- The plaintiff brought her car to the defendant’s shop for repairs, but when she got it back, she claims the vehicle was undrivable, so the plaintiff is suing. The defendant says he did some work on the plaintiff’s car, but when he cut away the quarter panel, he noticed the frame was rotted. The defendant told the plaintiff the car was unsafe to drive, but the plaintiff didn’t want to hear that. Instead, she took the car somewhere else and wrote bad things about the defendant on Facebook, so the defendant is countersuing for defamation of character.

He countersue her for defamation. In his case, as a businessman, it means that she damaged his reputation, but at the end when he talked to Doug, he said that he got more customers, it was beneficial to his business. So, did he basically sue her for doing good to his business? 😂😂😂😂😂😂
The defendant doesn't need to be in business. If you give a low quote because times are slow then that's just the risk you take. You can't then put those jobs on the back burner because more lucrative works comes in later.

I can understand the plaintiff being upset in this circumstance. I'd be just as disappointed and dissatisfied. The car in question is in worst condition than it was before he had it.
You get what you pay for......anybody with a brain should know all the rust removal, ding/scratches removal, and custom paint job being 1500 was too good to be true.

If you take a rusty car to get repaired and repainted and they tell you 2 to 3 weeks and $1500, run, run as fast as you can. MAACO will do a decent paint job for $1500 or so but that includes ZERO bodywork. And rust repair is some of the most expensive body work there is. I once repaired the bedsides of a Ford F150 with rust repair panels and then the owner took the truck to MAACO to get it painted. It looked really good and I charged $800 for my part. But the rusted areas were very small compared with the disaster this lady's car is. If she want's something rare 4000 isn't that low of production number. Try buying a '71 Hemi 'Cuda convertible. They only made 5 or 6. That is rare by my standards.

What happened to being able to get the “benefit of your bargain”? When she struck a deal for $1500 to get all the rust fixed she should have gotten that deal regardless if he had to pay someone else since he breached the contract

The Judge makes no sense when it comes to some of her verdicts. This one she reimbursed insurance premiums, but in previous ones she's told them they should have cancel their insurance

I just posted the same thing then deleted it after I saw someone else posted that. I have known quite a few auto body repair guys and not 1 is over 200lbs. Mechanic's are a different story I've known plenty of fat mechanics buy never an auto body guy.😂

No, I don’t believe she perjured herself. Pretty sure those were 2 different people. One guy came up there from the group threatening him but then she also brought a mechanic with her a separate time to look at everything.

She didn't send someone. Someone asked her for more information and knew of the guy's ways and paid a visit himself. That's why it's a community group.

Minnesota here. I once drove to St. Pete's during February. My car stuck out like a sore thumb because everyone in St. Pete's drives pristine looking Oldsmobiles and Buicks and my little Hyndai was covered in salt stains. I tried to find a car wash but here were no gas station $6 automated ones. Its was more like the $25 car wash places. You old folks down there take your car washes pretty serious!?
From the photos the car appears to have an extensive rust issue. Rust on a vehicle isn’t easy to deal with in the first place. If its that extensive, you need to take it to a shop that specializes in automotive restoration. $1500 isn’t going to do it.
And when I saw the gum in his mouth. Yes, Judge Judy would have ended that first thing lol.

It absolutely does. My son moved from Washington State to Minnesota. He had a beautiful Datson 280 Z. He didn't have a garage at his apartment so the car was parked outside. The car rusted out and we had to junk it.

$1500.- for all that work? All I can say is if someone quoted me that little for that much work I would RUN AWAY as fast as my legs would carry me. If that price isn't a red-flag I don't know what would be. Even if, and that's a big if, the defendant completed the work the quality of the job would have to be soooooo low it wouldn't last another winter. Sometimes when it sounds too good to be true it usually is.

He way under estimated how much work he faced and she should realized it always worse than expected once parts come off. Every one in a rust belt state already knows that rust tends to hide behind stuff.
I don’t understand why people comment about his body, he took long yes but with that amount of rust and sanding and primer on the car and taking apart the car to get the primer takes time, I think he shouldn’t have told her that amount of time but he should have been given money for the time and parts

Defamation is only if it’s false information said about someone but if it’s true it’s not defamatory or slander.
So...he completely fucks off on her and leaves her car in pieces. Threatens to impound it when she demands he fulfill the contract. Then he countersues for defamation when she only exposed accurate information about her experience. He loses and afterwards admits that her "defamation" BROUGHT him business. She should counter - counter sue for a portion of the profits that he made from her ad on the grounds that he falsely claimed that she hurt his image when actually he admitted it was the opposite. What an idiot.

the work he did was stripping the car of its parts which is like the first and only step of what he did. he had to remove the rust and any dents/scuff marks, repaint and then reattach the parts… he did none of that.

This is what I think happened: She went on FB asking for help and he saw the pretty lady and offered to help her (as often men do). Why else would he charge her less then the work was worth? but at the end of the day you have to complete the contracted work, cause it may cost her less but its not free work either.
If he felt the work was way more then he expected he should of put the brakes and called her giving her details as of why its more and they cant agree on a price he should of returned the car to her sooner.

First off, anytime a car is coming from the Midwest / Northeast region of the United states. It's going to have some rust, there is no such thing as a rust-free car from that area unless it's a brand spanking new. There's also a service that many mechanics / body work business offer in those areas and it's a clear coat of the bottom of your car. Basically, it will protect against any sort of rust that tries to encroach on your car. I'm only 2 minutes and 50 seconds in but it sounds like this woman fail to do that.
Also, why would you buy a 7 year old car for $6,000? That car better have less than $50,000 mi on it, I don't care if it was special edition, hot modifications on it, the only time a car is worth that is if it was one of 800 made.
Also, is this woman a huge fan of NASCAR why else would you buy a Dale Earnhardt car?

I don’t understand these judges, in some cases when it’s a repo cases, they charge 200, 300, 500… a month for “car rental” and the plaintiffs lose a lot of money, now the woman has been screwed over and just receives 750 for 3 months and the car still not done…
