Welfare state dystopia as a challenge for the right to social security
Social rights have developed in response to 19th century laissez faire capitalism. They have given rise to an interventionist welfare state that purports to liberate people from the whims of the market, making use of a plethora of social transfers. Legal doctrine on the right to social security reflects this rationale by focusing on the promotion of a benefit system which is ‘available, accessible and adequate’. However with such a system, the welfare state accumulates more and more powers which may turn against the very people who it intends to protect, sometimes with devastating effects for individual claimants. Recent scandals have occurred in a number of countries which show how the ideal of the welfare state may turn into a dystopia. Legal doctrine pertaining to the right to social security will have to face this challenge. It must be accompanied by stronger qualitative guarantees that protect individuals from the social bureaucracy. This lecture proposes three qualitative guarantees of individual treatment to augment the interpretation of the right to social security: compensation, elevation and participation.

De sociale zekerheid als dystopie: uitdagingen voor het grondrecht van de sociale zekerheid
Sociale grondrechten hebben zich ontwikkeld als een reactie op het 19e-eeuwse laissez-faire kapitalisme. Ze hebben geleid tot een interventionistische verzorgingsstaat die poogt mensen te beschermen tegen de grillen van de markt. De rechtsleer met betrekking tot het grondrecht van de sociale zekerheid weerspiegelt dit door zich te richten op het bevorderen van een uitkeringssysteem dat tegelijkertijd ‘beschikbaar, toegankelijk en adequaat’ moet zijn. Maar daarmee vergaart de verzorgingsstaat steeds meer macht. Deze kan zich keren tegen de mensen die zij eigenlijk beoogt te beschermen, soms met verwoestende gevolgen voor individuele rechthebbenden. Recente schandalen in verschillende landen laten zien hoe het ideaal van de verzorgingsstaat kan verworden tot een dystopie. Het grondrecht van de sociale zekerheid zal deze uitdaging onder ogen moeten zien. Het moet worden vergezeld van sterkere kwalitatieve waarborgen die individuen beschermen tegen de sociale bureaucratie. Deze lezing stelt drie kwalitatieve waarborgen voor om de interpretatie van het recht op sociale zekerheid te versterken: compensatie, verheffing en participatie.
