      Yeah it's ChannelFlip (the network) who had every British UA-camr (apart from Zoella and her mates) under their wing. They're still a thing I think but they're called FlipSide Talent now

    I really enjoyed this as I had no idea about all that! I really like being transparent about the sponsorships, but I just wish we didn't have to call an entire video an "ad" when it is like, 12 minutes long and say...1 to 2 minutes might contain an advertisement. I hope they come up with a guideline that makes more sense, maybe having "ad" show up on screen during the sponsored section or something? (I'm not even in the UK I'm in Ireland BUT I still do it as Ireland are slowly coming around to it and I never ever want to deceive anyone)

    I still click on the video even if it is an ad and sponsored as I want to watch that youtuber video and if there getting more money from me watching it and then be able to produce better videos then I'm okay with that

    To me, "This video is sponsored" sounds less like the company is controlling the content than "This is an advertisement." Maybe it's just a US vs. UK thing?

    I feel like it isn't really fair to you guys to suggest that you should've know better etc etc etc, like if it isn;t a rule then it probably wouldn't even cross your mind, and why should it? If they made a rule where retail stores couldn't put logos on 5 pence carrier bags anymore, it's not their fault that they used to do it because why wouldn't they??? I feel like you guys were wrongfully blamed and I support you (and the new rule) 10000%

      David Cox agreed! there's some I just can't watch (here's looking at you Well-Known-Audio-Book-Brand) but as a whole they're fine! Some are brilliant because it gives the UA-camrs a chance to do something they wouldn't usually do!

    The fact that you'll just get shamed and not fined or anything for not stating that a sponsored video is an ad is probably the most British thing I have ever heard.

    I never heard of it but actually I don't really care if it's an ad or not when choosing what to watch. But there are definitely three types of sponsored videos.
    1) It's just about the product and the UA-camr can barely act the way they normally would.
    2) It's an average video but they say it's sponsored and put the product in once.
    3) it's an average video and the sponsored product is in it but you don't realize because it is something they genuinely like and would normally use too.

    Thank you for sharing this story with us, I've always wondered how the entire thing unfolded! I'm glad it happened because disclosure is important and like you said, we should know what's sponsored and what isn't. You've always been really good and showing clearly that something is sponsored, some people seem to still be struggling to grasp the concept of disclosure.

    I don't care if a video says it's an ad. I'm still gonna watch the video. As long as the UA-camr is being honest about the brand it's still good. A lot of people forget UA-cam is some people's jobs. They need to make money so yeah they're gonna take sponsors, football teams do it and you don't see anyone getting mad about that

    THANK GOD FOR THIS! I find it insane that UA-camrs were not required to do it in the first place. A UA-camr should be honest with there audience and should disclose any sponsorships they have. Its just decency.

    Thank you for clearing this up!
    What a lot of people don't understand about being "media shamed" as a "social media person" is that, not only is it incredibly emotional to go through, but the backlash is terrible to go through as well...subscribers question you, you may lose "good" subscribers and gain trolls, even if you didn't know what you were doing was wrong and it was an honest mistake!
    Again, thanks for taking the time and having the balls to stand up and say you were involved, that's generally how everyone should handle stuff.

    so glad you were able to clarify exactly what happened because all i remember from the incident were ppl removing the oreo vids and slowly adding in #ad #spon on all the videos and thumbnails. i didnt even know it was all over the news and it became some kind of scandal thing

    I really enjoyed this. as a comedian, UA-camr and someone who works in social media for a day job I've always believed in transparency and honest communication being key. it's sad the number of brands who I've sat in meetings with who have said things like this or similar. just because there's a stigma in some people about ads doesn't mean it shouldn't be displayed. the people who think of sponsored videos as a dirty word were never going to buy your product or be receptive to any messages... personally I think the future is the audience's backing the creator and voluntarily backing content creators they love and brands not getting involved with this space in that way at all. thanks for sharing. x

    It's funny now when lots of youtubers do ads for the same thing *cough* best fiends *cough*. Every time you watch a video that's sponsored by the same thing, it always seems more and more un-genuine every time.
    Sooo.. Safe to say I haven't downloaded Best Fiends. Maybe the sneaky technique would've favoured them a bit more. xD

    It is kind of funny when you go into your sub box and see your latest five subscriptions all plugging Best Fiends. As a consumer I know what to expect more so whenever I see #Ad on a thumbnail than I did before the whole thing was introduced. I remember seeing it on the news and I'm genuinely happy with the change. Yay for transparency. :)

    I actually really appreciate that youtubers have to be more transparent about whether or not they've been sponsored, there have been a lot of videos I've decided not to watch because I saw that they were an ad (no disrespect, I fully understand that sponsored videos are how y'all make a living, but sometimes I know that I'll like a video less knowing that it was sponsored). It is a shame that those Oreo videos had to be removed though, the Dan and Phil one especially was a blessing.

    In terms of the legality, yes the ASA is a regulatory body which issues guidelines and yes there is no direct legal statute that can result in fines. However breeching such guidelines could open you to common law lawsuits, whereby an individual or body (such as trading standards) may take legal action against you based on breeching the guidelines, as a breech of the guidelines could be seen as negligence or a deliberate act to deceive and as such you would be in breech of various trading legal statutes. The ASA commonly refers cases to Trading Standards - whereby legal enforcement action can and has been taken against individuals and companies.

    This is such a great and informative video! Thank you for uploading and being so transparent about this. I'm doing my 3rd year dissertation on UA-cam and it's advertising ethics etc at the moment and the Oreo case with the ASA is a larger focal point for me, so this is super great to have seen.

    I totally understand and agree with the fact that there should be clarity as to if a video is sponsored. However, the shaming in the media was ridiculous and it should have been handled much better.

    I've never had a problem watching advertisement/sponsored videos from youtubers I really like, although I do appreciate youtubers being transparent about it. Like you said Emma, it is something you should just want to do, just for the sake of being honest about it. (: I can totally understand why some people wouldn't want to watch them though, they're not for everybody and sometimes they can be a little boring/not the content one would be more inclined to. =^-^=

    As long as it's not a super scripted TV-ish ad, I can't see the problem with sponsored videos. It's content, and if the youtuber is allowed to make it "their own", it's still entertaining content. For more impressionable people it's good to disclose though :)

    I'm glad there is more transparency in disclosing sponsored content. I have no issue with sponsored content as long as it still interesting content then I will watch it. When it comes to paid reviews etc it is good to keep in mind if the person reviewing the product has been paid to do so to factor that into making your own mind up about a product or brand.

    I mean I hated that people weren't clear about sponsors at the time, so I was and am glad this happened and the reporter did that, tbh. It felt misleading. But anyway nice and informative video, interesting to hear about this again as I remember it so vividly.

    I can appreciate that having to follow the guidelines is a pain but as you say I do think it is so much better to be transparent. For me, I don't think it was the typical 'advert' style videos that were a problem eg 'OOH LOOK BISCUITS', as we see them everyday on TV, but the videos where UA-camrs had 'opinions' on products (particularly beauty products) that were predetermined because it was an advert were sneaky. I remember watching a UA-camr (few years ago now) rave about a range of products which I went out to buy and they were actually shite. Didn't realise at the time that it was a sponsored video #doy

    i agree that youtubers should abide by advertising laws...but i dont understand why people are bothered by sponsored videos. sponsors are how youtubers earn their living most of the time. if its your job of course you will do what makes you money!

    I think part of the problem was that some of the brand parent companies are not in the UK and were either ignorant of the ASA or didn't think they applied for your type of digital media

    to be honest, i'd actually rather hear "sponsored" than "advertisement" because i LIKE hearing that my favorite youtubers are able to make money and survive and all

    what a way to make nothing out of something
    the news does anything to make people look bad, they blow up everything! it wasn't even the youtubers faults.. sponsored videos shouldn't be shameful! you need income! yeah, they can be annoying, but you make them fun! you're honest, i love u!!

    It just pissed me off tbh because all the news stories were like 'these young people are unaware when a video is sponsored' WE ARENT DUMB os obvious when a video is sponsored, we dont need a little sticker on each video to let us know 😂

    Further rezzzpeck for this, these were the days eh :P Sorry to hear that you got so caught up in it. Hard when there's a 'face' to put out there, reporters will jump for that :L Really cool that this meant clarity and honesty very much quicker than had it dragged on so not saying it was a good thing it happened to you but that it is good now that what came out of something awful has been extremely beneficial for everyone :S Hope that isn't taken as a backhanded compliment... :S

    AD video's are frequently just as good as non-ads videos -- really depends on the youtuber. I really like how Anna Akana handles her sponsorships at the end of every video.

    I'm just happy to see content and I don't care if i know if they get paid or not
