  • Today, we tackle an exciting and timely topic: upcoming changes to operating drones beyond the visual line of sight (BVLOS) from a commercial perspective.
    David discusses the recent signing of the FAA Reauthorization Act of 2024 by the president on May 16th. This act sets the stage for significant changes in BVLOS operations, with a final rule expected by September 2025. This new rule will streamline the process for commercial drone operators, eliminating the need for special exemptions.

    What about the multiple drone videos of people making one of those maximum-distance tests, I'm quite sure, you won't see a micro drone reaching the 5 km mark.

    So 135 BVLOS is going to become available without a waiver? Then does that mean 108 is going to come into effect…and how is 107 to 108 going to be implemented? Different testing standards?
    Because as of rt now the 135 waver is used to do BVLOS, I was in the commercial industry for the last ten years at a subsidiary of Boeing… I left to follow new opportunities. Well and because it was Boeing. 🤷🏻‍♂️

      135 was targeted for UAS BVLOS because it is for unscheduled air carrier flights. And the belief was/is that drone delivery will be the largest, at scale, advent of BVLOS UAS flights. Having said that, we both know that delivery will NOT be the only high demand for BVLOS drone flight. So, the lengthy process of either TC of an aircraft, or multi year process of attaining 135 certification through ASOC (or 44807 aircraft statement of compliance) just to fly BVLOS for data collection or taking pretty pics...seemed rather excessive. Hence the heavy push from on high to come up with something outside of the delivery vertical for regular and process efficient BVLOS operations. Big differences between 135 and the proposed 108..mainly "for hire (on demand) air transport carrying the property of another for compensation"
      So, if you read between the regs close enough..this ISNT to say that you can't do "drone deliveries" under the eventual part 108. Think about supplying your own oil rig offshore, or re-supplying one of your own jobsites with some of your materials you maintain in your own warehouse. That would be an allowable delivery under 108..so far as we know and per the ARCs recommendation. Long explanation short..108 will let you fly drones BVLOS without having to become an "air carrier".

    Should also be a person on his own property or an authorized property flying beyond line of sight is authorized.

    I am still working on my Part 107 with your program. So, are you going to then have a Part 108 too?

    I would hope to see an extended line of sight change to the regs or at least the removal of must be able to see the attitude of the drone from that part of the reg.
    With a small drone like the Mini 3/4 pro, technically flying it more than 150' (or a little bit more) away or even high puts you out of line of sight as defined by regulation.
    Even if you can see the drone and all the airspace around it, even for miles, you are technically breaking LoS regulations since you can not determine its attitude without an visual aid, not even using navigational lighting.

      It'll likely be relative to an effective SMS and performance based ratings system. The types of aircraft they are looking at for long range BVLOS won't be for shelf bought drones. Just over the tree line or to that effect? Yes. The scope of any 108 certification will very much be related to the flight profile or scope of mission vs just a "1 certification fits all" approach, as with 107 or even 135/137. 🎉

    I'm new to all this... so please forgive my ignorance if this has been covered:
    With the range available with small drones, does the RC2 qualify as VLOS? In an area of smog or persistent wildfires, any human eye would not be able to see a drone very far at all, making them essentially illegal to operate.
    What does "Visual line of sight" include?

      Visual line of sight means you can actually physically see the drone at all times. The purpose is so that you see and avoid other aircraft in the airspace.

      @DroneLaunchAcademy the RC2 allows for such avoidance, manned aircraft are 100' higher than small drones which means the only other aircraft are other small drones and birds... both of which see eachother. I don't see the line of sight being any better than if in a manned aircraft. Maybe this is a question to raise in September. I hope you'll post the link. Much appreciated ~
