.குடியுரிமைச் சட்டத்தின் 18-வது பிரிவின் (1) மற்றும் (3) துணைப் பிரிவுகளின் கீழ் வடிவமைக்கப்பட்டுள்ள NPR குறித்த விதிகள் மிகவும் விசித்திரமானது. குடியுரிமைச் சட்டத்தை நிறைவேற்றுவதற்கான விதிகளை உருவாக்கிக் கொள்ளலாம் என்று பிரிவு (1) தெளிவாகக் கூறுகிறது. ஆனால் NPR தயாரிப்பது பற்றி குடியுரிமைச் சட்டத்தில் எங்குமே பேசப்படவில்லை. மூலச் சட்டமான குடியுரிமைச் சட்டத்தில் சொல்லியிருந்தால் மட்டுமே அது பற்றிய விதிகளை உருவாக்க முடியும். விதிகள் உருவாக்குவதற்கு இது மிகவும் முக்கியமானதொரு அம்சமாகும். விதிகள் தனிப்பட்ட முறையில் அதிகாரம் கொண்டவை அல்ல. நாடாளுமன்றத்தால் இயற்றப்பட்ட சட்டத்தில் வழிவகை செய்யப்படவில்லை என்றால் எந்த ஒரு முக்கியமான திட்டத்தையும் இந்த விதிகளை மட்டும் கொண்டு நடைமுறைப்படுத்த முடியாது. அதிகார முறைகேட்டுக்கு வழிவகுக்கும் இத்தகைய விதிகள் சட்டப்படி செல்லத்தக்கவை அல்ல. சட்டக் கோட்பாடுகளும் கொள்கைகளும் போதுமான அளவு வகுக்கப்பட்டிருந்தால் மட்டுமே சட்டமியற்றும் அதிகாரம் சட்டமன்றத்திற்கு வழங்கப்படுகிறது என டாடா நிறுவனத்திற்கும் அதன் தொழிலாளர்களுக்கும் இடையிலான வழக்கு ஒன்றில் உச்ச நீதிமன்றம் தெளிவு படுத்தி உள்ளது.
NPR தயாரிப்பதற்கு குடியுரிமைச் சட்டம் 1955 இல் இடமில்லை என்பதே உண்மை. எனவே அதற்கான விதிகளையும் வகுக்க முடியாது. அதற்கான சட்டக் கொள்கைகளும் கோட்பாடுகளும் முதலில் வகுக்கப்பட வேண்டும். அதன் பிறகுதான் விதிகளை வகுக்க முடியும். இதுதான் துணைச் சட்டங்களை உருவாக்குவதற்கான அடிப்படைக் கொள்கையாகும். விதிகள் என்பவை துணைச் சட்டமாகும், அவை மூலச் சட்டத்திற்கு உட்பட்டிருக்க வேண்டும்.
மூலச்சட்டத்திற்குப் புறம்பாக விதிகள் இருந்தால் அவை முறைகேடானவை எனக்கூறி நீதிமன்றம் அவற்றை இரத்து செய்து விடும். அரசுத் துறைகள் இந்த விதிகளை உருவாக்குவதற்கான அதிகாரத்தை மூலச்சட்டத்திலிருந்தே பெறுகின்றன. எனவே ஒரு குறிப்பிட்ட திட்டம் குறித்து மூலச்சட்டத்தில் இடமில்லை என்றால் அது குறித்த விதிகளை உருவாக்க அரசுத் துறைகளுக்கு அதிகாரமில்லை.
NPR தொடர்பான விதிகள் பாரதூரமான குறைபாடுகளைக் கொண்டதாகவே உள்ளது. விதிகள் வடிவமைக்கப்பட்ட காலத்திலிருந்தே இக்குறைபாடுகள் நீடிக்கின்றன. நாடாளுமன்றத்தின் இரு அவைகளிலும் முன்வைக்கப்பட்டதாலேயே இவ்விதிகளில் உள்ள குறைபாடுகளை சரிசெய்துவிட முடியாது. மூலச் சட்டத்தில் வழிவகை செய்தால் மட்டுமே இக்குறைபாடுகளை சரி செய்ய முடியும்.

So I decided to accure knowledge through some true data. Then I find out historical data about Citizenship act of India. Finally I found that there is no any other selfishness. This is only for our country's safety.

@vicky there is a clause u didn’t mentioned here. There is clause called doubtful citizen means if anybody arises a doubt on you even though you have some documents available with u for proof u will be evaded from issuing a citizenship. Pls check the speech of justice.

- It is an Act that offers citizenship to "any person belonging to Hindu, Sikh, Buddhist, Jain, Parsi or Christian community from Afghanistan, Bangladesh or Pakistan, who entered into India on or before the 31st December 2014."
#𝟐. 𝐖𝐡𝐚𝐭 𝐢𝐬 𝐭𝐡𝐞 𝐩𝐫𝐨𝐛𝐥𝐞𝐦 𝐢𝐧 𝐠𝐢𝐯𝐢𝐧𝐠 𝐜𝐢𝐭𝐢𝐳𝐞𝐧𝐬𝐡𝐢𝐩 𝐭𝐨 𝐭𝐡𝐞𝐬𝐞 𝐠𝐫𝐨𝐮𝐩𝐬?
- 3-core-problems
i. The problem is not to whom the government is giving citizenship and help but to whom it is NOT (i.e., Muslims).
ii. This Act does not state 'religious persecuted' population as claimed by the Government narrative but 'any person from select religious denomination' who entered, NOT escaped for persecution reasons.
iii. This Act, therefore, by design systematically targets and excludes undocumented Muslims immediately and has long-term implications.

- Creating a law to give citizenship on a religious test is against India's own constitution [Article 14 (equality before law), 21 (protection of life and liberty) and Amendment#42 - ideals of secularism].
#𝟓. 𝐇𝐨𝐰 𝐦𝐚𝐧𝐲 𝐩𝐞𝐨𝐩𝐥𝐞 𝐝𝐨𝐞𝐬 𝐢𝐭 𝐢𝐦𝐩𝐚𝐜𝐭 𝐢𝐧 𝐧𝐞𝐚𝐫 𝐟𝐮𝐭𝐮𝐫𝐞?
- Consider the NRC exercise in Assam. It identified 19 lakh (1.9 million), undocumented persons. Out of which 36% (700,000= 7 lakh = .7 million) are Muslims.
- Nationwide impact can only be guessed.
#𝟔. 𝐎𝐤𝐚𝐲, 𝐬𝐨 𝐰𝐡𝐚𝐭 𝐰𝐢𝐥𝐥 𝐡𝐚𝐩𝐩𝐞𝐧 𝐭𝐨 𝐭𝐡𝐨𝐬𝐞 𝐮𝐧𝐝𝐨𝐜𝐮𝐦𝐞𝐧𝐭𝐞𝐝 𝐌𝐮𝐬𝐥𝐢𝐦𝐬?
- They will be sent to foreign tribunals (FT) to prove their citizenship.

- Second, 95% of those cases that result in FT are still declared 'illegal immigrants'. In other words, 'stateless,' who will be sent to detention centers.
- 26 Deaths in Assam's Detention Centres have been reported already as of Nov. 2019.

Pro CAA: It doesn't take away citizenship, it gives citizenship. Why are Muslims worried?

Pro: No, Muslims have 56 Muslim countries, they can go to any country. Where will Hindus go?

False that it gives citizenship only to persecuted minorities*, the fact is that it in its premise it talks about the persecution of minorities in those 3 countries but the law in itself never talks about the persecution and clearly state "anyone who is Hindhu,...., belonging to Pakistan,....." will be given citizenship, that means it never differentiate between persecuted and non persecuted who came here for economic or any other reasons. So, clearly there is no difference between an Hindhu and Muslim who just came here on economical or any other reason, Which is a clear discrimination and in my opinion, whoever supports this bill is an Islamaphobic.
2. Only around 30,000 people are going to get citizenship, NO, the fact is it's a number given by IB 4 yrs back about illegal immigrants who claims to be persecuted having long term visas, they are just immediate beneficiaries, certainly excluding Muslims who had difficulty in proving their citizenship in Assam NRC but qualifying 2014 cut off period going to get citizenship that is going to be few lakhs in numbers in the meantime lakhs of Muslim going to suffer(even some genuine citizens).
3. Nationwide NRC will be completely different from Assam's NRC if implemented, NO, citizenship is decided based on the prevailing act only there can't be much difference NRC Assam and national wide practice unless they make another amendment in citizenship act.
There are few court orders which ruled out voter id, aadhar, passport as a proof of citizenship(in cases which has nothing to do with Assams NRC)
4. Muslim are not persecuted in these three countries, NO, there are certain section Muslim being persecuted in Pakistan
5. The FAQ regarding CAA+ NRC from pib(fake pib page??) was not from any govt. official, there are lot of controversy over that faq(its not even published in its official page but in an WordPress page!!!)used in this video

False that it gives citizenship only to persecuted minorities, the fact is that it in its premise it talks about the persecution of minorities in those 3 countries but the law in itself never talks about the persecution and clearly state "anyone who is Hindhu,...., belonging to Pakistan,....." will be given citizenship, that means it never differentiate between persecuted and non persecuted who came here for economic or any other reasons. So, clearly there is no difference between an Hindhu and Muslim who just came here on economical or any other reason, Which is a clear discrimination and in my opinion, whoever supports this bill is an Islamaphobic.
2. Only around 30,000 people are going to get citizenship, NO, the fact is it's a number given by IB 4 yrs back about illegal immigrants who claims to be persecuted having long term visas, they are just immediate beneficiaries, certainly excluding Muslims who had difficulty in proving their citizenship in Assam NRC but qualifying 2014 cut off period going to get citizenship that is going to be few lakhs in numbers in the meantime lakhs of Muslim going to suffer(even some genuine citizens).
3. Nationwide NRC will be completely different from Assam's NRC if implemented, NO, citizenship is decided based on the prevailing act only there can't be much difference NRC Assam and national wide practice unless they make another amendment in citizenship act.
There are few court orders which ruled out voter id, aadhar, passport as a proof of citizenship(in cases which has nothing to do with Assams NRC)
4. Muslim are not persecuted in these three countries, NO, there are certain section Muslim being persecuted in Pakistan
5. The FAQ regarding CAA+ NRC from pib(fake pib page??) was not from any govt. official, there are lot of controversy over that faq(its not even published in its official page but in an WordPress page!!!) that you use in this video
Finally this is clearly discriminatory, I don't know why the people are supporting this act. Certainly whoever knows about the act will not support this act.

1) You are not open for any dialogues and discussions and debates that viewers counter you with logical and fair questions.
2) You think you are always thinking in right direction.
3) Are you backed by any honest advocates or legal consultants when you make statements just like Rajini that this CAA does not impact Muslims and dalits. The high probability of making many of the people as doubtful citizens is a primary concern for us Muslims and like minded people.Coulld you clarify this?

Please go and talk to people out there in protest who all are there .You will find advocates and other dignitaries supporting these otherwise why do you think many states have passed resolution not to carry out in NPR .All I am asking Vicky is just don't throw his judgements and conclusions over the situations. He would need to do a ground report to be passing his opinions.this is a law being imposed and impacting people directly just like the adversaries of demonetization and gst so don't just presume and advices. You have very well explained the CAA, CPR, NRC to even the common man. The problem in the country is not so much of understanding of the letter of the law but the credibility of the person who is implementing the law. So the problem is not lack of understanding but it is a lack of trust. In recent times people have experienced the destruction of independent institutions. For example just take the Supreme Court judgement regarding Ayothi case. Was there any justice in that verdict? That was an abomination of justice. Even the Supreme Court can be made corrupt what credibility can you give to a political party who have lost credibility. Will not people be made to stand in line for days as they were made to stand in line to take their own money from the banks. The problem of the government is its lack of will to listen to people or opposition. Go to the people to understand their problems and fears as early as possible.

2.Assam மாநிலத்திள் உள்ள 19 லட்சம் அகதிகளுக்கு CAA பொறுந்துமா பொறுந்தாதா.அப்படி பாதிக்கப்பட்டவர்களில் உள்ள 12 லட்சம் மக்கள் நாங்கள் மேற்குறிப்பிட்டுள்ள நாடுகளிள் இருந்து மத துன்புறத்தலுக்கு உள்ளாகிதான் வந்தோம் என்று கூறி பயன்பெற முடியுமா முடயாதா.அப்படி முடியுமெனில் Muslim என்ற காரனத்தால் மட்டுமே குடியுறிமை பெற முடியாத அவலம் வருமா வராதா.
3.தமிழ்நாட்டை பொறுத்தவறை ஒருவேலை எளிதான சான்றிதழ்களை கேட்டாள் கூட அதனை கூட தற இயலாத மக்கள் அனைத்து சமூகங்களிலும் உள்ளனர். அவர்கள் பாதிப்பு அடைய மாட்டார்களா அப்படி பாதிப்புக்குள்ளாவுவர்களிள் மற்ற சமூகத்தினர் பலன் அடைய மடியும் CAA வால் ஒறுவேளை அவர்கள் அந்த 3 நாடுகளிள் இருந்நு வந்தவர்கள் என்று கூறினால் ஆனால் இஸ்லாமியர்களுக்கு?
இப்படிக்கு உங்களின் விடைக்காக காத்திருக்கும் உங்களை பின்தொடர்பவர்களில் ஒறுவன்

Think you are only trying to agitate on NRC(which s actually a Supreme Court directive). I don't think anyone can explain in this level. Offcourse there are flaws in implementation. It will be rectified. It s not just agenda of modi or amitshah. Are those dignitaries sent to detention camps with an immediate effect?? Lot of officials, ias, ministries and previous governments have worked together. It is always for greater good. So shall we disregard the law and keep on allowing illegal immigrants???

Who said they are already declared illegal. There is tribunal hearing going on in each cases, if they are relatives they can still establish the facts and get it rectified. Assam NRC is not yet completed.
