    The constitution, as promoted by Burke, is now past its sell by date. The British constitution, as indeed any constitution, shouldn't be set in stone. That is certainly the case as regards Britain. It rightly pays lip service only to the separation of powers. Lord Falconer declares separation as sacred. This is contrary to the evolutionary nature of the British nation and constitution. The constitution that Lord Falconer favours like Europe's has to be written. Despite their endless iterations, they are worse placed than the UK with endless revolutions and turmoil. Lord Falconer with the Labour Party has provided the conditions for revolution in the UK as the only means of blunting arbitrary and abuse of power by them. I agree that a new political and constitutional settlement is urgently required. But not for the reasons advanced by Lord Falconer.

    Very thought provoking talk, thank you. To safeguard our constitution, it is imperative that an elected government must curtail and reduce the powers of all non-governmental organizations (NGO), to undermine fundamental human rights in the pursuit of power and profits. Be very very wary of 'Public Private Partnership' talk, as it really translates as all profits to the Private owners and the burden of debt/losses to be put upon the Public.

    The legislature has “deemed” certain facts or circumstances to exist contrary to actual reality for centuries and the Courts have respected this. No one has claimed any breach of constitutional principle.

    We're trying to get the existing Law transparent. The Statute base is done, just needs a better spellcheck, and the Case Precedent base is being worked on. Next, a translator between common English and legalese, so people can find what the Law actually says on it, in language they speak (ie assault meaning battery). The problem with codified Law is that gaps appear as the world changes, so a Constitution in the absolutist sense becomes outdated. In this respect, the UK's method of markers across the desert of life may be preferable.
    Another issue is that Generally Accepted Practices in International juridicature aren't properly documented outside Accounting and the Sciences.
    Equally, is Erskine May still pertinent?

    I feel like the title should be "does the UK need a constitution?". I get that common law stans argue the UK has one, but this 19th century narrative is becoming ridiculous in this politically developing country

      The reason it does not is your very point, that the world changes and legislation struggles to keep up, and is an abject failure at getting ahead - Data Protection being a dire case in point. The UK has the ECHR rewrite of the UDHR establishing some bases, but others implicit in the Judiciary and Security Services should be spelled out - I was introduced to the latter world aged 11, nearly 60 years ago! It's come as a sad wake-up call to the offenders in the current racism row to discover we don't have American levels of freedom of expression (ie the second Paras of ECHR Arts 10 & 11), but at long last folk are using legislation gov uk to look before they leap, causing the Police Service real issues.

    The Constitution is the peoples protection nothing.
    Parliament is not Sovereign law maker its Sovereign legislator and they accountable to the law and should only make statute that compliments our law.

    The United Kingdom is a corporate legal entity that needs to be dissolved its never been united. We need to get back to English Constitutional Law there is no British Constitution, we share our Constitution with the Welsh and Scotland has their own Constitution which is why they have a different legal system.
    I have asked people who have spent their whole working life in Law if they can tell me how many Constitutional documents there are that make up the uncodified English Constitution and can they name more than three. The silence is defeating they do not know because the Constitution was suppressed, subverted and then subjugated. We are governed by the Bank of England contrary to English Constitutional Law. Those in power are committing High Treason.

    Judges and lawyers have sadly not avoided politics. People are jailed and judged for poorly written laws in spite of the actions performed being squarely under human rights like the freedom of expression.
    These human rights violations undermine both the left and the right, but seems to be more aligned with left leaning parties and ideologies.
    Further, the use of terms like 'the far right' for everyone is undermining our ability to have an open and productive discourse. Seeing the same language being used by journalists and judges, as examples, paint a dire picture indeed.
    A constitution exist for three reasons:
    1. Protect unalienable and fundamental rights of the citizenry.
    2. Provide mechanisms for controlling and holding governmental bodies accountable.
    3. Set safeguards against abuse of power by governmental bodies.

    The addition of overseas students in the top Schools, combined with the reduction in numbers of children, has devastated the delivery of high-intellect members of the Civil Service.

      @@JelMain Would you prefer that the best educated people lived their adult lives in the country where their family roots are or be transplanted to England?
      Often they are studying here because they have well-off families who hope their children will advance their country.
      This does not always work. The child might not wish to be treated as normal rather than respected above others.
      Or the child might go back unable to fit into their own society.
      Quite apart from some being trained in their own country and recruited to work in England. Their country loses their value.
