As a casual viewer of the podcast and just H3h3 in general, it’s pretty disappointing to see Ethan decline so far like this. The worst part to me is how he isn’t willing to change or better himself at all, he sees all forms of critique as a personal attack on every aspect of his life ever. It’s one thing to struggle with critique as a newer content creator, but as somebody who’s as old as he is, has been doing this for as long as he has, who built a career off dishing off harsh critique, you have no choice but to follow those same rules and yet he just doesn’t. I can’t even call myself a fan anymore. The guy has his entertaining moments, he can put on a good show when he *tries*, but he’s really hard to like as a person. I feel like cameras off he would be just absolutely unbearable.

Unfortunately for him, illegally pirating that fight is committing a pretty serious crime in the eyes of the law. So it is a big deal actually.

A cease and desist is more appropriate in this case, as it would fall under DMCA.
Pay-per-view is a live service by definition, therefore it's not apt to claim loss of income based on a rebroadcast. However, if they were to persue, they would need to prove that ethan DIRECTLY caused the loss of income for the figure they're quoting, and this is after the fact, so it will be hard to prove that the income lost was rightfully theirs and not a matter of Ethans fanbase watching whatever he uploads. If, perhaps, his jake paul fight episode was viewed a substantial amount more than average regular uploads, it might be appropriate, but they would have to argue that fans of jake went through ethan instead to watch the same broadcast. As far as the link, it could very easily be argued that carelessness played a role as opposed to purposeful intent. an argument which would also be hard to prove.
Whilst I'm unclear who owns rebroadcasting rights, the owner of the the rights would have a hard time cementing those arguments.
Intention is paramount here and Fair Use could definitely be grounds for the dismissal of the case, based entirely on the fact that he made an episode to critique the content as opposed to offerring a "free alternative", which would be the only argument that holds any substance, and given the fact that he speaks about it for a long time compared to the episode, even titling the video after it, along with his long history of critique style content, implies he intended the video to include a critique, and doesnt spend the whole time on the topic, it categorically would fall under fair use. this is the same reason movie critics are immune from similar litigation.
Again, most of these issues are DMCA appropriate given the fact that he didnt upload the video while the fight was in progress. and therefore a cease and desist really is the first course of action triller, or the rebroadcasting copyright holder, shouldve taken.
furthermore, if it were a copyright issue, youtube has a system to deal with this and triller decided not to use it through theirs or a content management agency's account, or if they did and youtube refused to action it, then the blame falls on youtube.
