It is NOT illegal to fly a drone over someone's. The air space is controlled by the FAA and unless you are near an airport, in controlled airspace, you can fly, including over houses. Yes it is creepy to be hovering over someone's house. That can be classified as being a Peeping Tom. Shooting down any drone is a felony. The person that shoots down a drone, even a toy drone can be in prisoned to up to 10 years and be given a $75,000 fine.

If you can see something from a public location, uncontrolled airspace is a public place, then you can also take pictures from that public place/location. That is why Airplanes and helicopters are legally allowed to fly over people's homes. Helicopters even hover over people's homes. Now, if the drone pilot brings the drone down into your yard that is different. You could argue invasion of privacy because it is now within your home's cartilage. You need to review the laws on air space above and around your home. Also the laws on public photography. If I am standing on the public sidewalk and you have your curtains or blinds open and I can see in your house. I can take pictures and it's 100% legal. At the same time if your curtains or blinds are open and you are in front of one of those windows nude, you are the one breaking the law. It is called Public indecency because the public can see you from a PUBLIC location, the sidewalk or street. You just need to brush up on the laws.

I think it's giving that defendant a thrill to see what the plaintiff and the plaintiff’s girlfriend are doing something that no one else is supposed to see, especially in their backyard. It’s hard to be a good person and look out for your neighbors as well but there are many ways to look out for the neighbors. The police officers also have helicopters to checkout the neighborhood from above, and they do have cameras to check everywhere in that matter. What happens when the neighbors are holding hostage in their own home and they are the ones who are complaining that someone is peeping into their home not knowing it will save their life when it chips are down. The police are minutes away from the house but if someone checks on you for a safety reason. It only makes them look like they care about you. But I understand about privacy rights and needs to be respected but safety comes first right.

Heard recently laws haven’t kept up with drones. If you destroy one you have committed a felony (Interfering with an aircraft) and can face serious fines and jail time. Doesn’t matter about invasion of privacy as much as it should be changed to reflect it.
