This was 100% an unsafe merge - there was no clearance. Its is incumbent on the merger to find a safe place to merge. The vehicle occupying the lane has no legal responsibility to open up a gap. It would be kind of him to do so but not required. The merger should get at least one ticket and be prosecuted for assault. This is a very simple case with no ambiguity.
I'll add that a blinker establishes intent, not right-of-way. So many accidents could be avoided if this simple fact was drilled into the heads of learning drivers.

Assuming it's like that in Texas, that's probably what his lawyer will try to argue to place blame on the cam driver. You realize its the responsibility of the merger to ensure things are safe right? Not the person already in the lane, the later can give way as courtesy but he doesn't need to

While merging, its the responsibility of the person who merges to ensure everything is safe, as you said, person already in the lane can do a courtesy, but he doesn't need to. You know what the word courtesy means and how its different from traffic rules right (rules which again holds the merger 100% responsible for merging)?
It scares me that so many here dont know who the responsibility lies with and that the person merging was at 100% at fault. Seeing them defend someone who broke rules of merging as well as assault someone is scary, its scary to think people like you drive on the roads everyday, with the same mentality like the assaulter
