- The Legal Stuff - Part 2: WHAT IS A DBA?
D.B.A. is an acronym that stands for "Doing Business As". It is the same thing as a Fictitious Business Name.
Establishing a D.B.A. is NOT formalizing your business, or creating a legal business entity; it simply allows you to operate your business under whatever name you want to do business as. Sole proprietors can establish D.B.A.'s in order to build a brand separate from themselves, for example. L.L.C.'s can establish separate D.B.A.'s as well.
Before formalizing your business, you may want to consider doing the first steps:
1) Get a D.B.A.
2) Get a Tax ID Number
3) Setup a separate bank account
This way you can accurately monitor your business numbers, separate your personal and business expenses and build your brand.

So you can have many DBA's under the parent company which is the main entity but all your risk is in one basket as you grow you'll want to have a LLC for each dba so when one get sued not all get sued meaning your assets wont be at risk if one llc gets attack. If one dba gets attack the main entity is at risk with whatever assets is under it. So to minimize your risk of asset have a llc soon or later for each dba

If i make money through solar sales, security alarm sales, and my own atm company, how should i go about it? One business can be my main LLC name (ATM company) and the other 2 sales job incomes have under a DBA, so combine the sales jobs and seperate the atm business?
I''ll think having a diffrent dba is fine for each business and just having different bank accounts for each dba but file all the income through the parent company which is the llc or better said the main entity

Uriel Reyes Great question. I don’t see any hurt in holding onto a dba , but would definitely consult with your accountant or attorney.
Key point made is there isn't anything separating your legal liabilities. If the DBA fails and goes into bankruptcy, or your DBA is sued, your personal finances will also be a target.

I registered my LLC, got a tax i.d. number etc, my fictious name I've only registered. Did it NEED to be registered? Is registering the fictitous name the same as being a DBA? Or do I do 1 without having to do the other?

What if I made my LLC for accounting/finance services, and I want to do tutoring (for kids math, science, etc and mentoring on how to invest. Could I do my LLC for my accounting/finance services and a dba for the mentoring/tutoring services? Which all tie back to my original LLC?

That's a great question, and would be more fitted for someone like Gary Winter from Lawvex. My initial thought would be that it depends - is it something that can be a subsidiary or a division of the existing company? or is it something completely different? If completely different, you may need to file/formalize another entity. Again, I would direct that question to someone who can sit with you and ask the right questions in order to provide a better response.

Dear Butler, this is just a little information for you. The page DBA is danish and founded by Jac Nellermann. Its actually called: Den Blå Avis - Which can be translated to: The blue paper (As in newspaper)

If I file a LLC as “We Make Art LLC” without it being trademarked first, will I get sued if I “Do business as” a already Trademarked LLC that has the name “We Make Art LLC” or “We Make Art” ?

Company Name can be a DBA, but not necessarily. There could be a company (for example, Google) who has separate entities (I.e. UA-cam) that "does business as" something different than their company name.
