IS farrrr more strict than Japan. The only thing Japan IS more strict on the u.s. by a LONGSHOT is quality standards of vehicle manufacturing

    I visited a doctor and read their spiel. I then asked for a copy of their privacy statement. They looked at me stupidly. "Your agreement you had me sign says you wil give me a copy of your privacy statement. And I have to SIGN this paper saying you gave me a copy. Where is it?" They looked for a copy of it to give me. Apparently, no one had ever asked for a copy of it! FINALLY, after 30 minutes or so, they found one and handed it to me. I said "Oh thanks. Thanks for the privacy statement that tells me that I really don't have ANY privacy." I make that statement over and over to their faces and it goes right over their heads. It's terrible.

      I totally relate to what you're saying and am one of those people like you who pays attention to detail to what I am signing and ask questions. They roll their eyes at us for requesting the printed statement and label us as "difficult" patients.

      @@johnnygeneric161 does it comply with the Privacy Act ? That's how legalese works by mixing up to ambiguity between all these books, to get the $$$$, funding. There is soooo much to it. Actually, I worked at a Doctor's answering service. Their licenses were constantly pulled for not giving the meds, they were ordered to give !!! Many would yell, " I'm just not giving that to my patients for this". One had the kahoonas to say "Pull it, then, and I will see them in court !!!!!! Few know what's going on with these guys !!! They learn the body, and they do see what's going on in the money machine. of this veeeery tough and stressful job they spend an awful lot of Money to get. To this day I remember that job. I'm so glad I heard it for myself and my friend had arthritis breathing in pain, but her husband said no painkillers. Now she was seriously suffering so, I 🤔 think, he could have relieved her....I tried looking other relief meds up with her. The natural remedies became of great value to me, then.

    I worked at a startup where we had to be *so worried* about HIPAA compliance it was astounding. I mean, I couldn't walk away from my computer for 3 minutes without locking the screen because of HIPAA worries. And the amount of coding work we had to do ... incredible. Now I discover it was all just bullshit.

      I worked at a workers compensation insurance company and had to go through training every year on HIPAA. From 2000-2018. What they are doing now violates that oath because they weren’t trained to by the illegal Democrat government.

    One of the interesting things about medicine in Mexico, they don't collect bulk medical data so there is no privacy concern in the first place. In the USA the medical industry collects a creepy amount of information on you just to look at your elbow.

    I used to work in IT and specialized in electronic medical record systems. Just about every medical condition has a "registry" that your providers share your data with who then in turn share it with other entities.

      Which entities? I found a horrible medical record (based on hearsay) in my apartment file when strangely I was being evicted. Also treated scurrilously at a local college, when I had degrees from far more prestigious ones.

    Oh my this so rings true. A person had a health emergency crisis, and she was bombarded with tests, X-rays, denied food and water for 14 hours at a time because "they" planned procedures one after the other for diagnostic and prep services and it was a daily battle for her to get information, and she was as alert as she could be, even though she was desperately ill. She had to ask what medication they were trying to give her, she had to ask where they were taking her and she had to fight to refuse certain drugs and procedures that were against her wishes. She was faced with a battery of sub-specialists "consulting" on her case and ordering tests and meds for completely unrelated issues. It was a nightmare. More than a week into her hospital stay she was presented with a barrage of papers to sign when she was medicated and late in the day. Every question was met with massive push back and intimidation tactics. She is sure her rights and privacy have been thoroughly violated and trampled on. Not to mention being treated like a piece of meat, harassed and bullied, and shown no regard for basic human dignity.

      iv had many hospital stays and many health emergancies only because i was born with a disorder and syndrom and when i got treaments after cancer surgery with chemo it was way too much and it massed me up aggesivly attacking the gene disorder caused by the symdrome i was born with . They really push those meds amd hippa crap on you , if you ask questions and or refuse signing things they up the fear and scare factors its jusy wrong then they lable you as a difficult patient uncoroppertive , the whole time your in the hospital or go back your treated badly

      Was this during COVID, by chance? Because the lockdowns really inspired the hospitals to do whatever they damn well pleased.
      And there was little oversight because family members/guardians were forbidden from visiting the isolated patients.
      My friend wasn’t allowed to be with her husband until AFTER she agreed to turn off the ventilator. It was evil…

    This explains why I received marketing attempts after receiving emergency surgery. I was sure the only way my details were suddenly available had to be relatedto data entered as a result of my hospital stay. This confirms it. I tried so hard to stay off those marketing lists too.       Same. With Kaiser and Sharp.... people are asking which hospitals do this. It's almost any large hospital. Lol More women started to die during childbirth too when the hospitals opened for delivery in the early 20th century. Yes some were saved due to the hospital but I'd argue it's even if not more drastically in the negative direction.

In the last year and a half, my data has been breached 12 times 8, including my social security number. It is absolutely ludicrous, and there is not a thing our government is doing or will do about it!!

      Because you will be. Many practices will also refuse to take you as a patient if you refuse to provide you SS#. It is illegal to use our SS# for identification. These practices insist that they need it to bill, they do NOT.

They expect their provider to bill insurance, but the providers cannot find the patient in the insurance companies system to bill. If you want to keep your SSN private, please bring your correct and current insurance card.

      The HIPAA privacy policy document you sign is simply an acknowledgement of the fact that they have offered you a copy if you want it. You aren't giving up any rights. If they don't have that on file for you, then they can be fined massive amounts by the Office of Civil Rights.

    I know one organization that was so afraid of HIPAA, they made me sign a release authorizing them to release a copy of MY OWN RECORDS TO ME!
    The US medical system is thoroughly broken.

      I'm not US citizen but i know that US health system was broken since inception if i am not mistaken. You'd think Medicaid that was supposed to help those who can't afford health insurance would change something but as it turns out yet again Medicaid often discriminates people. Obamacare was good thing but didn't do much. In my coutry medical system is broken too but at least country covers basic health insurance for all citizens that are retired or unemployed, for employed citizens employer covers health insurance.

    I recently went to a new doc. I was surprised the desk gave me nothing to sign. During the doc visit she had tons of info she should not have had; namely medrecs she didn’t need and she ignorantly was confusing that data with other data.. She explained “We got laws. We can do what we want’. That didn’t fly with me and I contact 1 hospital and two medical schools about giving my data out without ANY written consent. The 3 facilities were very scared when I said that. I also wrote the Senate Committee on Healthcare etc etc. That included 2 senators from Nebraska, two senators from Connecticut, two senators from my state and Bernie Sanders! NOT ONE senator replied and the 3 facilities I contact all went into damage control mode. Note the med center I visited wrote me later requesting my signature which I would not give them. Yes our system is complete bull sh^t. I also know, some years ago, my records were hacked at Univ of Connecticut Medical School. Then sent a letter about the issue. When I called them to clarity they could not account for what data was hacked AND they couldn’t even confirm the data was actually ever hacked. On another occasion, at the hospital I worked for, a person dressed in a lab coat walked in the building, past our dept receptionist, down and around some halls to steal a computer with dozens of peoples personal data (a treatment controller PC). Our hospital did nothing but write people and that was the end of that.

      Provider to provider can share without patient written consent. So if you make an appointment with a new Dr they legally can get your previous medical records from your previous provider.

    Medical professional, I work exclusively with medical records. The advent of electronic medical records created a centralized store of data, making it easier for criminals to access and steal so much data with a single breach.

      I have only been required to pay for records once. I make sure that I’m given an immediate copy of my test results during an office visit. I have a lot of records, but the tests a mostly the relevant parts.

    We must revert to paper records, as being in IT, this is what I recommend to anyone who asks about privacy and security. No system is secure, it's impossible, we always have a way in, or anyone locked out would be permanently locked out.

      And that is why I do. I avoid blood tests. Taking medications. My last visit with the doctor was 5 min. She just talked to me. Try get blood work etc. I did the stupid poop test and mammogram and I keep telling my body stay healthy don’t break down and be make me by patient or better I try find natural ways. Now if get stabbed need Titnus shot or need antibodies for something if I need pain killers I try use less I suppose and trash the rest. 😊

      It has nothing to do with giving out information. You are saying it would be impossible to keep any medical info a 'secret' unless you are a doctor yourself with all your own medical equipment that you somehow are able to run while simultaneously being the patient.

    I worked in healthcare for forty years and HIPPA was not started to protect the average patient. As I recall it all got started in New York when one politician got the medical records of his rival and used that in an election. 🤔

      That is not what happens. The only time records can be released without consent is for provider to provider and for payment so insurance. Everything else requires patient signature

Then explain why I can't get my medical records to find out what my diagnosis is and why doctors refuse to tell me. The best I got was a copy of my records with 90 percent of it blacked out.     I also have concerns about medical offices requiring social security number on the form, along with your name, address, phone number, birthdate. More than once I've seen the prior patient's completed form laying on the clerk's desk, face up, with zero regard for protecting patients from identity theft.

    I used to be a file clerk for a doctors office. The idea that anyone had medical privacy is so hilarious to me. They need to know everything about you so you don't commit fraud. Medical fraud is a big deal. Did you know that if you drink weekly, you're an alcoholic? Yeah... they also write down assumed lies. Like when people's fists "fall" into things "accidentally"

    I got to eavesdrop on a HIPPA training teleconference in an urgent care. The questions from staff on day to day operations was eye opening. They have a great written policy but it all falls apart in reality. The staff seemed frustrated.

    I live in MN. I checked the box that said I did not consent. The receptionist was shocked and didn’t know how to handle it. She said, “I don’t think I’ve have had someone say no.” That tells me that their system is not at all set up to handle those decisions. I’m sure my data is not being excluded from disclosures.

    A lawyer once told me that it was legal for me to go to a doctor, give a false name, and pay in cash. A lot of people see psychotherapists that way when they didn't want their employer to find out. In the early days of AIDS, people would get AIDS tests under a pseudonym, like "Donald Duck" or "Ronald Reagan." I imagined the doctor saying, "Mr. Duck, let's go into my office and we'll discuss your test results."

    EXCEPT when your husband has dementia & hurting himself & you beg doctors to help… then they throw HIPPA in your face & tell you that as his wife of 20 yrs you have NO right to do anything about his dangerous & violent behavior… behavior that caused him to lose his leg & repeated attempts on my life. Doctors, adult protective services, police & family court judges all used my husband’s HIPPA rights as an excuse to violate my rights & risk my safety. I was forced into a hostile divorce & my entire senior life was destroyed & I lost my healthcare. I lost my home. My retirement. And I’m was taken from upper middle class to poverty. Lawyers are criminals. There’s no justice. Screw HIPPA… it’s a tool to commit crimes.

    We live in a de facto technocracy. In a system like that, collectivism (loss of private rights for the alleged good of the community) applies to the masses but not to the ruling elites. Our system is also part oligarchical. I miss the good old days when I could come and go and not be surveilled all the time, even in my own home. Maybe Ted Kaczynski was right.

You may want to video an interview with the H.R. and bluntly ask as if your niece or nephew cousin whoever applied would be "obligated" to surrender their vaccination status or does it remain private via law..
      Inquiring with the State would also be advised. A copy of such HR requirements needs to be highlighted and sent to the Department of Labor as well Health to remove immunity and draw an inquiry.

    I worked at a place where we had to make our medical records available to the insurance company, who, in turn, made them available to third parties to determine whether you qualified for things like medical leave or FMLA.
    I asked them how that was not a HIPPA violation, having strangers pore over my medical records

    When I got committed to a 72hr Psych hold, I recall reading their policy is to give you copies of your own records unless the Psych doctor doesn't think its a good idea they can redact portions or withhold entire indefinitely.

    About 20 years ago, I was a new independently operating Massage Therapist. I had a basic health intake form. With what I was taught in school, I was terrified that I would violate hippa and lose my license. I will admit that as a young naive person, I never actually read the hippa law.

    The fact that people have no rights at all is severely under appreciated. As usual this is counterintuitive, like all other matters in public discourse. Notice how the abortion issue undermines your rights especially how it’s framed in public discourse, you essentially making the argument from both sides that the government should be making decisions on your body or someone else’s body, the baby.

The abortion argument violates this principle. I know it’s framed that a woman could have her life endangered, but the liberal argument ignores the nature of the matter. Fetus is alive and naturally the baby requires nurturing and to call a fetus a parasite is intellectually dishonest in the way that a fetus needs to be supported up to many years after birth. Scientist consider human babies as mal adaptive because of this, the argument being that a lot of other species the babies are naturally able through instinct or whatever they considered ready to go from day one.

    Read those privacy policies closely, even for providers you've seen for years. A recent merger among several hospitals created a new consortium, which mandated signing a new privacy policy. I was *horrified* by the provisions. By default, they had the right to sell your body fluids and medical data to third party commercial providers that they admitted had no legally mandated privacy protections. It was possible to opt out, but only after you'd already agreed to the original privacy policy. Even my doctor hadn't read the new agreement and was as appalled as I was by those provisions.

    If ever you want to drive a truck. You give up your rights to medical privacy and rights to the company that hires you. It's not uncommon to get your license denied if you fail to keep your medical updated. They will refuse to hire if you do not sign your privacy away. When you resign that data has already been shared with gov agencies that now attach those details to your license for the remainder of your life.

    HIPPAA gets horribly abused.
    For example, they overcollect in advance by knowing your deductible and %coverage, then take a month to file with the insurance (so that other visits knock down the deductible) and then wait a month to get the insurance check and anot pher one or two to write the check. Result... they play with your money for 3 months... great way to get financing for them.

    Another great video, Naomi! I've been having this conversation with the local massage place I go to. They collected some medical information and have yet to provide a privacy statement to me. I've asked several times. They claim they have a strict adherence to HIPAA policy. I said that doesn't mean much. They don't get it. Maybe it's time to file a complaint.

    This really needs to get more attention. There are foreign billing companies in India and other places that are handling all patient private information for people in the US. Now that VC are getting into hospitals and medical practices they want to make more profits so they have the billing done overseas.

    Yeah, I wrote the ETL code for the regional NE TN and SW VA Health Information Exchange (HIE). They have a very entitled view of that data. My recommendation would be to refuse to visit practices who share your personal and private healthcare data with anyone else for any reason. Bring with you your own contract and demand that the physician signs it before treating you.

      Yeah okay. Your advice basically amounts to "be rich, don't be poor, hire a private concierge doctor, ofc they don't take insurance, obviously." Nobody with health insurance has that option. Have you ever been to a regular pleb/serf doctors cookie cutter turn and burn doctors office? It's often big hassle to just make an appointment, or get them to do the simplest tasks, like have you actually dealt with a doctors office? You'd be laughed at if you brought your own contracts for them to sign. Then when they realize it's not a ruse, they're gonna call the police and have you trespassed. This sounds so delusional. Like it's trolling or for someone that has experience in the regular reality the serfs live in.
