    China has claimed that the Philippines' agreed to a "secret deal" to maintain peace in the disputed Second Thomas Shoal region of the South China Sea- a place Manila asserts its claim over, despite China's repeated provocations. According to Beijing, a "gentlemen's agreement" was reached when a Chinese diplomat connected with Manila's head of the Western Command of military. To cement its claim, China released an audio clip of the purported conversation for a few journalists. However, the Philippines has rejected the claim, stating that only the President can sign international agreements. Manila has slammed the Chinese claims - with Philippine officials calling for the expulsion of Chinese diplomats.

      China empowered the coastal guards to take whatever necessary to protect her territorial integrity.
      The gentleman agreement with the Philippines military is to provide humanitarian supply on board the beached ship on Chinese territories.
      It is the Philippines military obligation to seek higher authorisation confirmation form her Government and not China, if they are not authorised to do so.
      From the recording transcript, the Chinese have been seeking confirmation from the Pinoy side.

    The problem is, the Philippines has check and balances in its 1987 constitution, the Executive branch (Office of the President and offices under it) cannot enter into a deal with other countries without disclosing them to our Congress. Any Presidential and Department actions that is not properly disclosed is illegal, therefore cannot exist.
    Also, only the Philippine President can make the final deal with any other countries.

    I am a filipino soldier and i fucking hate our leaders, what kind of leader would agree to this contract? And then be dumb enough to not expect that they are being recorded for such an act? I swear our military leaders and admirals are disconnected to the average soldiers, im just glad that by next year my service will end, and i will no longer have to die as fodder to these corrupt officials. 😢

    True or not, "secret deals" that involve sovereignty are invalid from the beginning. First, such deals violate the PH Constitution on sovereignty. They must also go through the Legislative Branch.

      @@zenaidasumugat7234 "Negatively affecting our country" - That's what China likes to think but I think that's not what's happening. Otherwise, we wouldn't still be supported by our allies.
      It is understood among foreign ministers all over the world that only a head of state (presidents, kings, and the like) can make dealings regarding territories. And, at least with the type of government we have, it is supposed to undergo scrutiny of the legislative and, if invoked, the judiciary, to make it happen. Finally, it is not supposed to be a secret, unlike what China has been spreading beginning with the "gentleman's agreement."
      Analogy: imagine a son or daughter secretly dealing with your neighbor for him to take a part of the family's backyard. When the father of the family saw that the neighbor is occupying his backyard and complained about it. The neighbor's response is: "We have a deal with your son!" - That's not valid. Only the father has the authority to make such dealings. But though he has that authority, it is not absolute. He has to disclose that to his wife, and children who are his heirs. The heirs should be aware of the extent of their property. And "secret" deals defeat that purpose.
      The Chinese foreign ministry should have known better (if the people running it are indeed qualified).

      The UK, Europeans n USA can go anywhere and claim any island or land occupied by natives or not but China cannot claim a few reefs which it historically has occupied.
      On January 17, in the year 1893, the Kingdom of Hawaiʻi was illegally overthrown. The following remembrance recorded by Johanna Wilcox speaks of the overwhelming sadness felt by the population after the overthrow and annexation of Hawaiʻi to the United States of America.
      The Spratlys and the Paracels were conquered by Japan in 1939. Japan annexed the Spratly Islands via Taiwanese jurisdiction as part of Kaohsiung on 30 March 1939. France and UK protested and reasserted French soveregnty.
      In 1946, the Americans reminded the Philippines at its independence that the Spratlys was not Philippine territory, both to not anger Chiang Kai-shek in China and because the Spratlys were not part of the Philippines per the 1898 treaty Spain signed with America.

      The text you gave talks about history and who can claim land. It seems to be biased toward China's views on the Spratly Islands issue.
      You said that the UK, Europe, and USA can claim land, but China can't. This isn't totally true because claiming land depends on different rules, like history and international laws.
      You also mentions Hawaii and compares it to China's claims, but it doesn't mention all the details. The situation with Hawaii was complicated, but it was accepted by other countries.
      When it talks about the Spratly Islands, it's not telling the whole story. Japan controlled them during World War II, but there were other things that happened later that changed the situation. It also says Taiwan had control, but that was only for a short time and not recognized by other countries. Plus, the part about the Philippines being told by the USA in 1946 about the islands isn't clear.

      I also checked China claims ownership of the entire South China Sea, ignoring international rules set by UNCLOS. This shows a belief that power makes what's right, which some call greedy. It's like going back to old era when strong countries could oppress weaker ones. with China must follow today's international laws to solve conflicts. Everyone needs to obey the law to keep peace, stability, progress and not use power to control the entire region.

      @user-oq4eh2in3w the underlying dispute between the claimant countries since 1945 is one of territorial rights over the SCS islands. After oil was discovered in the SCS in 1969, Philippines started to challenge China’s claims of territorial rights over the SCS islands, after having kept quiet for 25 years prior.
      And UNCLOS is not the proper forum because it does not deal with matters of territorial disputes or to resolve issues of sovereignty, as that field is governed by rules of customary international law on the acquisition and loss of territory, which can be decided by the ICJ ONLY. No jurisdiction means no power to define the sovereignty rights over the disputed islands. Taiwan controls only 1 outpost in the Spratlys, Itu Aba Island. When Malaysia, the Philippines, and Vietnam began reclaiming land around their features, So the Chinese said, okay, if you do it, I'll do it too, and China decided to follow suit. However, while Malaysia, the Philippines, and Vietnam could only reclaim a few acres around their features, China could reclaim up to 2000 acres with its massive resources.
      Only difference is that, for example if Malaysia can claim 20 acres, Chinese will claim 2,000 acres. So that's a game, right?
      UNCLOS clearly has no jurisdiction to rule on territorial rights. Only ICJ can decide, for example the territorial rights over Pedra Branca was decided by the ICJ. Can Malaysia now go and file a separate claim with an UNCLOS tribunal? It cant.

      They got a court for hired. The Permanent Court of Arbitration (PCA) not an UN agency, rented the premises at ICJ Hague and paid the off duty Judges during court breaks to interpret the UNCLOS law.
      Trying to make it look legitimate.
      The South China Sea Arbitration violated the basic principle of state consent in international law. The award is illegal, null and void, and has no binding effect whatsoever. Any attempt of citing the illegal award of the South China Sea Arbitration to undermine China’s territorial sovereignty and maritime rights and interests will not succeed.
      UNCLOS clearly has no jurisdiction to rule on territorial rights, Only ICJ can decide.     The Philippine Military is not allowed to talk to any foreign embassy and any foreign embassy is not also allowed to talk to any Department Heads, it is in Protocol. Only the President can commit the country to a Treaty and approved by Congress. We don't deal in secret agreements or any new model of negotiations. The Filipinos knew the basic laws and the authorities knew the sentiment of the people we want China out of WPS. Any agreement should be black and white meaning on paper to make it binding.

    If china's claim is true they are being fooled, and so naive of the protocol, they suppose to talk with proper authority (pres./dfa sec. of state) and proper document (written not wiretap ), and also they should have valid claim, accepted and based on international law/UNCLOS not just imaginary dash lines before they can enter into agreement or deal.

      China never followed or respected protocols or laws even its own pronouncements and commitments specially on things that opposes its projected interests may it be on trade in international laws or even on local laws and sovereignties China’s ways are more on under the table deals and through influence or coercion for intance if China faces a law suits they don’t look at the merits of the case instead they go directly to the judge for any possible manipulation and if not possible they’ll try influences step up and work its way to replace the un cooperative judge this is the pattern of China’s strategy in achieving its goals even on geopolitical arena this happens in the Philippines in Malaysia in Maldives and all across South America to Africa you’ll be surprised if one day India will have a pro China government as Germany had a pro Russian leader
