According to the CA Secretary of State...you can NOT simply fix or redo a notarial certificate. You MUST meet with signer again, have them sign in front of you and put the NEW date on the cert. Backdating a notarial cert is illegal. Please clarify and refer to where in SOS handbook it says what you are suggesting is acceptable. Thank you.
Hello. Your Errors 101 training video was made in April of 2021, but I would like to request a copy of the Acknowledgement(s) for all 50 states as discussed in said video. I would also like to inquire if I could obtain a copy of Coast 2 Coasts 20 page signing instructions discussed to increase my understand and knowledge base of how to best work with Coast 2 Coast should the need arise. I am a new notary, but as a real estate broker, not new the closings. Thank you ahead of time for your time and assistance. Stephanie Gavric (located in Central Florida)
The State of California Notary Handbook does outline that if there is a notary error on a certificate, the remedy is to bring that document back to the signer and re-execute it. Not every state has this ordinance, however keeping in mind that the original document with the error can also go back to the notary signing agent to fix the error, example: a seal is too light or a name was misspelled. Since being a loan signing agent and being a notary public are not the same thing, keep in mind that delays due to notary errors can cost rate locks and delays. In all cases escrow agents are asking for all purpose acknowledge to fix the errors due to time restraints of closing the the loan. We understand how every signing agent has to run their business in a way that fits how you want to do business. If the document in question is a recordable document then re-executing the document would also start the RTC over again. So please make sure your certificates are accurate to avoid this sensitive situation. We can also expand on this on this weeks class 4/30/2021
The new loan application had me crazy the first time. I think we should have been notified of the change. LOL But now I am use to it. Thank you for the training
That is up to you, since you already recorded the entry in your journal, you do not need to add this item. However, if you want to keep good notes, you may choose to do so.
This is not straight wording, our special instructions include the right to cancel for the year which is 13 pages, as well as sample of loan docs that often have errors. The total of actual reading is about 1 page.
Great info! Thank you. I had a question regarding E&O Agreement (for CA) since the Acknowledgement is going to be signed and stamped by the notary do you also sign and stamp the E & O Agreement ? I know we are not supposed to staple docs, so how does the lender know that this acknowledgment is pertaining to this particular form?
So if you add a loose notarization to any form, I would add the title of the form it belongs to on loose certificate. That way the client will know what form it is to be attached to if the forms get out of order. Never staple or paperclip, escrow hates having to take the time to remove them.

Hello the lender will provide a label for corrections but usually at a cost to us. You do not need to sign up directly with us, if you are on snapdocs, all signing services will be able to work with you.

Hello, Lender's and Escrow generally do not want them staples on any of the documents, some do not like paper clips either, but they are better than staples. Usually if you prep your docs in order before you ship they stay in order by escrow.

In California at 16:20 for the Jurat do we put the signer under oath before we fill it out during the loan signing process?
You can give the signer the oath during the loan signing before you fill in the form.

If there are 2 signers, do they both sign my journal? Do I do one box line or 2?
If you have two signer you are notarizing they both should have their own line item in your journal.
