In regards to Berserk, I think they really should try not to push too hard against this and let it be. Maybe its my bias as I am working on making anime live action films with AI, but I really think a statement to make it clear they don't agree to the use of their work being used is all they should do. If they sue (which they may be within their rights to do) is against the otaku spirit in many ways. Everyone really just wants to see a continuation of the '97 anime and not the modern CG adaptations. Fan trailers and fan content is just another great way to get free promotion for Berserk manga. But copyrights holders sometimes aren't thinking that deeply about it beyond just "oh that project is possibly making money off our IP". In the modern time we are very used to consuming memes and gifs and fan content that takes IP and remixes it, giving that IP more life and cultural power. Its a win-win but the suits "not like us" Sorry for the long message 😅
