      LAA: as you "negotiate" damages, ask the judge to consider awarding you the actual cost of additional income taxes incurred, due and payable the IRS and your state (if you pay state taxes) to be included separately. I did, it worked (WA state). I figured it was their f-up and I shouldn't have to pay the increase in my income taxes out of the award for their f-up. I won. The city had to pay that portion of income tax obligation! This could be substantial depending on the amount of the award and ones increased tax obligation thereof. I do hope you spot this comment and check it out with your attorney. Let (us) know if it works for you where you're at.

    That second sgt committed Assault under the color and while armed, you have to make a written complaint and copy that complaint with evidence to the Attorney General and request Criminal charges. that Sgt is punk and out of control.

You blame the people who are exercising their right, do you want to change the rights or do they only apply when everyone feels completely comfortable?       ​@Colin Thomson They're asking for it? Yes, sometimes, but you can't paint with such a broad *brush*. A man on a bike literally came up and removed his camera and detained him for nothing, in fact that is a big part of why this was even posted. Again, if the police acted accordingly, maybe there would be less views, but that is a good thing, and it would show, "look, police are interested in upholding your rights". Do you never see an auditor video where police are courteous and don't abuse their power? Those do, in fact, get posted and that is the declared purpose of these audits.
      I don't know where you get the idea that the only entity that government officials serve is the Greater Public interest, and whether they should is a philosophical debate that dates back to the beginning of government. At the least, the right of the individual vs the majority is something that is important to protect, and I would go further to say that anyone who upholds the constitution is someone who knows how to do both. Maybe we are asking too much of our public officials, but I don't think anyone is asking for them to pick on someone because they don't want to give up their 4th amendment right or refuse an unlawful order.
      Also, what does it matter if you sympathize with them? If you think one should be compensated for appearing on this, then you should change the law, because the law says differently. If they break the law they should be held accountable, absolutely, but you can't lump them all into one group.
      "What’s the point of filming in an airport or post office?" Are they suddenly off limits? You're assuming there is supposed to be a point, the point is made after the filming in the post office or airport, or any other place where we see time after time people misunderstanding and real abuse, not of rights, but of power. There is no point until something happens where a point needs to be made. Usually that point is officers need better training, and that we have individual rights, and that those rights go by the wayside by popular opinion.
      How is filming antagonizing?
      All that being said... the original comment that this threads off of "Wow that is scary.. Can you imagine if you didn't have a camera, what he would have done..." I mean probably nothing. Depends how long he was standing there just watching the goings on. How long until enough people complain about you, that you become a problem for doing something you are supposed to be able to legally do?

Is he even doing an audit? does every cop know what an audit is? What if someone just wants to film? So, only people auditing have the right to film, not those who want to film as an independent journalist? Why should he even give a name? Trooper never asked for a name, he asked for an ID, that is an unlawful order, he then declared it was a lawful order. We are talking about the law versus what you personally, Colin Thomson, think is proper behavior. The law says he did not need to provide an ID. You like to make generalizations: "When someone refuses to identify, they’re either looking to provoke or up to no good." you are a mind reader too?
      In my opinion, you are right, walking around an airport just filming is suspicious, but it is not illegal. Yes, someone walking around just filming should be investigated, but saying that he needs to provide ID is wrong. The trooper didn't give a chance for a name, he went right to handcuffs. The Trooper was within his rights to investigate, and even detain, but not to elicit ID under threat of arrest. The officers behavior was his own doing, his failure to ask for a name was his own doing, the officer created a situation too, not just LIA, and LIA did NOTHING ILLEGAL, I can hardly say he did anything to create a situation, other than try to do something that is his right. The officer did what he thought was necessary in order to investigate suspicious activity. It is definitely questionable if the officer did do something illegal, we don't see that part on video. Now this is my opinion, but take away the goal of getting an ID, and all that the police did was "no good".
      Also, it's UA-cam. Using your real name is selfish, there are plenty of other people with that name, and how are they supposed to be on here with nothing to hide?

      In My day that young fk has what we called John Wayne Syndrome. Usually the normal after their 1y probation & up to 5y, only change was a great Sargent that nipped that sh!t quick.

Perhaps they force the issue in the hopes that they will be detained so that they can feign outrage. But they're actually very happy to be detained or arrested, because they know it will spread among the UA-cam auditing community and accumulate those views.

Wanna be Auditors, who most go into it seeing a cash cow will soon realize it rarely works. That's why so many have stopped making videos. They rarely have attorneys lined up to help them in case something bad happens and rarely do they have the money to go to a jury trial. This is the reality facing these Auditors.

      @@LongIslandAudit the type of complaint to file is an official misconduct complaint at the state attorney’s office. File each complaint/violation against each individual cop separately. You may have to go in multiple times to do this. The reason you want to do this is so they don’t dismiss the whole complaint based on the first complaint they read. The reason you file this type of complaint is because after the cop accumulates a certain amount of these complaints (usually 6 but it varies) it alerts the departments liability insurance. They get two options. Raise the insurance rate for the department or fire the cop. Cop can’t move to a new department. That’s how you fire a cop. If you have friends that were apart of the incident they should file the complaints the same way.

      Incorrect. You can be placed in handcuffs while detained, you can even be moved a short distance to be placed into a squad car and it's still a detainment. They cannot however say you are under arrest and then later decide they didn't arrest you because they didn't drive you to the station to book you. People are expected to Obey and not Resist when under arrest... so if a cop says you are under arrest then YOU ARE UNDER ARREST and the cop later claiming he didn't arrest you won't hold up in court.

      That depends. In many or most cases placing a person in handcuffs is indicative of being under arrest. But that doesn’t mean that every time a person is cuffed or placed in a cruiser that an arrest has been made.

      In other words, citizens are allowed to record police officers "so long as the police officers in question don’t object to being recorded." Don't believe me?...
      A Connecticut woman was arrested in her own front yard after she recorded a traffic stop in front of her house. When this issue cane to light, the cop claimed he didn't feel "safe" with her recording him, asked her to stop, and arrested her when she did not. Somehow, this was protected under section 1-B... Yeah.
      Face it, people... The deck is stacked, and the system rigged.

    I live in CT. EVERYTIME an out of state auditor flex their rights they get arrested! New Haven, West Haven, Bridgeport, Branford, etc, etc...There really are no in state auditors doing regular audits. Also, have you ever thought of wearing a chest area body camera like NNP and NNH? It will help when your cell phone gets grabbed and tossed.

      Actually there are a few that are just starting to pick up the baton and you are welcomed to join us. Personally, I am still in the support stage of learning/getting used to speaking and dealing with pos cops, not to mention studying the laws that they stupid cops often bring up to intimidate auditors. I’m out of New Britain, btw.
      Look up Northeast Audits and Constitutional Audits. NA has been off the scene bc he has been dealing with the case involving getting arrested by the Waterbury PD while filming from the sidewalk.

If a rookie like Costello (only on the job 14 months) deletes the footage, he will be done! But, we will see. If I get it, I will of course publish it...

    That Sgt. needs to face severe penalty. That was an entirely personally-based assault and destruction of property.       Weird because Auditing America did just that in 2019-20 and didn't seem to have any problems. Troopers showed up, told the complainants that the auditors were OK to film and left. Either the training has changed post-Covid or the auditors did things differently to illicit the different responses.

    Nice to see that deescalation training is coming into use! It’s scary how many officers believe they’re just entitled to your information without question. If last enforcement asks, you’re “required” to comply. That so many cops believe that it must be part of their training.

      I would love to do this too, but the problem if you have watched enough of Sean's videos, is if you do do this, the cops basically tell every local department who you are and if someone were to murder you on video they wouldn't do anything about it. I am sure he probably gets harrassed constantly even when not auditing because of these videos. I know it makes me a coward, but I truly don't know if my mental health could take the retaliation of my local police.

There are different ways to anonymously flex your rights like supporting channels like this or simply FOIA request every department that even has a slight whiff of corruption to it. You can do all these things anonymously and share it with the public

    Thank you for standing up for our rights it disgusts me how you and others are treated over a camera when the police walk up to anyone they want to and start demanding info about a person they have cameras if we treated them that way we would be in prison that’s where they belong for shoving you across the street like you were a criminal because he didn’t like your camera please make them pay and thank you again I’m so sorry you were treated this way I think all cops need to learn the laws and just maybe it’ll happen one day

But these guys don’t tend to post the stories unless cops create a scene and commit a crime. If everything goes legal I think they don’t even publish.

      retire isn't the right word, fired isn't the right word, ARRESTED AND PROSECUTED are the right words... but sadly they will treat this as a "personnel matter" and he will take early retirement to stop the investigation and the department will wash their hands of it, just like so many do, because prosecutors are reluctant to bring charges for clear attacks on citizens.

    Give a man a little bit of authority a badge and a gun and he thinks he's above the law what the sergeant did was obvious assault, which pretty much means everyone under him has the same mind mentality as him, I would pursue this all the way up the chain of command as far as you can go and I would personally sue the sergeant

      You can email the Governor, and most if not all state and local offices have email addresses. Or you can write a letter and make copy for yourself and send it to the commandant for the state police.

    Long Island Audit is one of the best. Not only does he know the law and his limitations but he's also articulate and can express himself without falling all over his words and thoughts like other auditors. He doesn't bait the police, doesn't speak in false arabic accents or swear at the officers like other auditors.

    CT recently passed a law tossing qualified immunity under certain circumstances. If you look into it it is possible to sue that Sargent personally. Ironically, the lawmaker who spear headed that change in law was stalked and harassed by the cops both in public and at his home!

Although some analysts claim it's still subject to the requirement in section 4-165 that the conduct be "wanton, reckless or malicious" in order to hold the officer personally liable. It also doesn't apply if the officer "had an objectively good faith belief that [their] conduct did not violate the law".
      But it didn't take effect until July 1st of this year, so there isn't any case law on it yet. Might be a good test case.

Imagine if he were dealing with someone actually in a bad mood? Hes dangerous. Wonder how many people hes assaulted and got away with it, how many peoples rights he's violated, how much he may abuse his family or pets.     Every auditor thought I was over exaggerating when I said Connecticut is really bad with our cops. We haven't had auditors here lik California an Florida so our cops are only just starting to be tested. Ur my hero!!
