Unless martial law is declared, which it hasn’t been, soldiers serving a policing function (including the national guard) are required to abide by police rules… which means the 4th amendment applies to these searches as well.

The way MTA is set up, there is a sound argument as to why the searches are not unconstitutional. The subway system is a pay-to-use service, they can search you as a condition of entry; it would be no different than getting searched before going into a concert or professional sporting event.
Except for the part where private property owners have the right to dictate the terms of entry but the state has no authority to deprive people of their right to be armed.

They have indeed allowed for "sensitive places" but they have rejected the notion that the city can simply declare all public spaces "sensitive" by default. Reasonable examples of a legitimate "sensitive place" would include a courtroom, jail, or mental ward. I submit that transit hubs and public parks are not appropriate places to ban the carry of arms and any place that is off limits for carry should be required to have positive entry control, 100% screening, and armed guards.

Some people are saying it's not a violation of the 4A because you can choose not to go on the subway. A critical piece of public utility is being held hostage under the pretense you give up a right. That alone is deprivation of rights. A simile to this is if the police would not give you a lawyer until you talked to them alone for 30 minutes uninterrupted. Rights cannot be conditional, and cannot be held hostage for other uses of daily life. That breaks the entire point of it being a right.
