Police are not required to advise you of you rMiranda Rights (protection against self-incrimination) as they perform an arrest because the arrest in and of itself, does not incriminate a person. However, police are trained to provide the warning as soon as possible, AFTER an arrest, to ensure any potentially incriminating statement the individuals makes while in custody, is admissible in court. It should be noted that there are also instances when police can question you without having to advise you of your rights. Eg.: asking routine booking questions (name, DOB, height, weight, etc.), under cover police officer asking drug dealer questions while he/she buys drugs from him/her, and exigent circumstances (I just arrested a suspected bomber and I am asking him/her to tell me where the other bombs are).
