The Judge says the ticket/citation is a summons & complaint ? Is It Really… Nope, anybody can beat these unlawful, unconstitutional tickets!!! 1) Probable Cause ; The police officer must have articulable probable cause before detaining of anyone !!! Understanding of probable cause: The police officer must have and be able to articulate probable cause that, A) You have harmed/damaged a person or property. B) The police officer has a witness, of you committing a crime. C) The police officer witnessed you committing or about to commit a crime. D) Has a warrant for your arrest. Without probable cause before the stop, the ticket/citation is unconstitutional. 2) Proper Complaint ; For a proper complaint. The injured party (plaintiff ) (he/she) (living soul) must have created and signed an affidavit, aka (sworn complaint) that has a judicial (branch) officer signature with a embroidered seal (stamp) (notarized). Where is the plaintiff and judicial officers signature and stamp? Not on the ticket! 3) Charging instrument ; The sworn complaint becomes the charging instrument when submitted into the court of record by the plaintiff (living soul) or by a representative (prosecutor) with a court received stamp “Filed“ with case #. If there is no charging instrument submitted by the plaintiff (living soul) then there can be no summons issued and there is no case for the courts to be tried. No stamp “Filed” on the ticket! 4) Proper Summons ; The ticket/citation is not a proper summons. The summons is a separate document from the complaint and also there is no hand written signature of a dually appointed judicial officer, aka (judge) or (head court clerk) of that court. 5) Separation of Powers Act ; When the issuing (ticketing) police officer gives you a ticket/citation and shows (tells) you the date too appear in court by his/her own accord, the police officer is in violation of the separation of powers act. The police officer power is from the executive branch, the officer has no judicial powers to create the instrument for a court date & summons for anyone to come into court, only the government judicial branch officer aka Judge or head court clerk of that court can set the time/date and create the instrument (summons), thus ticket/citation is unconstitutional and null & void. 6) Damaged Party ; Who is the damaged party (a living soul)? The plaintiff being the (state of) or (city of) or (county of) is not a living soul. Must be a living flesh/blood soul. 7) Legal Right ; A ticket/citation does not indicate, a violation of a legal right. 8) The police officer is committing perjury ; When the police officer sworn on the ticket and or (incident report), and or in court that you committed a crime/felony and or violation against a fictional plaintiff that is NOT a living flesh/blood soul. a) Violation = Injury, Infringement, Breach of right, Duty, and or Law (Blacks law). b) Crime = A crime is damage to person or property or police witnessed a felony. “Sherar v. Cullen 481 F 945 (1973) ” c) A “Code’ or Statute’ is not a Law,” “(Flournoy v. First Nat. Everything in my post of fraudulent tickets comes from the Constitution (Supreme Law of the Land), Bill of Rights, Supreme Court Rulings (case law) and courts Civil & Criminal Procedures....... Their laws & rules in there books for all to read. Most people do not understand that statues and codes are not law and does that law even apply to you in the first place. If you are using the public roads for profit (commerce) then all laws, statues, codes apply, because its a privilege, however if you are not and are using the roads as one of the "We the People" as a matter of right in your private capacity, not for profit then their is a big difference in what laws apply to you. If you are in private capacity using the public roads as a matter of right the police must have probable cause before stopping you even if your speeding.
@@Mistilou, If it's help with a traffic violation, then he can not help you, because he is one that has Federal and States rights mixed up. Every State has the right to put in place their own local laws that are to protect all citizens. In other words, If you are speeding or breaking some other traffic laws, then you are endangering the safety and well being of every citizen around you. I think the fines are way out of control, but exactly how much are you and or your child's life worth?
