    The company I use to work for donated left overs, but stopped because someone got sick and sued the company. As much as I like the idea, I can see people abusing this law.

      Same thing happened here ìn Ohio. I hosted my sister's bridal shower at a hotel, and not everyone came. We asked to take the leftovers home, and they said we weren't allowed to do so because of that very reason. Such a waste of money and food.

      @@elmariamgibson Your sister has already paid for the food. She can take it if she wants. You, on the other hand are not the paying customer, so under profit-driven "sanitary" laws, they can't give the food to you. Should have had your sister/husband ask, and they would have had to give it to them. They paid for it.

      When I was young and worked for Starbucks the organization donated to would barely ever pick up the donations. 95% of the time we'd have them ready for nothing. Saw this happen at multiple locations over the years, not even one district or even one org that may have partnered with multiple locations.
      It got to a point a lot of stores didn't want to waste the labor because of these organizations. Across the board everything about food donations needs to be revamped. Even though companies like Starbucks try to forecast their supply to avoid waste it's devastating how much food was thrown out most nights.

    The thing people don't realize is that it requires approval / laws changed to allow this. There are rules out there about "expired" foods (even if they are still good). I worked at a supermarket back in the 90's and every day we'd throw out at least 30 loaves of bread amongst other things. Basically bread baked daily gets tossed at the end of the day because fresh bread gets made the next day before the store even opens. Bread isn't dead after 20 hours . Opened packets (*those scummy parents who open a box of 10 iceblocks in the supermarket and give 1 to their kid to shut them up and leave the other 9 in the freezer*) of things get tossed as they can't be sold "individually". This means if you open that box of 10, you've now stolen 10 as the other 9 get tossed out as nobody is going to buy a 9 pack opened and pay for 10.
    People go to the deli and order $10 worth of something . It gets wrapped, priced, stickered and they put it in their cart. They then decide later they don't want it anymore and either (leave it on a shelf unrefrigerated or stick it in another fridge). This is something that can't be returned so it just goes to waste.
    I worked in a convenience store once and had this woman take a cold drink out of the fridge. She opened it right there in front of me and said, "I don't think it is full enough". Of course she broke the seal doing this which means I can't put it back on the shelf. I just drank it later on as it was now "waste". I assure you, there was nothing wrong with it apart from what she did to it by opening it.

      Dumpster diving is illegal because of idiots that sued. They ruined it for the rest of us that realize " Do so at your own risk". I used to love dumpster diving. It's the adult version of Christmas, you never know what you might find.!!!!

      Donating food to food banks and other nonprofit organizations is protected from criminal and civil lawsuits by the Bill Emerson Good Samaritan Food Donation Act, a federal law signed by President Bill Clinton in 1996. There is no available public record of anyone in the United States being sued because of harms related to donated food.

    I once worked at a country club, I couldn't believe how much buffet food they threw away after each day. I asked my manager if I could take food home for my family, she said no. It wouldn't look right if the patrons saw us taking food home. But still it's not right. We even had someone that got fired for taken food home.

      The resort my wife worked at for a while has the same problem. Lots of food from the buffet goes to waste. They used to let employees take the leftovers, but had to stop that because all the employees started cooking extra to make sure there was food left over so they could take it home.

      The reason why business don't give food to the employees or give food away is because of 2 reasons.
      1) The one obvious reason is that workers will intentionally find ways to create more waste so they can take home free. Which hurts the business. Its not seriously big issue until you get those few that abuse it and ruin it for everyone else.
      2) People by and large are selfish and horrible creatures. I've heard of stories from a few business I've worked for where they used to donate food or give food away that was going to be thrown away. The food would go to workers just about to go home from work, homeless people, or whoever. Person lies about getting sick or does get sick, then they sue.
      People want to know why business', governmental programs, food banks, and all of these other types of things aren't more generious or why we don't have "common sense" type laws and helping more people. Number 1 answer, people are aholes. While you might be truly wanting to help, there are lots of people ready and waiting to take advantage of that. Its a sad truth of reality.

      Its a product that they already paid for. Its theirs. They also pay for trash removal. They could use it for toilet paper (if possible) and the government should have no say in it.
      You should have to donate all of your leftovers to charity. All of them. Even a half of a chicken wing if you cant finish it.
      This stupid socialist crap is why Cali sucks and people and businesses are leaving.

    The problem in the past has been if someone gets sick because of discarded food that company can be held liable for damages. There has to be a release of liability form that a company can sign to release them from legal responsibility. Very simple.

      That is NOT the problem. Trust me, it isn't; it's a cheap and easy excuse, though. But any way you slice it (lol), if you're hungry, you'd prefer to eat stale or "older" food rather than nothing. Otherwise, your health will decline far worse than what most semi-older food could do to you. The only way a person would perish from "expired" food would be from some seriously poor luck and poor judgement (such as drinking milk that is clumpy and stinks to high heaven). And if there's some hidden, undetectable pathogen... well, your number was up anyhow.

      That still is very much a problem, the food needs to go to food distributors who are trained to check and redistribute the food and you are covered legally (as long as you don't purposefully give food that can make someone sick). This law changes none of that, all it does it make so those businesses need to get into contact with said food distributors to have them get first dibs on food before it's tossed. And as mentioned food on a buffet still gets tossed, but the uncooked chicken that was in the fridge all night in case it was needed can. But you still get no protection giving food directly to those who need it, it has to be through a food bank or something like that.

      @@Novastar.SaberCombat Trust me on this one, Nova, this IS the main problem. A person who is starving and gets food poisoning from free food can successfully sue the donor and that hungry person might OWN the company that donated that food, unless there is some way to free them of liability.

    Actually, grocery stores used to donate all their salvaged food to shelters until around the mid 1980s, they had to stop become too many " hungry" people would sue if the food wasnt perfect. Lets see how this plays out.

Plus, if you know anything about certain types of lawyers, you'd understand that one doesn't necessarily need money to bring forth a lawsuit, if the lawyer thinks they can win that's all it takes.     i knew someone who used to work for the warehouses that pack the sandwich's for circle k and the amount of food they throw out is actually crazy. My friend would put all the food into a bag and leave it in the area the cameras couldnt see for the homeless to get a few meals daily. Nothing was wrong with the food they just always had too much and threw out the excess .

      I noticed working at Circle K that we were ordering too much sandwiches and putting too many hotdogs on the grill and throwing away the leftovers, I tried suggesting to cut down on quantities but was told by management they purposely put too much food on display because it looks better when there is an abundance of food, nobody likes to be the person taking the last sandwich / hotdog :/

    I once walked by a dumpster behind Sprouts only to find it filled with fresh edible, packaged produce and several fresh bouquets of flowers. I took the flowers and gave them away for free on a neighborhood Facebook page. I was dismayed at the amount of edible, good food that was piled in that trash can.

    Finally. France did this and give a slight tax write off for it.
    Also for everyone saying businesses get sued over it, look into the Good Samaritan food donation act. There’s protections already in place since the mid 90s.

      It's a tax write off in the US as well to donate anything to a charity, but a lot of companies still won't and it's not completely due to the risk of them getting sued either. Retailers will throw out anything, cloths, shoes, handbags, toys, etc. even though they are usable. Some will even have the employees destroy the items before placing them in the trash, like cutting holes in cloths or cutting cords on electronics.

They need to pass a law that good faith donors can request a lawsuit get reviewed by an independent group that immediately throws out any cases that don’t involve deliberate donation of bad food, like stuff that’s visibly rotten right from the source or has been contaminated (like with soap) by some jerk who hates homeless people. As long as businesses and other donors still have to waste time and money defending against frivolous lawsuits with no merit, they’re still deterred from donating.

    Another way to help hungry people is to support Meals On Wheels. They feed older , hungry, shut- in people who have trouble getting out or are homebound. Many of them cannot afford enough food! Try living on "social security. " Don't deny people this food.
    Donation of money or volunteer time to MOW is worthwhile and directly saves people.

      My wife and I live on social security, own our own home, drive 2 20 year old cars, eat out ocassionally, buy whatever food we like, and put money in the bank every month. It is how you live and spend your money that makes all the difference. Living alone is untenable in today's enviroment. Two social security checks makes all the difference in the world compared to one. Two people living in the same home hardly increases the expenses at all, but doubling the income makes all the difference.

    I am a sous chef in a restaurant. While I understand the idea of doing this, one problem is liability. For example, if we were to donate our leftovers we would lose our liability insurance if they found out we did that. ALL insurance companies have this policy with regards to restaurant liability. Also, in my state, the person who prepares the food can be prosecuted if someone gets sick or dies as a result of mishandling. Once the food leaves the restaurant it is out of our control but that does not reduce our liability civil or criminal. No I am not talking about orders to go. I am talking about if we cook 100 meat patties then donate them to a charity and they mishandle those meat patties and someone get sick WE can still be prosecuted and sued over it.
    Also, as a point of science, food that is composted does NOT create more methane gas than food that is digested. So donating food to be eaten will NOT reduce methane emissions. Doing so will merely change where the methane comes from.

      Just because there’s the Good Samaritan act doesn’t mean you won’t be sued, and even if the case gets thrown out by a judge you will still have spent money on a lawyer, it’s a lose lose situation made even worse by the Democrat party and its feel good ideas.

      Actually it may cut down on the cost of trash pickup because they will have less trash thrown away. Goodwill has a huge trash bill because so many people donate actual trash

      Most commercial properties use private garbage collection, usually that large metal bin behind the business that is collected at 4 am and wakes up the neighborhood, the contract for collecting garbage doesn’t matter how full the bin is, half full empty or full it is the same price, but you can schedule daily, every other day or weekly depending on how fast it takes to fill it. Mine is collected daily regardless of how much trash is in it

    There are recovery business that process expired food into animal feed. It doesn't just end up in a landfill. My uncle bought two truckloads of expired cereal when i was a kid and we fed it to his hogs. I spent days opening boxes and dumping it out. But it was cool because I got all the toy prizes inside. It was fun.

    I met a homeless guy I was locked up with, said he would literally wait for a family with kids, wait for them to finish eating at McDonalds, and he would say 9 times out of ten there was plenty of uneaten food just waiting in a bag for him. Saddest shit I ever heard.

      @@kurtrussell5228 That is just open ended though, I have tried to get my ID the same way a homeless person would and it is a pain in the ass to get everything together to get any type of government assistance, a lot of work for someone that doesn't have a car. I've also been to homeless shelters, I would rather be on the street than some of these I have seen. With the cost of housing and job instability that 9 out of 10 is becoming a lot more people that put themselves in that position by trying to live a normal life and one bill away they get on the street.

    This should have been done ages ago, still see 55 gallon bags FILLED with bread & bagels just sitting beside the dumpster from Panera. There needs to be more coordination with these groups to ensure this waste doesn't happen anymore. People are steuggling to be fed out there!

      panera donates unused bread and pastries but when someone doesnt come pick it up they sometimes give it to employees (depends on closing manager) or they throw it out.
      I used to work at panera and theyre one of the better restaurants that actually donate BUT sometimes they dont get to donate and i think thats when they should allow employees to take the food in my opinion. it always depended on the manager and probably against their policies

I get it, there's food safety and all of that, but why do Good Samaritan laws for food distribution only protect you if you give food to "licensed food distribution groups". Those bagels the OP mentioned absolutely could be given to any family down on their luck or something, but the store could get sued if anyone gets sick as a result, so they have to give the food to a food bank, then the food bank needs to give it to the families, and by then something like pastries/bread products are more suitable for building material than consumption.
      This bill as nice as it is, still changes none of that. That stadium can not give hot dogs to the homeless after the game or anything like that, it has to all go to food distributors, this only makes it a requirement that they have to give food to food banks instead of throwing it out.

      Here's a different scenario but the same idea. We used to donate The ripped bags of dog and cat food that came into our store to the local shelters and then out of the blue corporate said you must throw it all out and never donated it again which I thought was quite silly.

    even when I was a kid and got thrown out of the house as a 17 year old as a kid because of abusive parents I was lucky that donut shops and other places in town donated their leftovers for the group home I was in until I finished my high school a nd was able to get my own place. I was so grateful for that food because many times I had to go without food before that.

    As a teen, my husband worked for a restaurant. There was always food leftover. One night, he and a co-worker decided to take some dinner rolls and donate them to a shelter. Dinner rolls that had never touched a customer's plate. The shelter refused them. Told hubby that he could go to the store and BYE some and bring them, packaged, to donate. Hubby didn't.

      @@redfoe77 This law does not. This just requires restaurants get in contact with food distributors to collects what they would normally throw away (and a few other things). The protection they have is part of the Good Samaritan act for food donations which is an existing law already, however that only gives you protection if you give the food to organizations that are trained to sort and distribute food (checking for freshness), it does not protect you if you give the food directly to people which is why the above comment about the Tony Romas restaurant and food banks won't take a bunch of meat that was sitting in a smoker that never got sold so it will still get thrown away.

    Stores should have been doing this the whole time. It's miserly to just throw things away just because they couldn't sell products unless the food was about to rot. A lot of things can still be consumed past the expiration date.

      It’s because of the risk of being sued. Even though there’s a federal law releasing donors from liability for good faith food donations, people can still sue, and the donor has to defend it at great cost, even if the case is tossed. They need to update the law to immediately toss such cases before the donor has to pay anything.

    Meanwhile here in Texas we don't require such laws. A friend of mine is a member of a group of people who own BBQ catering trailers and they all cater to events at least part time. Any food they have left over is donated to various charities. My friend mostly donates his food to a local women's shelter in his neighborhood. Others donate to feed the elderly and home bound people. We have local grocery stores that donate to food banks and some of the road side produce stands donate as well.

      I worked doing deliveries for NYC metro grocery chain, and every delivery also had pickups for donation. Anything they couldn’t sell but was still good, went back to the warehouse, and was then shipped off to food banks. It’s insane a law had to be passed requiring this.

    In Chicago, a company filming food commercials (for restaurants, groceries etc) took the food used in the commercials and was donating to the homeless. Then someone sued them, saying they got sick. After that they just threw the food out.

    If you look at it closely, it is not that Fast Food restaurants and grocery throws away the food. After the day, they put it outside so homeless can take it if they like. If they give it to them, they can be sued especially if they are encouraged by their advocates even if their stomach ache was not due to the food given to them.

    I worked in a school cafeteria in New York. At the end of the day EVERYTHING was thrown away. It made me sick. My sister works in a different school in New York and talks about how staff will buy food for kids because they know these kids don't have food at home.

    I have a relative who works at a mortuary. Many funeral/memorial events have huge amounts of food left over -- such as buffet-style sandwiches. On the way out the grieving families often say "you can have this food". My relative quickly wraps up all the still-fresh sandwiches and heads over to the homeless areas to distribute meals. However, I think this law is most useful for packaged food that hasn't been sold, but is dented or whatever. It's much harder to redistribute food that's been opened or sitting out.

    And as far as the feeding Corporation, I used to work at local food banks and I can tell you first hand that from the moment they stuck their finger in the business our ability to hand out food got worse and our dumpsters were always much more full. . The one thing I always promoted was volunteering . This would have been the biggest obstacle to getting food from the rescue Warehouse out to the greater public.

      At our food bank we freeze milk and give it out past the expiration date. It's really shown me how our shopping habits (taking a later date off the shelf) allow for those to have food at food banks. It's difficult to say other than we use judgement and inspect items that come in before handing them out. We're the last to inspect food that goes in their bag, so I'd probably say the food banks. But people should also use their discretion. Although, if people were desperate on the streets they would probably be shifting through a dumpster for this food. Who knows. . .

      California’s MAIN reason for doing this is because of methane gas, created in landfills from rotted food.
      If not for that environmental concern, the waste would continue to go to landfills.
      Instead, there is a bit of a “perk” from all this. That same wasted food, that once ended up rotting away in a landfill, is going to feed the hungry.
      I’m just saying California’s government is selfish, and their hidden agendas are not necessarily going to do what is best for their people.

    You want the truck driver to deliver it for free after they reject it and not get paid and pay for it .work for big companies that want you to take it there after a rejection of the product and drive across town or city to some small place and not get paid a cent and no load if you refuse. That’s why dumpsters at truck stops are full . The business don’t want it and aren’t buying it . The driver is a lease driver he has no where to put it except trash .

      Actually, there are laws REQUIRING fruit to be thrown away if it's not pretty enough, or if it's not of mandated minimum size. I dated a girl whose family farms strawberries, and they've had years where over half the crop went to jam and preserves because of state requirements.
      Since then, I buy from local farmers when available.

    Donating food is always a bad idea. I stopped volunteering at a food bank for this reason. People get angry when they don't pay for food and often retaliate against you. No good deed goes unpunished.

    ...sounds like a good way to increase the cost to companies for additional distribution. Generally throwing the food away in the trash is a lot quicker and sending it to the landfill just requires a little bit larger trash capacity which generally isn't an issue. Saving/donating food requires people at the end of the shift to do all the necessary preparations to get the food in appropriate storage containers at the appropriate temperatures in an appropriate location, and then they have to be shipped in specialized trucks to go to a particular area who then check the food, and then a good amount of that food gets thrown away...

    I watched a Sam’s Club worker throw out about 10 whole cooked chickens in the trash can. So I asked why. He said that they could not sell them because they expired time stamp after cooking. I had just put on in my cart, before he started throwing them in the trash can. I handed it back and told him that he missed one. He said no he didn’t. It was in my basket. So my next question was, if those are bad how is mine not with the same time stamp? He simply walked away.
    Later I told a friend. When there is nothing left to eat, you can find me at Sam’s dumpster, eating hot chicken. 🤤

    While its a good thought, the State didn't pay for these items, they don't belong to California. This is an illegal seizure. If the state wants these items donated then they need to pay someone to organize, collect and distribute them at no expense to the retailers.       In the grand scheme of things this costs the orgs with excess food nothing. I could see it being difficult to keep food that needs freezer and fridge on hand until the food bank trucks arrive though

    I read a report that 45% of food in this country gets tossed or wasted . Insane and whats even more sad is how much energy is wasted to grow and transport all that wasted food , fuel , water , man power etc etc etc .....all wasted for nothing

    Equivalent to having resturant police to make sure everyone eats their food, because someone else might be hungry. Owners should be able to do as they please with their food. Free market works well.

      The CEO of Feeding San Diego, one of the beneficiaries of this law is paid $260,000 per year. That is a heck of a non profit.

    I certainly hope this organization prioritizes veterans and citizens over illegal migrants - seems to me the California government made this mandatory to help pay for the illegal migrant expenses. I also hope these businesses are able to write off the donations on their federal and state taxes. Otherwise, it’s nothing more than a government edict being fulfilled at the business’ expense.

    When I did field duty in the Army, I asked why we were throwing out food that could feed people. My Captain said because someone might get sick. I pointed out that it was the same food the troops were being served. He had no comeback for that.

    I think it’s a good idea. I do not think however that the state has any authority in this matter. In fact, I know they don’t because they are not granted that authority.

      Technically, we allow them to have that authority. It's the catch-22 to the state vs federal argument...give the state enough power, they make strange, barely enforceable laws...for better or worse

    I saw a woman collecting 100s of packs of tortillas from the grocery store. I asked she said new law they can’t throw it out.

    Horrible law. The unintentional consequences are going to be huge. Prices on food are going to spike for everyone and cause more hunger.

      People are getting told B.S.
      Since 1990 food prices went up 3.67x in California. Minimum wage has gone up 3,76x in the same time period.
      Yet people don't talk about that second part.
      Food is actually cheaper than it was when I was a kid where I live.
      The entitled youth just cherry pick facts and only base food prices off the all time historic lows.
      That extra food is due to over production and when over production ends due to this stupid law the cost of food is going to skyrocket compared to wage inflation, causing more hunger.
      Almost everybody in the comments don't understand economics at all.

    The food is out dated so it’s a health risk that’s why it goes it goes in the garbage dump. What’s going to happen to the stores if homeless people start getting sick from that food ??????????????

      Everyone is one debilitated illness or injury away from being disabled. How would you support yourself & have enough to live? Many disabled people go hungry because SSDI & SSI don't pay enough to live.

    Dunkin Donuts is a big culprit in this. I asked why they throw out food instead of giving it to the homeless, I was told because of liability.
