my homework listening to this guy....he is very good at explaining things you need to do and is very helpful. I advise everyone to do the same. I got approved very fast and didn't go into it uninformed.

      My phone court day is in less than a week and I’m very nervous . My disability shows physically in certain areas . Idk if this is going to harm me by it being a phone appointment

    My recommendation is to fight. I’m on my 5th year now after initial filing and before hearing they sent me to a SSA doctor that said they found it hard to see me returning to work as well as my specialist, the judge flat out said the SSA doctor was not the one to make the decision on my case in my hearing denial. So no I’m suing the SSA with a different lawyer. I will keep fighting until I get benefits it’s the only thing I can do.

      The SSA doesn't ever win a case for anyone because they are not for you or anyone else that's why it's better if you get with a private law firm because they have no connection with the SSA that's the only way you will win your case . The SSA have their own psychiatrist and their own doctors and their own judge's and they all work for the state that's why you keep losing. But if you get with a private law firm they will send you to their own doctors psychiatrist etc and judge with all of the above I will guarantee you that you will win 💯.

    It also should be mandatory to give ppl on SSI AT LEAST "poverty level" equivalence. As it stands my SSI each month is around $2-300 under poverty level for a single individual. I mean @ least give us "poverty level" payments , instead of "BELOW poverty level"....ahhhh, I hope things start getting balanced out, not fair some people are getting their DOGS collagen injections and other people are sleeping on the streets or worried each month that they may be on the streets....tired of rich richer, poor poorer

      It's all about your work record and how much you paid in... very important to have a great work history with almost no gaps.

    I’ve been denied after 3 times. I will miss 96 days on average per year of work for smoke inhalation injury and 3 lung surgeries. Occupation expert agreed that I would not be reliable to any employer. SSDI is turning into a judge vs medical expert making the decision. I’m thinking about leaving the country. It’s sad.,

      That sucks man where do you live what state? I know in my state of Missouri i have been fighing 9 years fro mine the judges approval rating makes a big differnce and mine is mostly mental problems so those are harder t get in my expiernce and from what I have heard.

    What else is different? I had my phone hearing with the ALJ on 5/14/21 and received a phone call from my local SSI office telling me that I have a fully favorable decision from the ALJ and they need to "warp up a few things" before I start getting paid. I was schedule for an appointment for 6/03/21. Is this normal?
    For those who want to know
    1. Applied January 2017
    2. Dined
    3. Requested reconsideration and denied
    4. Sent to the ALJ and denied, however, the ALJ completely messed up and my case was remanded back to the ALJ
    5. As stated above, had a 2nd chance with ALJ on 5/14 and received phone notice of a fully favorable decision today 5/20
    6. Did not have an Lawyer
    7. Have not seen my doctor since 2019
    8. Located in California
    Update
    Received the ALJ letter in the mail yesterday 06/01/21 with a fully favorable decision.

    Great Video once again. 7 Excellent thoughts. I'm thinking that due to the COVID-19 and people receiving Stimulus Checks, the extended Unemployment Benefits, Aid to Businesses, and the overall terrible condition of our Economy right now... Judges will be somewhat or much more lenient. I think the phone hearings aren't a good idea, because some people just aren't comfortable talking to someone on a phone under a stressful situation.

    You are the best expert teacher online concerning all aspects of SS. I'm age 63, on SSDI and was told review in 5-7 years. This is the fifth year. Should i expect a review again?

    Great content as always. It is going to take a while for the job numbers to catch up. Overall, using the OEQ data, there were 5M less jobs in the data from 4th Quarter 2019 to 1st Quarter 2020. The big drops will not be seen until the 2nd Quarter data is released. It usually takes at least a month before US Publishing releases the data.

    Thankful that I never had to have a Hearing/I was approved in about 3 months so meeting a 'listing/s' is probably still pretty quick administratively; I realize these vids are all about Hearings but for some applicants maybe you won't need one - fingers crossed for you.

    I wonder about more people getting a closed period of time, so they need to reapply in a year or two when they may have better technology to show the applicant very clearly and zooming in on them so the judge can see potential clues to pain or difficulty moving. I am so glad that I did everything you said to do and didn't have to wait for a trial. Life right now is stressful enough!

    Hello! Thank you for always keeping your community up to date! Quick question, I’m at reconsideration and I sent in neurosurgeon notes stating I was getting 2 level lumbar fusion last week. I faxed in that info and got response that it was received and they put my app as in dire need. I am now 7 days post-op and recuperation is súper painful frustrating and hard. Do you think that them knowing I was going to get surgery done will give them a reason to deny me again with the thought process that the surgery will fix my problem??? Thanks in advance looking forward for your response. I’m down to $60.43 cents in my bank account and I get no unemployment no púa nothing at all whatsoever except for 119$ food stamps living in a stranger’s house very far away from my family.. desperate definitely!     Suffer from Sarcoidosis Chronic Anemia Lupus COPD Endometriosis ect... my case is at the appeals council since August 2019 , I called yesterday was told cases are not being looked at until it’s been at the AC for 15 months 😒
    Unbelievable is all I can say about this..
    case going on since 2017 .. I was hoping for a decision by now ,it’s unfortunate for all who desperately need assistance..

      My case has been going on for over 5 years. Appeals Council sent it back to be redone by same judge that denied me. They scheduled a new hearing last year and it had to be rescheduled, still waiting on that hearing to happen. That's been over a year.

    It’s been two months since I went back to work after my accident ..I can’t take it anymore because I work at a grocery store and they think it’s an excuse when I call out because of my back pain. Do you have all suggestions?

    The judge that denied me a few weeks back makes $172,000 a year.. I got denied during a freakin Coronavirus with heath issues including chronic high blood pressure. I' just turned 50 but were around 47/48 when I first applied.. And this is my second denial....I don't think I have another two yrs plus to go back through all this again! But God have Mercy all of us.

    I was told that since I have CANCER and drawing SOCIAL SECURITY there is NO NEED to apply for DISABILITY IN THAT THEY WOULD NOT GIVE ME ANY MORE THAN I CURRENTLY RECEIVE.

    Consultative examinations have resumed in Florida as of late June. They would be impossible to do via telemedicine.

      JDave Foster Would be impossible to do fairly and accurately, but apparently in TN (or at least my case) they don't care about fairness and accuracy. I didn't even get a chance for the telemedicine...the "expert" didn't even contact me by phone, just looked over notes (no test results or anything) from a previous doctor I saw over a year ago!

      In Philadelphia they have resumed also...social security wanted new xrays and a physical done, which I had done two weeks ago..I'm hoping to get an answer this month.
      This happened before covid reared its ugly head again in my city.They may have stopped now

I am on SSI, due to many health issues. Her AODL are not good. She has been home schooled for about 2 years now.

    Hi Mr. Ginsberg. I live not far from your practice in Macon Ga. I was in a car wreck last year and now I'm in constant pain and cannot work. I have had spinal injection, physical therapy with no improvements. On my last visit with a spinal surgeon I have been told I not only need a cervical fusion but also a lumbar fusion. I have a disc herniation at C5-C6 and C6-C7 also spinal stenosis, lumbar spondylolisthesis, severe compression of the L5 nerve root and was told that I have severe spinal instability. I'm only 39 and I feel like being I'm younger I don't have a chance. In your opinion do I have a case ? Also are you accepting new clients at this time? Thanks...

    I have a question I recently got a form in the mail for a review not sure if it’s the short or long one and I’m a little bit concerned about my current state bc due to covid and as you mentioned being afraid of other people in the waiting room who could be sick and get me sick limited the number of appointments in the last year and half to only what was absolutely necessary. As someone with ptsd and anxiety the threat of dying being plastered on the tv constantly had me scared to death and I didn’t think it was reasonable or expected of me to risk my life and that of my close loved ones by going to providers where I had already maxed out therapy. Literally the only point of these appointments would be to vent and complain to the doctor about my symptoms without them having any ability to do anything to change that.
    While I did this prior to covid to appease SSA I was too scared to expose myself for no benefit and I didn’t expect that Social Security would use this as an opportunity with the doctors being closed and procedures being shut down to review people. I’m afraid they’ll claim my reduction in appointments is due to improvement when in reality for a period of time these doctors were closed or weren’t offering steroid injections or other elective treatments during the pandemic and I’m sure many people like myself even if they didn’t have anxiety or PTSD going into this pandemic with all of the bombarding of fear messages and stay home or youll die and be responsible for the deaths of your family and friends I’m sure others refrained from seeking treatment to reduce the chances of getting sick and getting others sick.
    What can I do to help myself in this scenario? I have been having regular weekly visits with my therapist who I’ve been seeing for the better half of five years first in one facility and then I followed her when she opened her own practice.
    Also I regularly went to PT during this time as it was one of the therapies that at least offered some benefit of less pain more mobility and the ability to placed back an alignment a little help w insomnia etc so that to me was worth doing whereas having a 5th Rhemotologist tell me there’s nothing they can do for me no new meds or therapies are available since last year and have risked possible death for a 5 min visit where I get a shoulder shrug and I’m sorry. Just because it’s a different doctor doesn’t mean they have some magical cure the last one didn’t have access too and I end up having to move to another bc once the doctor decides they can’t help me they don’t want me wasting time on thier schedule and I’ve been told as much.

      The last I heard was that no CDRs would be initiated until the pandemic was over. That's what it said on their website last time I checked it.

      @@stlautismman43 I just received a short form CDR last week and a friend of mine just lost his benefits a couple days ago after his CDR. So, they are still going on and cutting people off.

    On my renewal letter they just ask for past 2 years doc visits and e.r and medication list so mail back its been a month tried to call but no one answers

Out of curiousity, what was the title of the SSA form (listed at the bottom of the page: e.g, "SSA-(followed by a 'dash')-(followed by a 3 or 4 digit number)-and may [or may not] end there; or: MAY or May Not-be followed by an additional dash-followed by-[usually one or two English alphabet letters? Was it the "update report" ? (SSA-455 ) ? Just curious-because this form usu. does not ask for a medication list.

    I reapplied in December 2019 and this March 20th and the 27th I had to go see two of Ssdi doctors and now I am still waiting on a answer. Had back surgery in 2018 and I am still not better I am in more pain now then before.

      Therecia, I would suggest that you should not rely on the SSD consultative evaluations to win your case. Instead ask your surgeon or treating orthopedist to fill out a functional capacity evaluation or otherwise comment about specific work activity limitations (i.e., likelihood of missing time from work, pain at a level where you cannot concentrate, etc.). Second, you have to say more than "I am in pain." You should explain that your pain interferes with attention and concentration, pace or work, reliability - in other words, why does your pain make you less reliable.

      Therecia your probably going to need a private law firm. Social security disability is mostly handled by the state you will nerver win with them. So what you should do is get a private law firm that works with disability case's.

    I am on SSDI and tryed applying for ssi when I called they set me an appointment to apply for the ssi cause it's not enough income Bim getting for my children and I and the person that called me right away had an attitude as if the money was comming out if her pocket that's how I felt she's like it's a wasted of time if we do the application cause I can tell you rn that you won't qualify well that day I wasn't really feeling well so I'm like ok then I started to research and I do qualify for it she just didn't want to take the time and do the application or something I just got a letter about it and it says that I can qualify for the pass ssi to help me to get able to have a plan wish I do to help me get a plan have you heard about this the only thing she had told me since I'm nit over 62 abd nit blind I don't qualify but she fir got about the third one is no source of other income and I have more to pay now that I'm nit making it

    My doctor deleted? lost? records of an MRI he ordered, along with a physical therapy prescription from it. As a result, it was left out of my private LTD claim and SSDI claim and has seriously hurt my case. What can I do? I am so mad as I didn't know about this until after I was denied initially.

    Thank you! Thank you! Thank you! I applied March 3rd on strong advise from my doctor. Phone interview March 30th. Filled out 24 page questionnaire around May 24th and had a disability physical June 30. On to the next step.whatever that might be. DDD from L2 down to S1,
    spinal stinosis and secroiliitis.

    Hello, you seem knowledgeable on the subject so I have a question I’m hoping you can answer. My mother received a pandemic ssi card I think it’s called. And she received a lot of money on there and she hasn’t worked for years. Is there a reason why she can get so much or would u think it’s is an error?     My grandson was born with special needs and I’ve raised him to this day. I applied for SSI when he was 17 because I became disabled and had to stop working. I am his current payee and he pays his portion of the bills and I purchase his food with his money.
    Right before the pandemic hit they requested his signature because he was due for an evaluation to see if he was still eligible. Does this sound right to you? How can someone who is born disabled get better enough to not be considered “disabled”? I never received anything until two days ago when they requested another signature for records of some medical foundation that never had anything to do with my grandson or myself.
    We live in California and I really don’t understand why they are doing this unless they were told to review cases and to cancel as many as possible. I’m disabled to this day and he is my caregiver. I’m a senior who is high risk due to COPD and cannot go out and my grandson does not understand the communication required to speak for himself.
    Are you aware as to why they are bringing this up at this time? He takes care of me but what I receive on SS Retirement certainly will not support both of us if he is denied his disability benefits. Do you have any advice?

    it took me 2 years to get my social security in 1990.they are so slow approving people . with till you try to get low housing 2 more years to wait.

    I have a rare artery disease called Takayasu’s arteritis, fibromyalgia, depression,anxiety etc.... I was denied a few years ago and recently applied this month. Like how can they deny someone when their entire right side is occluded?! Some days I can’t even walk because I’m so dizzy and in terrible pain

    I was extremely blessed I was finally approved for Ssdi after being denied 3x in right before this pandemic I. December 2019. God is truly amazing!.. can you do a video on applying for TPD and student loans. Keep up the great work! Everyone stay safe!

      Congrats! I feel blessed too! I was denied 4x and had to take it to federal court and was finally approved August of 2019.🙏🏼😊. It was in January that i got my retroactive payment and all. I feel blessed.

    I am going through my initial application(filed in March just before the Covid). I have a previous spinal cord injury from 5 years ago and was in a semi accident 2 1/2 years ago that injured all of my back with no hope of improvement without major surgeries. My list of diagnosis and physical/mental impairments are long and I meet some (not just one) of the SSDI listings I already went to a CE for a "physical exam" a few weeks ago and now they are sending me to a neurologist for a "physical exam". I am shocked to be sent to 2 different providers in this Covid crisis. I am in Oklahoma so I don't know if that has anything to do with it.

    Hi Jon, My wife has fibromyalgia and severe back problems she was getting Medicaid and was about to receive back therapy because she was already getting help for the fibromyalgia but then they took her Medicaid away and now she has no insurance and I'm on SSDI so we can't afford insurance for her and that's been about 4 years now and her condition has gotten far worse is there anything she can do as far as Social Security is concerned Thank You.

    Hi Mr. Ginsberg, quick question. I applied for Disability Reconsideration on Dec. 1, 2019. It's been approx 8 months and I haven't heard anything from anyone. My caseworker does not return my phone call. Is it possible that NO ONE is working on my case due to COVID? Or do you think that my caseworker wants me to have an exam with another DR, and that's the hold-up? If so, why don't they let me know something?

    I applied at the end of March this year sent all my recent medical which included MRI and X-ray and Nero surgeon. Surgeon wants to,do,fusion from S1 all the way to T11. Also wants to remove l5, l4 and l3 vertibra and replace with artificial ones. Anyway I never had phone interview nor ce exam but my claim status now say a medical decision has been made and we are working to process your benefit application. Is this just a generic message they use or is this a sign of approval? Thanks

      Hi Joe, unfortunately that is a canned statement and means nothing one way or the other. I received that many times during my initial application, reconsideration, appeals, etc until I was finally approved in June. Best of luck to you!!

    My son’s SSI was drastically reduced because I had lost work due to the pandemic and claimed unemployment. They probably expected a family of 5 to live on what little they paid. I had no choice but to claim PUA to pay bills, but SSA will probably never understand that.

    I had a hearing feb 27,2020 right before the virus I had a attorney with me who said I have good chances of winning the training vocational specialist even said I can’t work but the judge sent me to a ssd doctor in March I went there but the se called off for family emergency and haven’t heard nothing since any chance of knowing what’s next

    this my experience with s.s. is that i had there dr. ok me but in court they had a different dr to testify to say some thing totally different but i had a good attorney and he tripped the guy up and got him to say that yes i could not do a full work day

    I had my second appealed hearing January 15th had second back surgery January 23rd judge denied it didn’t believe me so I appealed with AC it was remanded alj had proof but stated she didn’t plus 4 other reasons it was remanded alj had it from sept till December now odar said I was sent a 25 page report is this a good sign? She did say that’s a lot of paperwork for just a hearing scheduled can you help me understand

    Sir, my wife was just denied at alj hearing. Basically doctors notes didn't play well & advocacy group failed her, not pointing out issues beforehand. Her work credits run out in September... Judge has 80% denial rate. Should we appeal or submit New application ? Thank you

      Just get an Attorney who does SOCIAL SECURITY cases ONLY!!! I was denied at my first hearing so I got an Attorney and I won!! SOCIAL SECURITY pays your ATTORNEY out of your social security money.

    I applied in March 16 and they sent me a lot of letters rhe adult function report questionnaire and also a questionnaire about the and also my limitations and also job questionnaire about the things that I did at work why are they taking so long to let me know if I am approved how long it going to take them if I am approved or denied

      For adult SSDI and/or SSI applicants: It is common for them to send applicants the following: 1) SSA-3369-BK "Work History Report Form-Adult" ;
      2) SSA-3368-BK "Disability Report Form-Adult" ; 3) SSA-3373-BK "Adult Function Report QuestionnaIre" ; and sometimes a "Third Party Report Form"l
      The process takes a while, they need to gather medical records; testings/ observations; and they very often send claimants to third party ...

      When you apply for a hearing the amount of time it takes to have a hearing scheduled will depend on the backlog in your area. More recently I am seeing delays of 9 to 12 months - the delay has gotten shorter this year.

    I had a telephone hearing July 21st. My lawyer represented me as having a 1.04 listing. At first the judge was trying to figure out what my exact date of disability was. My lawyer called me recently and said the judge went in and found me under not 1 listing but 2. Does this sound good on my behalf? Im just waiting to see what my outcome will be. @Jonathan Ginsburg

      Currently, video hearings are on hold because they are held in SSA hearing offices, which are closed. My best guess is that OHO (hearing offices) locations won't be open at least thru the end of 2020 so a phone hearing will get you a decision faster. As far as which is "better" that is hard to say. Some claimants are going to feel much more comfortable with their lawyer by their side and a judge they can see. Others would rather have their cases heard sooner rather than later.

      Interesting question. In theory, when you apply for unemployment you are stating that you are ready, willing and able to work, whereas when you file for disability you are stating that you do not have the capacity for any type of work. Some SSD judges see unemployment as being inconsistent with disability whereas others do not. My argument has always been that you (the applicant for disability) are not a doctor or a vocational expert so saying that you are prepared to try to work is not inconsistent with also stating that you may be "disabled" as defined by Social Security. I can also tell you that in this current coronavirus climate I am not seeing any judges deny claims because an applicant is collecting unemployment.

    Hi Jonathon, my name is Theresa Hoffman. 1st thank you for your videos. I have received my hearing date for my appeal. 1st time was rejected, just submitted paperwork. My work has hired Allsup to help get my Disability. My date is November 18th, 2020 at Noon, Pheonix, AZ Judge Paul Kovac (if you know him) In reviewing your videos, I beleive I have a good chance of getting it.
    1) Fell (at home) injuring my back 2/2/18
    2) I have been diagnosed with fibromyalgia in 2004. But always worked. rarely called in sick.
    3) Had a motorcycle accident 2014 broke 4 ribs and shattered scapula.
    4) Have worked as a Radiation Therapist for 27 years.
    5) I just turned 60
    Question for you, do I bring up my past history, always working through my medical issues. The back injuries from the fall have also caused neuropathy in my legs and feet. The combination of the fibromyalgia, 4 back injuries(from MRI) and neuropathy, limits how long I can sit, stand and walk, depending on a good vs bad days 15 minutes to 1 hour. Again thank you for the videos, I feel that I am prepared to talk to the judge. Any other advice would be greatly appreciated.

    Johnathan I am on SSDI, my Husband is Air Force and I need him to take care of me. We have to go to Germany and are in the SOFA Status process.
    My question is..Can I still stay on SSDI while in a NATO Country (Germany) or do I have to stay in the USA completely alone for 2 years?

      You can draw SSDI overseas, with that said...as you mentioned you will fall under the SOFA agreement being the spouse of a member of the Armed Forces and, it does not cover SSA issues. I assume you will get station either in Ramstein or Spangdahlem, so any SSA issues can be brought up to the consulate in Frankfurt,Germany. What you need to find out if the needed medical care overseas can be provided to you by the military, most likely at Landsruhl Regional Military Hospital. The real question is if you fall under EFMP (Exceptional Family Member Program). The AF will screen you months prior before your PCS move and will decide if you can accompany hin or not.

    I didn't have that with my lawyer. He actually lost my case for me, because of private conversation of marijuana use, knowing my judge was toughest on "drug addicts"?????? I am going to end up back to homelessness, after working at same company for 5 years.

    The ssdi dont want to approve me.i have been appealed 2 times now doctors dont see you dont review your cases an the caseworker doesn't want to do anything. Kidney disease has run my life. I rather be working, but can not. She told they are not processing claims do to convid19. I'm located in burke county Ga.

    What about reviews after one is 65 now? . 6 months until 66.2 years of age and no ability to fight soc should they want to kick me off of it. Tremendously worried with the budget cuts. There is no way to NOT be homeless as I was when I was awarded SSDI 9 years ago. at my age. it would mean sure death.

    I need you to represent me. My lawyer lost 2yrs ago and lost. I appealed haven't heard from him since losing,now they put hearing on hold. He is only worried about money. Told me to commit myself
