Annaleine "Anne" Reynolds was left stunned after PJ's Construction, hired by Keaau Development Partnership, built a home on her Puna, Hawaii property. abc7chicago.com/pjs-construct...
“Accidentally” sure… they’re trying take her properly by force.
You might accidentally deliver a load of mulch or even build a section of fence, but building an entire house is not an accident. Either gross error or intentional skullduggery on the part of the builder.
Also it's not so awful if you get the house for free which this 100% should be happening. Once this is all resolved she can either keep it or sell it for max profit.
@sylvainh20. But she does NOT WANT the house. She mainly bought the property for the beautiful fauna which has been completely razed. She wants the house gone, period.
she is going to get a nice free house
her getting the house for free is better than the developer removing it and restoring the land, including trees, at their own expense. Which is what should and probably is the baseline. Developer should be happy if she just keeps the house since they save money
Developers tried to save money by not hiring surveyors....look how it turned out
The county is at fault for approving and passing all construction!!! This is what happens when you hire incompetent people in authority positions!!!
Penny wise, and pound foolish!
Can’t sue a surveyor you didn’t hire.
Yep. That’s where they messed up
It happens all the time, the last fence we constructed for a builder was 14 inches in the other property, and I told them many times to hire surveyors, but guess what? They were too cheap to do it , and now we have to move almost entire fence to the right property line. More money hahahahahah!
That´s a huge and unforgivable mistake made by the building company. The owner should be let to choose between keeping the building for herself WITH NO FEES ON THE PLOT OWNER or the house being dismanteled/ demolished and the lot being returned to its former status WITH NO FEES ON THE PLOT OWNER
Finally someone with common sense. Exactly what should happen. She should also be recompensed for any money she's spent trying to resolve this, including the extra property taxes that she had nothing to do with raising, but still is on the hook for.
@@booboo8577She should be required to pay the increased peppery tax should she decide to keep the structure.
You suck she doesn't want the dumb poop house
I wonder if “Tree Law” applies?
I wish a lawyer would take this on contingency
How can you sue property owner for your mistake?,plus now with your mistake her property taxes have gone up
It's a groundless lawsuit they playing hardball trying to force her into a resolution hoping the legal fee's she now faces will persuade her to accept their rather merger offer of an alternate plot of land.
Even if she's broke plenty of lawyers would be willing to snatch up such a cut and dry case for free. They can EASILY sue the developer for legal fees. @@ZuulGatekeeper
Hawaii, that is all.
@@Jedi007c6 America land of the fee, not just Hawaii it's down to something called the 'America Rule' that requires each party of a lawsuit to pay their own legal costs regardless of the final result. Since such costs are not included in any final settlement it allows the rich to file frivolous lawsuits & bankrupt the poor by dragging them through the courts to either coerce a settlement or force them to sell anyway to cover the fee's. You don't find this in other Western countries there the loser has to pay the winners legal fee's.
I'm surprised she's not countersuing for the property taxes AND to make them restore the land to how it was before. Unjust enrcichment? Fine. If it was me, a demolition crew would tear the house down before trial, where I'd present the plaintiffs with the bill.
Build it own my land.. you wasted your money..take your losses... I'd sue for destruction of private property.. plus trespassing.. not to include to tax increases...
I’m going to assume the lawsuit is worthless. They built something on someone else’s property. How hard can it be for a judge to understand that. You don’t have permission to build on my property. And now you’re trespassing.
Possession is nine tenths of the law. She got a half a million dollar house for fifty thousand. Now she can replant all the trees again with the money she saved.
Their lawsuit yes, her countersuit on the other hand
@@RollingThunder808 She doesn't want an ugly poopy house and I don't blame her. What a nightmare. Developer needs to make her whole again,
@RollingThunder808 They killed her dream.. sometimes, it's just not that easy to lose something you worked and manifested.
Depends on the judge... If he's corrupted and taking bribes...the case is a lot more complicated 🙄
America is overran with corrupt judicial officers, attorneys and other government officials

They tried to steal her land. This scam has been going on for years. They need to tear down the house!
no they didn't. You're just so ignorant of the law that you think you somehow gain ownership of land if you build something on it. You don't. You lose ownership of whatever you built. The developers had nothing to gain from this
These developers, Keaau Development, didn't realize they had built on the wrong lot? They are either stupid to the lowest degree, or they did it intentionally for financial gain (maybe hoping that the lot owner wouldn't notice until after the house was sold and they had their money). Whichever the case, you wouldn't want to buy a house built by these people. The short-cuts and construction defects are likely spread throughout every house they build. And now they're suing the legal property owner? Wow.
I think it's their trick to force her to sell her property
for sure they didnt invest in good materials too and the work done in supervision.
How do you build a house with out permits, septic, well without knowing who owns the land?
They didn't survey the land thats the reason why
Have you ever met a native hawaiian? They are about as intelligent as a pineapple.
Thats america for you …invade your property and sue you 😂😂😂
My property my house. Its not my fault you built a house on my land lol.
WHO TOLD YOU TO BUILD A HOUSE ON MY LAND
It’s insane that the developer is suing her; and now, she’s countersuing which maybe she might not have done if they hadn’t sued her first. And they totally deserve if she wins for the cost of protecting the property, increase of taxes on it, plus the loss of foliage. The developer is implying she’s lying about her new age-like reasons for not wanting to switch lots. It doesn’t matter. It’s her land! She can want to keep it for specific new age location reasons … or just because there’s a free house on it because of someone else’s mistake. She doesn’t have to be altruistic to a development company. If I were in her place, I’d do the same thing and I wouldn’t have new age reasons. (Btw, I hope her lawyer also puts defamation for calling her a liar in that countersuit. Seriously, they DESERVE any grounds they can think of for suing her in the first place!) I hope she wins that countersuit, can then sell the land and house; and is able to buy an even better plot of land OF HER SPECIFIC CHOICE for her retreat somewhere else.
100% agree
The company should be sued out of existence.
"It’s insane that the developer is suing her"
No it isn't. He cost her 70k in damages and he already offered her that but she demanded he incur 850k in losses because she's angling to get a free home out of it. You would sue her too.
they were required to conduct an evironmental impact statement for the native species on the land. So if they were so reckless to do this, they probably have destroyed a lot of native habitat on other sites.
no in hawaii it is not needed
That house is not worth $500,000. It probably cost about $100,000 to build.
And now worth much less.
It's Hawaii. That's pretty low for the Islands.
have you looked at local reale estate costs across the USA? 500k for a 1 acre single story home is pretty average. The days of 200k and 300k homes is LONG gone. It's what happens when investment firms buy up 85% of homes in the united states and then don't sell them.
Remember: you'll own nothing and be happy.
@@TheWorldsprayeronly in certain areas. You just gotta look. I bought my house last year in July. 170k for just under 3k sf with a 30x24 shop
@@johnmassie9701 yes but moving across the country for a somewhat cheaper home isn't an option.
I'm in western colorado where prices are insane because inventory is incredibly low and demand super high with denverites trying to move out here.
Where were the inspectors during this whole process of building this house on the wrong property?
It was built one lot over from where it was supposed to be built. I have purchased property all over the country and I usually go out at identify the 4 corners of my property using a variety of methods. Some areas are easier than others. Sometimes I get GPS coordinates of the property corners or boundaries and other times I don't. The purpose of building inspectors is to ensure the home is being built to the building code of the municipality.
That's why they're supposed to hire surveyors but the developer didn't want to, most likely (ironically) to save money
@@ChrisHarding-lk3jjusing a method that isn’t 100% still makes you liable for using the privately owned property (which includes land) of others so it’s of little to no consequence wether you’re too lazy to hire a professional surveyor to do the job right if you can’t do it with certainty you aren’t violating others rights. However the inspector part of your comment is 100% correct
Inspectors are responsible for the actual building, not property lines. That falls to surveyors, which the construction company opted not to use.
It’s not an inspectors job to ensure what is being built can be built there. Only that it complies with building codes. They don’t survey, not their responsibility.
Was this developer licensed because he’s a shyster and should be shut down.
Seems like she owns a house to start her retreat
Except they bulldozed the very thing she needed on the land. Nature and surrounding habitat.❤
@@jcook2433 That can easily be fixed, I wholeheartedly believe this is a fantastic outcome for her if she focuses on the positives. With time and effort replanting will succeed and the natural habitat will return to the area.
She gets a free amazing house and gets to replant conveniently around it, she can really turn this into an fantastic outcome for herself.
They built an ugly house and removed her plants.
IF I were her, I would sue the developer for all costs, value of the land, additional taxes, and any other costs. Then take possession of the house, and sell the package. Buy another tropical property to replace the one that was ruined.
It may not be that easy but otherwise maybe.
Developer can pay the cost to move or demolish the house AND restore the land to it's prior state or give her a big payout. NOT the other way around.
no, she can take the lot right next door. she doesn't have a valid reason why the lot next door isn't acceptable. She's trying to pull a con to get the home for free so she's claiming her current lot is aligned with the stars, which is something should would have no way of knowing without advanced math, physics and astronomy that are way beyond the community college required to be a nurse. To have calculated the alignment of her house to the stars to such an exact degree that a property 50 feet away won't do would be quite the feat. The Egyptians would take note. I can't wait to see how she explains how she did it in court.
Sounds like the the builder, developer, and real estate agent CONSPIRED TO COMMIT FRAUD.
Why aren't charges filed? Too many donations to local politicians, maybe?
This woman should immediately file a counter-suit for all the damages her property incurred because the constructing of that house means the land cannot be returned to its natural state.
Has nothing to do with conspiracy. They made a huge, colossal mistake by not hiring a surveyor. Simple as that.

the property had already been surveyed by the time they began construction.
I live on Oahu and have NEVER heard anything like this happening anywhere in the country, much less in this state.
Seriously? Keaau Development Partners and PJ's Construction should both get sued; Keeau for cutting corners and RJ for trespassing and not doing their due dilligence!
nobody cut corners. it was a residential subdivision, meaning the surveyors already surveyed the entire subdivision and drew up maps which were submitted to the city, at that point, the properties are found from the platt maps, not hiring a surveyor to find them.
Take that house apart, and give the land back to the owner
She shouldn't have to pay for their incompetence.
I can't even imagine.
I would be livid
What a nightmare!
Nightmare? The lady gets a free house. This sounds like a first world problems, problem.
It was the builders error why is she ɓeing sued? 😮
Because whoever has money can afford to sue somebody
because he offered to cover her 70k in damages and she refused because she wants him to take 850k in losses to cover her 70k so at that point he had to sue because she is being so unreasonable.
She should sue them and to ensure the building is removed.
Are you kidding? The developer is suing? Before they do work, verify. Someone dropped the ball. Not the owner of the land.
I'm wondering why She isn't suing for all the above and some and the grief.
the developer is suing because they tried to cover the damages but she wants them to pay over 10 times that so she left the developer no choice. Would you agree to take an 850k loss for damages of 70k?
*that house is $500K? probably the cheapest house in hawaii.* 😂
It's in a really really bad spot according to some of the locals. It's supposedly in the potential flow path of an active volcano
It's the house 🏠 without the land which no one will want.
No one wants to take responsibility for their mistakes or actions. It also looks like they cleared that formerly beautiful site of all of its foliage.
She should sue them, any jury will award her the money.
no jury will award her the money she's currently trying to get from the developer. She's trying to force 850k in losses on him to cover her 70k in damages.
Developers should pay her the difference in taxes, pay for demolition, pay the worth of the plants they removed, and pay for emotional damage
no they shouldn't. she should swap lots with them.
She should be able to keep the house.
no she shouldn't. That's called unjust enrichment under our law. If you are given something of value by accident, our laws say that you still have to compensate the person that gave it to you.
I live here on big island.
I know this neighborhood.
That house costs 80-100 thousand to build.
Not 500.
That is a crime infested area...in the prospective flow from the volcanoe if it erupts.
Thats why the land is so cheap and impossible to get home insurance.
Lol! What a mess
hilarious, given that half the people in these comments think the developer was trying to steal her property because it's worth so much.
I'm still trying to comprehend what MAN thought the next best solution was to sue the PREVIOUS landowners as well as the current?
the developer is probably wondering why the lawyer did that as well.
My land, my home.
Yokel laws! When you bulldoze and build a house, nothing is “accidental’ about it. The mistake was the building company’s - not the land owner's or the county's. The land was not surveyed nor verified by the county or the landowner - that is the construction company’s responsibility, not the landowner’s. The land owner can counter sue - for a whole range of restitution and compensation. The construction company is also guilty of trespass.
She should not have to pay at all its her property that should be her house! She should rent a bulldozer and level the house then sue the developer and have them arrested for tresspassing
Not her problem or fault in any way. Developer and agent need to resolve. Any judge that rules otherwise should be removed from the bench and disbarred
"Not her problem or fault in any way."
It's definitely her fault she's getting sued. If you caused 70k in damages and the person you damaged refused your offer to give them 70k and instead demand you to take a loss of 850k, you'd sue too.
they didnt build a whole house accidentaly... they shuould leave that house and keys to her now. they tried to steal her land and even have guts to send her to court? for what? that she didnt allow them to build in her land? and how did they get all the papers to allow them to build in that property, that means they have even corrupted someone on the way...or did they make mistake too ? if the judge does not rule in her favor he shouldn't be a judge anymore. they trasspess, they build illegaly, they even didnt have a build premit for that house or if they had how did they get it without her consent, and than send the case to court? on what bases? they even damaged her site without any consent...
The land owner needs to hire an attorney and sue the developers and the county, along with everybody else involved.
she's already in a lawsuit and she's on a nurses salary against a multimillion dollar business. people use the courts to harass, delay and bankrupt their adversaries, not win the case.
It’s a crying shame and the bottom line is, it’s her house if she wants it’s! They need to make it right for her and they need to except the loses of there mistake! I am not sure why she has to pay extra property taxes when the county gave them the permit, and it is their responsibility to assure that the permit they are giving is legal. And, giving someone a permit to build a structure on land that is not theirs is, well, not legal. The county should not be unjustly enriched because of their mistake.
She should counter sue!
Negligence and accident are not the same thing.
The owner can enforce no trespassing on her land and she gets a free house
The land owner should be offered money to take the house. The house might not be to her liking or might be in the wrong area of the land. It would cost her thousands to have the house removed.
Shouldn't be on her to do anything but go see her empty lot again some day. Why should she pay to have anything done with the house?
She was wrongly robbed by dumb builder who is a crook & a bully
that's the dumbest shit I've ever heard. The court will say that she owes the developer the costr of the house if she intends to keep it so why would the developer pay her to take it? If someone gives you something of value, under our law you still have to compensate them for it. If you don't then it's called unlawful enrichment.
Someone needs to go to jail for this.
Seems obvious, if the home was built on 'her property', it is now inclusive of her property, and demolition would be TRESSPASSING. See your state codes for NO TRESPASSING SIGNS and put them everywhere!!
So what will happen now
Keanu Development should lose their business license over this.
no they shouldn't. your ignorance of the home construction trade makes you incompetent to render a decision in a matter like this.
Wow, you made a mistake. Take the L and move on
how will she spiritually heal now? 😂
Sounds like blackmail and mail fraud
Sued for a mistake they made? Now she has to pay for an attorney to respond and counter sue. So much for the woman's retreat. 😳
"Thank you for your gift. Now, GTF off of my property."
if it had been built with out permits the city would have it bulldozed, building should be completely removed and then land restored to its original condition as best as possible, that means bringing back in native trees and plants, and reimbursing her for all legal fees IMO
These laws need to be made stronger, especially for squatters. Squatters have no rights if the property is not theirs. There are too many ways to commit fraud and scams by allowing them access or rights to the home that is not legally theirs.
That woman is violated and the developer should take the loss. It was built illegally and they did not have or follow a proper procedure to make sure the land was free and clear to build upon.
I don't know about all states (which it should be in matters regarding this) but this is what they should have done and why squatters have no rights to a home that is not theirs.
A title search report is essentially a snapshot of the property's ownership history. It includes information on the current owner, any outstanding mortgages or liens on the property, and any easements or encumbrances that may be attached to it. In Florida, a title search is done by a licensed real estate attorney.
These people were in violation who built the home. Good thing they did not sell it to anyone and they lived in it. That would compound their problem.
The fact that they sued the actual land owner says a lot. Mistakes are made but this is pathetic.
it says a lot about how unreasonable the lady is being. You have to understand the journalism here is highly slanted and always is in cases where some business is suing an individual. The news wants to look like they are the defenders of the common man but they don't have the spine to challenge big corporations so whenever some local business sues a person, the news uses the opportunity to create the appearance that they are fighting corrupt businesses that victimize the common man, even when it's the individual that's screwing the business.
In reality, they offered to cover the lady's 70k in damages but she refused and wants them to take 850k in losses over a shitty piece of land in a high crime area on a lava flow where it's impossible to get homeowners insurance that's exactly the same as the lot the developer owns next door to her.
They need to bulldozed the house and clear the land. She needs to put fence around her land and signs saying no trespassers.
Where was the surveyer during the first steps of the construction process?.
the surveyors had already come and gone and left platt maps for everyone else to use by the time the contractor was in the picture.
"Both had poop!"
Not a line you usually hear on the news.
She should stand her ground. Literally
That is another universal law they should have. A survey of the land each time a house is sold, instruct the owner's of the property lines and also any renters. It would save many people having fights and going to court. Give them photos of their property lines. I have had residents take out the survey rods and place them inward of our property, taking away from our property. This is against the law and there is a state statute against it.
the survey was done. it's a subdivision. they are surveyed, subdivided and maps are submitted to the city before any construction begins. the contractors use the maps to find property.
That horrible house has been there for decades.
What I assume when you are developing or even surveying a property lot is make sure nobody owns that Lot so It's not just the developer's fault but those who approved the documents for it. Or it may have been illegally built.
What a beautiful lady! I hope she gets her land returned and the retreat built of her dreams after she wins her multi-million settlement.❤ How does such a mistake happen???????😢
A small, local builder made this mistake. They wouldn't have a million dollars to pay in a settlement. They'd just declare bankruptcy and start up another company under a relative's name. That's the Hawaiian way.
They would be leveling that house and replanting every blade of grass and wild flower that got destroyed. As well as a monthly fee for not being able to use my property and storage of their materials, including back pay from the first day they had any material dropped off on my property.
if you asked for that then they'd sue you and win. If someone causes you 70k in damages, they don't owe you 850k in reimbursement no matter how badly they got your knickers twisted.
@jimbeam-ru1my what makes you sure they would win? As a contractor myself, I'm aware of how far things can go south for us legally.
@@demon12792 The goal in these suits isn't to get the judge to render a verdict in your favor, it's to draw the process out to delay and harass your opponent so that they will agree to a settlement on your terms. You can shoot for the moon and ask for every kind of compensation you can think of, but that will just ensure the opponents lawyers keep filing motions and setting hearing dates until you can't afford the process any more and take whatever settlement they offer.
The nerve!
She will lose her land, will lose in court, end up paying all fees, court fees, and in the end prob get sued for trying to plead her case as a innocent poor old lady.
They sued the PRIOR lot owner’s family?! WTF?
She needs to countersue for the property taxes!!
Not lawyer, not legal advice.
That being said.
To sue for damages you need two things.
1. Liability
2. Damages
Owner is not liable.
Owner incurred no damages to the builder.
They messed up. they need to own it.
If anything, the builders are in fact 1. liable. 2. have incurred damages to the land owner by a. modifying the attributes of the property that was important value to her purchasing it, b. caused her to pay more tax, c. likely has to end up paying more to get her project built because she needs to undo the work these builders did.
She can sue the builders.
she can sue the builders but if she did then she would be entitled to the 70k value of her lot. She currently wants them to incur 850k in losses, which is why they sued.
She is handling it properly. Doing nothing and letting them fix it is what it looks like to me. Its their problem. Let them pay all involved to resolve it. Best call on her part. Put up no tresspassing signs and wait to win in court.
lack or planing on your part does not constitute a pay on on my part either remove the house and restore the plot or piss off
Sue to have the house removed and put back to original, sue for taxes that the government says is owed...n
Trying to sue the victim of their stupidity...
I don't understand. It's her land. Why is there even a discussion? They fkd up, they need to remove the property from her land, why is it any more complicated than that?
#1 always hire surveyors
#2 hire a land title lawyer
#3 don't do nothing until all is cleared
Builders normally have insurance but I bet they don’t want to involved the insurance or their premium is going to jump. That was a very stupid mistake. She should not have to leave the property. She can demolish that house if she wants to. She did not ask for it, why would she have to pay for anything? Ask the judge to demolish it
Require the builder to move the house to the lot next door?
This was no 'accident' . Developers do not make rookie mistakes like this
We need to make sure no one ever uses this company again
Tell them "I want the house bulldozed."
Watch their jaws drop. It's illegally placed on her land and they can be required by the court to remove it, AND return the land to its original state (implying, they'd have to reseed all the plants too).
They'll turn that dinky home into a gorgeous studio like she wanted at an even lesser cost for her, to avoid the deconstruction costs. She's got em by the balls.
She should sell the property and the house hire a lawyer and sue for more
Its her house for free. Plain and simple.
After the land was stripped bare, and then the squatters, It is essentially firewood, etc.
I know a lot of people are like - how could this happen?
But this is more than a mistake - this is the second one of these kinds of things I've heard in the past few months.
The other one in CT - and the developer sued the owner of the property then, too.
it happens a lot more often than that. When a subdivision is created, the land is surveyed and divided into lots and the surveyors create platt maps which are then submitted to the city which the contractors and everyone else use to identify properties in the sub division. The contractor takes the map and then takes measurements from surveyors marks or landmarks to find the exact location of the lot. Sometimes they fuck up. Like everything else, human error happens. Sometimes the surveyors fuck up and the maps are a little off. Mistakes happen.
The problem is that people think the developer did it for nefarious reasons, like intentionally trying to steal property (you can't gain ownership of land by building something on it). They never believe it's an honest mistake. Houses have the illusion of permanence and immovability in people's minds, it's inconceivable that one could accidentally be built in the wrong spot.
Well, they can either rip down the house which will cost them.. but I suppose they get some usable materials back plus pay the costs for restoring the land to its original condition and possibly other fees. Or let her have the house for free and take the L. Have seen this happen with roofing projects but more rare with a whole house lol. For roofing mistakes it's usually just easier to let the person keep the roof for free.
I hope she ends up with a free house. To me, her 'new age' reasons are guano crazy, but it's HER lot. Maybe she can sell the free house and find another place for her 'new age' retreat.
As someone who surveys land I call bullshit
you call bullshit on what? If you survey land then you should know that when a subdivision is proposed that the land is surveyed and maps are drawn up that are submitted to the city and at that point finding lots can be done using the maps and taking measurements from landmarks or surveyors marks.
Hey its a hot market over there u snooze u loose! Make sure you keep your paperwork up to date!!!
