A very blatant and obvious miscarriage of justice. It's always scary to be reminded that there are people like this in the world. And I don't think she treated him like a servant. I think she considered him her possession, bought and paid for, with no rights at all

I only started to hunt for your upload a short while ago and was so relieved to find the tale of Eduardo Torella from you. I had known this sad story for a while but your telling of it is just so much more poignant than anything I've heard before. I'm rapidly coming to the conclusion that I am thoroughly addicted to you and your voice (hope that doesn't make me sound like a stalker!). You speak to me every day (and sometimes several times a day when I need to climb down off my high horse). What an appalling woman - and the people who allowed themselves to be bought off allowed her to go her length. Of course she tried to buy respect with charitable donations - while being very cheap in other ways like compensating her victim! One of the standard ethical issues charities sometimes face is whether they should consider the good that they can do with the money more important than the donor's reputation. I always thought it was fine to accept donations for a good cause from anyone without acting as judge and jury on the donor, but in her case, I might have second thoughts. Thanks for another great story.
It is amazing how many wealthy and famous continue to do the same. Money & power knows no bounds even today. They do what they and are never held accountable. Their position (rank) and money get them out of every crime.

I must admit that initially, the case seemed so disarmingly straight forward, I could not see how you could make it cover the best part of an hour - yet your amazing intuition in the last third of the story where you analyze the events and suggest what might have happened - and what you think must have occured, and even said - is masterful in my opinion. As listeners, we could almost believe that you were actually there yourself, at the time, or at the very least have some sort of "sixth sense" Truly remarkable!

The only question was, was it accident or deliberate? Given all the circumstances I thought the balance of probabilities was very much in favour of the latter. I think it was probably a spur of the moment thing, and that DD was drunk and very angry..
Well, you can’t buy immortality, and you can’t buy a ticket to heaven. Money must seem quite useless when you are very close to death, and you have become accustomed to using it to get your own way. I certainly hope Eduardo and his mother have made it to God’s kingdom, anyway. 🙏
Doris Duke always fascinated me. A very interesting woman. My late mother met Doris Duke through her paintings, as mum was an art historian and insurer. Mum said there seemed to be an air of sadness around Doris and she spoke to mum about her child that died as a baby, and felt she never got over it.
Thank you Mark, you have a wonderful voice for story telling. Another good case choice by you. Poor Eduardo may have reaped good financial rewards whilst working for Doris, but sadly paid the ultimate price when trying to extricate himself from her control.

The fact that this episode is just as interesting and intriguing as always, even without the "added suspense" of other possible suspects, many preceding events etc., is proof of your masterful storytelling & insights into the people's psyche. A situation which would probably have proved difficult to prove as murder, but as negligent homicide relatively straightforward, perhaps. I think she was probably simply drunk and very angry.

I just shouted with deep agreement when Mark stated the importance of 👉🏿TRUST👈🏻❤️🔥. I am shock-and-awed over how much power and sway Duke’s money and her father’s built up tobacco influence held over the whole of the United States way back in Mad Men 1966. Using charity and paying ‘serfs’ to cover selfishness, greed and an inability to learn is one of the oldest and most disgusting tactics of many of the very wealthy. This case is one of the definite precedents of later evils to come after the Powell Memo (which took place while she still wielded power). So glad this gross murder has finally been brought to light, and that Mark has done yet another superb job in doing the bringing. ❤

After mentioning it to you I went back and watched it again - some of the references in it went over my head, they must have been a thing of their time, but the reference to "Norma Scott" was a plain reference to Norman Scott, the man whom the Liberal Party leader Jeremy Thorpe wanted killed. It is a superb parody of how a British judge can sway a jury if so inclined. I have noticed in the US judges do not seem to indulge themselves in 6 hour long addresses to the jury, which we have developed a nasty habit of in Britain - certainly in days gone by. Thanks also for your comment on the DD case and your concurrence in the matter. I think ultimately people were too afraid to take her on. Brilliant job, Mark. You are in top form as essayist and narrator. The best on UA-cam. I always focus on tawdry financial aspects. She would have been robustly insured. Crushing people with cars is down the middle of their fairway. That's what they do. Unlike some professional liability policies, the policyholder need not give consent to settle. Underwriters wouldn't have vindictively fought Eduardo's family. Clear liability. Combined ratio includes defense costs. Even eschatolgically evil State Farm would settle such a case. Did she decline insurance coverage? That would be more haughty and scandalous than the actual murder. Insightful and entertaining as always, excuse the one quibble..

I have not appreciated this, but it makes sense - and I do not know the answer. I had understood that she refused to settle on the advice of her attorney who told her it would render her liable to arrest for admitting guilt. I did not accept that explanation, but thought it due to Doris's determination to see the whole tribe of Tirella's off! The insurance angle might reinforce or deplete that assumption...
The fact is, she didn't need anything or anyone, she didn't even have to better herself with a skill or a job, resulting in a meaningless life. Pitiful.

Thank you, you're very kind! It was quite straightforward, as you say - simply a question of whether it was accidental or deliberate. A situation which would probably have proved difficult to prove as murder, but as negligent homicide relatively straightforward, perhaps. I think she was probably simply drunk and very angry.

I just shouted with deep agreement when Mark stated the importance of 👉🏿TRUST👈🏻❤️🔥. I am shock-and-awed over how much power and sway Duke’s money and her father’s built up tobacco influence held over the whole of the United States way back in Mad Men 1966. Using charity and paying ‘serfs’ to cover selfishness, greed and an inability to learn is one of the oldest and most disgusting tactics of many of the very wealthy. This case is one of the definite precedents of later evils to come after the Powell Memo (which took place while she still wielded power). So glad this gross murder has finally been brought to light, and that Mark has done yet another superb job in doing the bringing. ❤
Thank you very much - I am glad you liked it! The Powell Memo is a shocking and egregious example of a very senior judge being effectively bought by interests which obviously require independence of adjudication. Quite astonishing when we see such behaviour!

PS: excellent investigation into this one. I do believe you're very close to the truth. I believe I told you that I spent 30yrs as a Firefighter/ EMS Medical First Responder and 16 yrs as a Insurance Special Investigator in Fire and Fraud losses for Insurance companies here in America. So, I've worked with numerous Crash Reconstruction experts over the years. They were just coming into use back when this incident occurred, but usually only at state police/highway patrol levels.

After mentioning it to you I went back and watched it again - some of the references in it went over my head, they must have been a thing of their time, but the reference to "Norma Scott" was a plain reference to Norman Scott, the man whom the Liberal Party leader Jeremy Thorpe wanted killed. It is a superb parody of how a British judge can sway a jury if so inclined. I have noticed in the US judges do not seem to indulge themselves in 6 hour long addresses to the jury, which we have developed a nasty habit of in Britain - certainly in days gone by.
Thanks also for your comment on the DD case and your concurrence in the matter. I think ultimately people were too afraid to take her on.

I always focus on tawdry financial aspects. She would have been robustly insured. Crushing people with cars is down the middle of their fairway. That's what they do. Unlike some professional liability policies, the policyholder need not give consent to settle.
Underwriters wouldn't have vindictively fought Eduardo's family. Clear liability. Combined ratio includes defense costs. Even eschatolgically evil State Farm would settle such a case. Did she decline insurance coverage? That would be more haughty and scandalous than the actual murder.

I have not appreciated this, but it makes sense - and I do not know the answer. I had understood that she refused to settle on the advice of her attorney who told her it would render her liable to arrest for admitting guilt. I did not accept that explanation, but thought it due to Doris's determination to see the whole tribe of Tirella's off! The insurance angle might reinforce or deplete that assumption...
Funny how at the end of her life her musculoskeletal injuries mimicked those of her victim.
The fact is, she didn't need anything or anyone, she didn't even have to better herself with a skill or a job, resulting in a meaningless life. Pitiful.
