Talking strictly about commun sense, why wouldn't a 14 year old have s3x with his 16 year old boyfriend?! The suposed age gap was on porpuse because everybody knows how boys tend to be more immature than girls! If they love each other and no one is forcing the other person, why not? I think it's early because they might not be ready for that but to think that they are "children" and that they don't think about "those things" it's extremely naive! Better to do it within a relationship than to get drunk and do it with a random person and get pregnant or get AIDS, Hepatitis, gonorrhea, sifilis, etc.

People under 18 can't drink alcohol. It was under 16 until some years ago (probably 20 years?), and it's illegal to sell alcohol to people visibily drunk, to someone that apears to have some mental desorder or some intellectual handicap.
It's legal to change s3x but people need to go through psychotherapy for quite sometime to find if they don't have some issues (like trauma or some mental disorders) and even after that, they need to stay in psychotherapy for I think it's 3 years, regardless of their age, to guarantee that it's what they really want.

Let me rephrase the Drug subject a bit better: Portugal changed the view of Drug Consumption from being a Crime to be a Social Health Problem
There's a few misconceptions, the age of consent although technically correct, being 14 and 15 in most contries of EU, Portugal's law states clearly "there can be no abuse of inexperience", this leaves room for interpretation. Trust me , don't come to Portugal thinking this is a sex tourism paradise, get involved with a 14 year old as an adult, only pursuing sexual gratification, and you'll get a few years behind bars. But France for example, has the age of consent at 15 without restrictions. So, don't think Portugal is like that, you try to only have sexual relationships with a 14 year old here, you will most likely get arrested for abusing his/her inexperience. Even if you date (no abuse of inexperience) its obviously highly frowned upon.
For context, here is the law that states the age of consent (Use google translator at your own risk):

There are exceptions, for example if the ADULT is a legal guardian, tutor, teacher, (anyone who has clear hierarchical power) then THE LEGAL AGE of the counterpart IS 18!
Edit: If people want confirmation that a 38 year old can date a 16 year old, just search on google for the legal court decision document "RP20200422573/18.1JAAVR.P1" and the case absolves the accused of child po.... because the photos shared of her naked were in the context of a romantic relationship.
On another case, "1779/13.5JAPRT.P1", a young man of 22/23, admits to having two relationships with two different girls of 14, without it being considered a crime, as it was in the context of a "gratifying emotional relationship" .
Also, the drugs laws was almost correct, you can't carry 10 individual doses of any drug, you can carry a limit corresponding to 10 days of consumption, there's a table, its for example 2.5g of thc (usually corresponding to 25g of cannabis at 10% of THC , usually) , 1g of coke, 1g of MDMA, 1 tab of LSD, etc.) . If you respect these limits, you're off the hook with at most a fine of 150€ . But you can carry any amount as long as you can prove is for auto-consumption but this is more difficult and bureaucratic and time consuming (This law is pretty new, November of 2023). So yes, you can carry any amount now, as long as you can prove it is for auto-consumption for 10 days . Good luck trying that if caught with 100g of coke or weed.

This means anyone over 18 can have sexual relationships with a 14 year old (Except tutors, legal guardians or anyone with ascending power), BUT CANNOT abuse his/her's inexperience. So, its not illegal unless the adult abuses the inexperience, which is almost always the case.
You are so wrong that this not even apply if one got 17 and the other is 14, its not a crime AT ALL in this situation, no matter if there's proven abuse of inexperience.

In Portugal there's a lot of girls with as relationship with men over 18 years old. I personally know a girl which star a relationship at 12 and got pregnant at 14. The man was over 40. He never went to prison. In respect portuguese journal there was an article that 19 girls get pregnant at the age of 14 years old.

We won the war on drugs more than twenty years ago and that was wonderful, but I think we are currently starting to lose. Lately we have seen some consumption on the streets that we didn't see 5 years ago, I don't know if it was because of the pandemic, but it is getting worrying.

You are almost right; relative to drugs, if you have hard drugs you won't get arrested but you are send to a detox program.
Which is the proper response. Drug use and addiction are medical, not criminal probems. Treating them as such is much more effect that throwing people in jail. It is also less expensive.
As a portuguese person, I never saw any cop care about someone drinking in public here. Or looking extremely drunk. Its one of those laws that probably are there but are never enforced. People just laugh at the sight of a funny drunken fella, even cops
In the heavy drunken state, you can get a fine. Usually its not a problem, but if cop doesn't like you and you're way too drunk, you can and will get fined. Im also portuguese and while it hasn't happened to me, it happened several times to some friends (while i was around)

Wild camping is not allowed in Portugal… don’t confuse between wild camping and parking RV’s. You can park an RV in any street and sleep inside as you can in any other vehicle but you can’t use any more public space other than the RV itself. So you can’t put chairs, tables barbecues etc outside your RV. You can only do that in camping parks… also you can’t use camping tents…

Our law about RVs is completely stupid.
You cannot park and sleep inside a RV in any Natura 2000 areas from 10pm to 7am. But if it's not a RV or similar then there's no problem.
More, in Natura 2000 parking lots it's almost impossible to park a RV even if you just want to go to a restaurant or take a walk. Those parking lots have forbidding signs exclusively for RVs. But you can park a semi trailer if you want.

@@joaochainhonunes you should read the natural parks law before you comment. The forbidden parking are not just for RV but for many other vehicles. The only difference for the RV is that for the rv is also in the driving code but if you check the natural parking rules you will find that is forbidden for many other vehicles…
Regarding the being drunk on the street situation, I must say, I highly doubt you get in trouble for doing that, since I was a kid I always saw that kind of stuff and never heard of anyone having problems with the law because of that. Note: I am from a small/interior city, that may affect my experience
Basically this law is for police to have something to pick up if you are drunk and you mess up and get violent. Before, hooligans were coming getting drunk and break everithing and police couldn’t do more than free them after.

You're right. Not only in small towns, but in the big cities too. Unless the drunk guy is causing a scene, or disturbing other people, or being a nuissance of some kind, nobody cares. The authorities won't do anything if you are just being a happy drunkard. As it should be, in my opinion. If you are not disturbing and not harming anyone, I don't see why the police should intervene.
Like other laws, as throwing garbage or cigarrette buts to the ground, spit on the street, cross a road not on a crosswalk or at a red signal... All that is not allowed and we see people doing it every day. As well as leaving your dog's poop on the street!!!! This one is very anoying.
Yeah I was going to say, as someone who grew up on bigger cities: you wont be having any trouble for being drunk on the street as long as you arent doing anything else that is a crime. If you dont damage property or be too loud then the police arent going to bother you at all and you could be literally stumbling down the street in from of them 😂

The only law that I'm not comfortable with, is the age consent! Everything else is fair game in this day and age.

The age of consent is 14, but it is not as straightforward as it was explained. It depends on the parents to have a word as well, and the age difference can't be bigger than 3 years if you have a girlfriend till you are 18, etc. so basically, if you are 21 you can't have a girlfriend with 17 in theory of you are having sexual relations.
Regarding the "14 is the age of consent", it's must be said there is an important caveat: the age of the other person.
14 is only the age of consent if the other person is underage (i.e. 17 or younger). So, a 14 year old may consent into sex with someone under 18. But if the other person is legally an adult (i.e. 18 or older), then being 16 is required for the consent to be admissible. It's still lower then 18, but it's not as low as 14.

The statute you just quotes says, *in line with what I said,* that an adult (i.e. 18 or older) having sex with someone between 14 and 16 is punishable with up to 2 years of prison - which means the adult *cannot invoke* the fact that the minor gave his/he *consent.* Which means the age of consent is not 14 if the other person is an adult. Menor de 14 anos (13 , por exemplo) e até os pais responderiam por crime pelo facto de albergarem o jovem e tere conhecimento da situação sem o evitar, já que seria um crime público.
Como é bastante óbvio, se constituisse crime teria de vir mais abaixo averbado na lista de condenações prévias, o que não acontece. E que obviamente vai de encontro ao que a lei descreve.

It's like in Canada, it used to be 14 and they changed it to 16 in 2008 but with conditions, basically the same as in Portugal, depends on the age of both parties involved and circumstances
And one more thing you didn't say and I believe it's at least curious : The maximum prison sentence is 25 years and with good behavior it can be reduced by half...

The age of consent grants adolescents the opportunity to take decisions concerning their body, their health and their beliefs. It is specially important from a medical point of view. For example, in cases where the parents might oppose a life-saving treatment because it is against their religious beliefs. If the person is 14 or older they are legally entitled to decide for themselves in this situation.

Slight correction about drinking in public: IIRC, you can drink anywhere you want, but consumption is curtailed at the supply level, much like in other countries in Europe; at least here in Lisbon, commercial establishments face a series of restrictions related to sale of drinks, especially in glass containers, for hygiene and safety reasons, but if you bring your own with you and don’t create a mess, you should be fine (you might, however, inadvertently cause trouble to the nearby establishments by raising suspicions they’re selling past the legal time, so doing it as far away as possible from those is advisable).
Excellent video! Very useful for most of us who made Portugal our home. I was shocked by the age of consent part but it is not exactly like that. I don't think a boy or girl aged 14 know what they are doing. We were wild camping in Alentejo and the police came and told us we couldn't stay... Then one of the ladies told them we were only there for a few hours and we would all sleep inside our cars (Not RVs and she had a large van). Coolio, they said and left. They did warn some other guys who were there and they had to remove their tents. I don't understand the law, perhaps it is just so people don't make it permanent?

Even if for entertaining purposes only, I think talking about the law should take a bit more care than a simple google search.
Age of consent in Portugal is indeed 14, but someone of legal age (18 or older) can commit a crime if having relevant sexual acts with a minor under 16. No legal problem with a 17 yo having relevant sexual acts with a 14 yo tough.
The consumption of drugs is still prohibited... although it's not a crime it's still a "contra ordenação" (administrative offense) - just like driving over the speed limits, for instance.

I have two friends who are now married for almost twenty years, and he was 24 when starting dating the girl which became his wife. She was 14 at the time and he was 24. Contrary to moral doomdsday predictions nothing bad ever happened and they remain a great couple to this day here in Portugal.

There's a caveat there, 14 to 16 there are specific conditions for that consent, regarding age differences and forced influence. Either way should definitely be higher.

It's like in Canada, it used to be 14 and they changed it to 16 in 2008 but with conditions, basically the same as in Portugal, depends on the age of both parties involved

Not that I would go to Lisbon nightlife, but the restrictions they are trying to implement are on alcohol sales past a certain time past 23h because of noise complaints.....little kids and tourists can't drink, get hammered and go home without causing issues or "accidents". Regarding drinking, if somebody has an accident provocad by someoneelse but had alcohol in the blood, even not gilty, is considered the responsible for the accident.
Sorry to step in, but that is not the case. The guilty party is whom ever made the action that produced tha accident. The police can and should fine the drunk, or arrest him but that's it.

Portuguese person here, weed lover as well. It's not considered a first degree crime to hold weed ( or hash ) but it is considered 2nd degree crime, and you will be submitted to a fine and psychological treatment from professionals. This is on legal terms.
In illegal terms, as a holder I must advise to always fear the police for they will fuck you even if you have a miserable amount.

Just adding a bit of context/nuance regarding the drug thing, there is a very blur line regarding this and how was described on the video is half-right. To clarify, the act of selling, TRANSPORTING is still A CRIME, no if you've "10 doses of X drug" on you, no you will get it confiscate and pay a fine bare minimum so THIS IS VERY IMPORTANT to be known since people think "you can have with you to consume" so yeah if its mine i'm fine.... Age of consent is different in each state, currently 16 in most, not to long ago it was lower n some of those southern states. Also don't forget the southern states have now lowered the age of consent for employment to 14 in slaughter houses, fast food joints, and demolition crews. Dont be surprised if all consent laws are lowered. The difference I see here verses there (and I've lived here almost five years) is maturity.

Regarding age of consent, as far as I know, it's not a blank slate post 14, I think there can only be up to a 4 year gap between them until the person reaches 18. And if it's found that the "inexperience" of the person was exploited by the adult, the adult can get jailed.
The reason the law has been kept, is due to protests from the Romani communities that still have arranged marriages, and it was impossible at the time for the justice system to enforce the law if it was changed, due to them still being nomadic and the number of guns they possess.

If there's a diferente of up to 4 years minus one day and the older party is 17, there's no law applied, no matter if there was abuse of inexperience. The law applies only if the adolescent is 14 at minimum and the older party is an adult, no matter the age.
