    I want to point out that the psychiatric hospital order isn't an automatic life sentence the way people are talking about it. It's an "indefinite hold" because the courts don't know if the person can be rehabilitated and how long that could take. It could be fifty days or fifty years. The problem is that a doctor would have to sign off that the person was no longer a danger to themselves and society. A lot of doctors don't want to take that liability, so it's easier to leave someone languish in a mental institution than take the risk of signing a release order and then getting sued because the person they released reoffended afterwards. Hense why people sent to mental institutions typically have stays that far exceed what their jail/prison time would have been.
    The other thing people get wrong about the "insanity defense" is that, at least with a lot of US States, one of the conditions is that once the hospital releases the accused, they're brought back to court to stand trial and receive sentencing. I know my state, Arizona, has such a provision. (I remember it being enacted in the 1990's, but that might be me misremembering it.)

    The kid didn’t know to keep his mouth shut. Makes me think he didn’t have a lawyer or have a good one. Be interested in cyber security & want to further your career/life with these skills but manifesto’ing after being caught doesn’t mean you’re getting hired at the end of the day. Anyways hope it was planned out, hope he gets his freedom, hope he never sees the Pinkertons.

      To be completely honest, I have personally beat a large amount of cases and received bail at will for calling Competence. He most likely will have a better time at a mental facility than a federal hold. FYI all cyber crime in the United States is a federal offense which is always classified as a felon, a federal offense is a felon, not all felonies are federally offenses. Even using a person's wifi network unauthorized is 2-3 federal offenses if charges are pressed. This is a large scale attack on aprivate company so if you ask me he got luck and now can fight for early release under a conditional discharge, also if he's not 21 he'll ha e to under go are eval and depending on if he was found not guilt due to competency or Insanity the words matters and level of court the sealed the order, other courts can adopt an order from another court.

    This just shows how unwilling the US legal system and that jury and/or thar judge is in dealing with mental health issues. People can be rehabilitated and redirected into constructive paths if they are given the care that they need and likely needed most of their life but weren't receiving.

    • @Rudirudel
      @Rudirudel 5 місяців тому +1

      The guy lives in the UK. Not everyone in the world falls under your weird jurisdiction. And concerning the "unwilling to deal with metal health issues" argument: That's exactly what they did, didn't they? They send him to a hospital instead of a prison to be treated. And if you think about it for a second, how would you describe a person that is under arrest and confirms to the court that once he is released, he will commit crimes again, other than mentally ill? That's not what a sane person would do.

    • @jackielinde7568

      No, it's a case that he'll get out when a doctor feels he's no longer going to be a liability risk if the doctor signs off on the release order. Also, depending on where he is, the stay only prolongs any sentencing hearing. That's the way it's in my state. The mental hospital isn't a "get out of jail free" card, just delays the inevitable.

    • @Southghost5997
      @Southghost5997 5 місяців тому +1

      It's not a sentence of life in an asylum, it's indefinite based on rehabilitation. He, and his doctors and family are fully aware of this. Someone who acknowledges they did something wrong, shows no remorse and is motivated to repeat the wrongdoing can't simply be let off free without consequence. I'm not so sure on the current recommendation though, it does seem harsh on the surface, maybe as more cybercrime becomes prevalent we'll learn how to better handle cases like this.
