I used to be many years ago a waitress, I’m sure my hot headed self I would have certainly smacked him back, what the hell is his problem , ignorant nasty person.
It's assault - and utterly unprovoked from what we can see - as the waitress, there's no way I'd walk away from that, plus her employer has a duty of care to keep his staff safe in the workplace.

The police are supposed to uphold the LAW. They're not supposed to take sides. They're not supposed to take ANYTHING into account except "Is this person committing a cr!me under the word of the law?", not "We got quotas to fill" and "I can't arrest [XYZ] because that would cause me problems". And they're DEFINATLY not meant to be a goon squad of "Enforcers" doing whatever politicians tell them to do no questions asked. The only metric applicable for telling if the police are doing a good job is "Are law abiding citizens happy with the level of protection we're providing?".
If politicians want to change how the police work they're meant to transparently propose a change to the book of laws the police work from, giving the majority of the public (Who ultimately provide the operational budget for the police) chance to say "Yay" or "Nay" to the changes. Years and years ago every town ,village ect had a small police station and a handful of coppers they used to patrol their area on foot ,they used to stop and chat to people and call upon the elderly to make sure they were OK. This was a great way of policing. And if there was any trouble they were there very quickly.
