      I've also got a civil suit against a store I took my registered service dog with a doctors note the owner denied me service and then filed a trespass order. The lieutenant tried to tell me that store owned the sidewalk I got video of that too. I showed the cop my medical papers for my service dog and they didn't up hold my rights and still served it. The cop also told me if I'm on the sidewalk in front of the store I'll got to jail but I got the map from town surveyor

    Court system to us: ignorance of the law is no excuse, go directly to jail.
    Courts to law enforcement officers: it’s ok you murdered, harassed, beat, abused, tortured, and ruined the lives of innocent civilians. You didn’t know what you were doing was wrong. You acted on good faith. We won’t charge you with a crime and we won’t let anyone hold you accountable in any way whatsoever.

      One of the most ridiculously sad things about that is - these state agents that say ‘’lawful order’’, I have now fully realized those are just words they say with their face! I quite literally don’t think they even understand what that actually means and I know damn well, after watching hours and hours of auditors ask officers , (?) Hey 🐽 What is the 1st Amendment?Hey 🐷 what is with the 4th Amendment? I’ve yet to see any of them ever once answer Correctly or even close to the answer, & that’s if they answer at all ! That alone is terrifying! It’s always contempt of a cop or who has the biggest ego race including, the very obvious- I have a little dick syndrome, The usual- I loved to bully in high school so therefore I went and got a job where I can bully any and everyone including grandmas , veterans, well ANYTHING…including animals. There are NO limits to their consistent incompetence. I truly believe a great majority of these enforcers are not only plain stupid some of them obviously have some strange psychopathy, some of them seem to be sociopaths.

      Its not that the cops are stupid, they handled the situation relativly smartly actually, they most likely even knew what they where doing is bullshit themselves.
      Lets be real what happened there:
      - Guy filmes the location of a big billion dollar corpo
      - corpos call the cops one the guy filming in the hopes of them making him leave.
      - the Cop, Lee, initially seemingly agreed that no trespassing had been done
      - corpos got mad that they didnt had they way and most likely pulled some strings - which would explain why a seagent randomly shows up to handle the situation
      Now since corporation are running currently the US in all but name and have direct political and monetary influence within politics the local police departments higher ups most likely pissed their pants as this can and will have negative effects on their careers as the corpos will run crying to the local city officials who inturn will blow steam up the departsments ass.
      Hell the seargant did effectivly confirm this by telling the guy outright that he does not want to arrest him for tresspassing. And since it was the persecutors themselves who only followed up with any charges, it suggests that strings have been pulled in the background without the cops involvement.
      Remember, police doesnt charge people with anything, the persecutors do. It doesnt matter what cops say or dont they dont have any authority in that.
      So the cops had 2 choices.
      1. Leave the guy be and find themselves without a job next week
      2. fuck with the guy to make the corpos happy, but its clear that they themselves actually didnt want to do anything about

      They can't. While LEO have Qualified Immunity, Prosecutors (and Judges) have "Absolute Immunity". Meaning they are untouchable no matter what they do. The system needs to be canned and we need to start over.

      I concur, although there is something to be said for living to fight another day. An auditor could, theoretically, get locked up every time they encounter police. How much auditing could you accomplish if you have to spend all of your time and money dealing with the corrupt criminal justice system and, despite being innocent, being convicted by crooked judges working with predatory DAs and incompetent public defenders

    the incompetence of this cops never ceases to amaze me... they had no clue of where an easement is and where private property is.....and of course the cop goes into his pockets and searches him...cop -"why are you making this difficult.....i gave you a lawful order to give me your name.....i have a lawful reason to ID you....... turn around you are under arrest......" = i'll falsely arrest you as i know nothing will happen to me....sad how this cop believes that anything he spews is a lawful order.....glad he sued this clown cop... maybe he will learn about easements but doubtful......shocking the prosecutor still decides to prosecute him for trespassing...... and this clown cop is a sgt.....

      Which is sad and pathetic because the whole basis of law is that you are innocent until proven guilty and the one of the many tasks of police officers is to acquire evidence as proof of guilt. This is an open-and-shut case of an LEO that’s acting as a feelings enforcement officer instead of a law enforcement officer.
      This officer did absolutely nothing to prove guilt. The farm that called police did not formally issue a warning of trespass to Delaware Defender nor did that farm management/ownership inform the officer to trespass him. The moment that officer stated in court that the farm didn’t ask him to trespass Delaware Defender, he lost the case that was probably ultimately going to be lost by the prosecution in the first place considering the mountain of evidence that proved Delaware Defender’s innocence. The officer also did not clearly state the public easement law nor secure evidence that Delaware Defender crossed the properly line between that farm and the public easement. When that officer stated he was on private property, I would’ve asked, “you tell me where the line to their property is. If you’re saying it’s up to the road, then you are lying because that would be a violation of public easement laws.”
      This seems like a slam dunk lawsuit for Delaware Defender. The officer clearly violated multiple Constitutional statutes, including Delaware Defender’s First and Fourth Amendment rights. The fact that Delaware Defender had a stronger grasp of Maryland/US Law than the actual law enforcement officer has to be alarming. Also take into consideration that Delaware Defender has physical evidence to prove his innocence is going to make this an easy lawsuit.

    Even tho it will take a long time, unless DD accepts a settlement to resolve this, I hope future updates will follow. DD is a bright spot in the auditing scene, as he is level headed, not overly abusive to cops and government employees, plus he follows through with a lawsuit. This should be important to the viewers. Hope DD gets a nice payoff.

    I’ve always said. You will not be promoted in the police service unless you violate peoples rights. The more stripes you have. The more people you’ve violated. In most cases asking for a supervisor is only getting a more qualified rights violator to the scene. Anyone that doesn’t know about public easement shouldn’t be a public servant.

    The officer testified in court that he just decided to trespass Delaware Defender and then was promoted. Sounds like there is an “understanding” between this officer and that company. It would be interesting to see who his friends are and how he might be connected to the management at that company.

      And they need to REALLY follow through and stop settling! When you settle a lawsuit, you will get some money. But that's all. Nothing else good happens. The world doesn't change at all. The police or whoever it was you sued doesn't have to admit any wrongdoing, they can say we only settled because it was cheaper than fighting it in court. Most importantly, no case law get made. You remember qualified immunity? The cops get out of jail free if there if no existing case law with the same fact pattern. The only way we can make new case law is to take the lawsuit all the way to a jury verdict. If you lose, appeal. Then if you win your appeal the courts decision is binding on all other courts in the same district. If another cop does the same thing...no qualified immunity. If you settle then this doesn't happen but whatever the cops did to get sued does happen again, and again and again ....forever.

    It's so infuriating that a LEO would tell a citizen they're being difficult because they refuse to ID , when they clearly haven't broken the law! It's been far too long that citizens just blindly do what police tell them to, without asking is it's a legal command and that they don't challenge them when they demand something that violates our rights. We've given our power away, so now, when people like Delaware Defender, challenge law enforcement as to whether what they are doing is legal, police and prosecutors try to make them out as "police antaginizers", instead of "police and citizen educators". Delaware Defender was not disrespectful in any way. He just pointed out that he should check the map before making a big mistake. The officer didn't care, because he doesn't pay for lawsuits,the citizens do. How could he be promoted to Sargent when he doesn't know trespassing laws? He never investigated anything! His goal was to get his ID, which he probably have to the company Delaware Defender was photographing. He should check into that and file charges if that happened!

    22Cv815 US district court, District of Maryland. It’s an active case. Included the wives in case they tried to transfer assets. Sued them as individuals as they never had probable cause and were thereby never in capacity. It’ll be interesting to see if the city settles this or forces it on their individual liability.
