Most states have clear dram shop laws that will hold an alcohol vendor accountable for serving an intoxicated person, when a reasonable vendor would have realized this person should no longer be served. Continuing to serve an intoxicated person increases their chances of hurting themselves or someone else.

Drunk drivers need to show intent that they plan to drive drunk. Keys in the ignition show that intent. In addition to my experience in law enforcement I was also a bartender. In many, if not all states, bartenders and businesses can be civilly and criminally responsible if they over serve a patron and he/she kills and/or causes damage to property.

If you genuinely think you've made an honest mistake, like the time I was dead-tired and stopped at a red light, looked both ways, and then went through it, got pulled over, and then just told him sorry on my way home from a long shift and I just got mixed up there for a second. He let me go, but sometimes they've got you in the crosshairs and at that point, your best bet IS actually to stop answering any and all questions and try to use the court system.

in most places to be arrested for DUI/DWI in the US you just need to be in the car with access to the keys. Its mostly up to the discretion of the officer but I know officers who arrested people who where asleep in the back seat with the keys in the front seat. if he wasn't on the side of a major highway though it probably wouldn't have been an issue.

It is a grey area if someone is being responsible by not driving, yet sleeping one off til the person can drive and the keys are in the ignition with car on so the heater can warm them up. The vast majority of people who ask for "Their attorney " have no attorney. It's a great idea to get one but you don't have a right to an attorney as you are getting arrested. Shut your mouth and tell the lawyer once you get one what happened so they can begin the process of getting the cam footage and reviewing the case. Being asshole won't look good in court. Even if the police are being an asshole you are not going to win that battle of wills.

Its mostly up to the discretion of the officer but I know officers who arrested people who where asleep in the back seat with the keys in the front seat. if he wasn't on the side of a major highway though it probably wouldn't have been an issue.

It is a grey area if someone is being responsible by not driving, yet sleeping one off til the person can drive and the keys are in the ignition with car on so the heater can warm them up. Officers can use officer discretion in this case by not arresting. But, the person still can be arrested because the intent with the car on is there. To me this scenario i gave would be a BS arrest.
The bartender should and can refuse service to those they feel have excessively drank, and they can get into trouble for servicing someone clearly drunk. The owner unless there has nothing to do with it. And I will say someone close to me fell asleep at the wheel, with there Foot on the gas and the car running. I broke the window and pulled the Keys out, cut my hand badly, and when the cops arrived they said they couldn't charge them with a DUI because the car wasn't running when they got there. In my opinion that I a load of shite. At least in the state of Wyoming. It should be the same in every state but it is not.

The vast majority of people who ask for "Their attorney " have no attorney. It's a great idea to get one but you don't have a right to an attorney as you are getting arrested. Shut your mouth and tell the lawyer once you get one what happened so they can begin the process of getting the cam footage and reviewing the case. Being asshole won't look good in court. Even if the police are being an asshole you are not going to win that battle of wills.

But sometimes officers also want to escalate things. The choice of words and the way they talk they want to escalate and when stupid people like these girls play just like police want then this is a party for officers.
So I think police also should try to act more professional, cursing, yelling, using words like spread your legs, you running from me, etc etc is just excuse to escalate. Explain one time if people don’t understand deal with them however you want.

Bar owners will be arrested if they KNOWINGLY let someone get in the car when it’s obvious they are drunk. there needs to be hard evidence that the bartender knew for sure that the customer is drunk
