I remember there was a videogame show on Japanese TV (early 2000s) in which one of the co-hosts was Hirokazu Hamamura (ex-Famitsu magazine editor.) And he told one hilarious Miyamoto story from the 1980s. While attending a game convention in the US he was approached by a couple and their kids for an autograph. They told him the kids loved his games and stuff and went away. Miyamoto noticed that his interpreter was perplexed and asked what's wrong and he said "Miyamoto-san, that was Paul McCartney!" In which Miyamoto replied, "Paul? So that's his name? And what he does for a living?" I would love to know the veracity of this story.
That part about not understanding projections was hilarious to me because I used to (emphasis on USED) to listen to movie podcasts and I quickly learned that Hollywood is just as, if not more silly than the videogame industry. Countless projects announced that get cancelled, changed up or just vanish, and analysis that doesn't really mean anything at the end of the day. It says a lot that the movie podcasts I listened to don't even exist anymore.
So we have 3 generations of people in my household. Mine, my parents and my brother's children. Literally everybody walked out of Mario happy. It's not a deep movie, but it was a fun movie that made the Mario and non-Mario fans in the family happy. I can understand some people calling the film shallow but there's nothing inherently wrong with the film. I'm not sure why the critics hate it so much.
Iwata to me was the bright spot In the darkest time for Nintendo not Just the Wii U era but even before that when the GameCube wasn't selling well he worked on melee he then became president and the face of Nintendo for a lot of people, every month or so there was Iwata doing some luigi skit or being a muppet or star fox or lego iwata It Is a huge Injustice for all he's done to get us through the rough years he couldn't see the success of the Switch and the Mario movie I would give anything to have a Nintendo Direct with Iwata announcing the Mario movie, I miss his smile
The stuff that Iwata did for the company was really memorable, for helping with Smash Melee like you said, but also guiding through Nintendo's high and low periods

I very much agree with your guys' take on modding. Nintendo has the right to say what you can and can't do with their games. These are their own IPs and they should be able to set their own boundaries. No one should be surprised if your content gets taken down if you go against Nintendo's boundaries.
The fact that the credits of the movie pay the tribute to him is proof that Nintendo never died with him. The toxic fans that said that are nothing but heartless toxic people that Never care about developers but themselves. Thankfully for us, we are respectful and we care about the developers.
I think two things that didn't make sense for critics was 1 - usually the reason why characters go to the next scene goes by v v quickly and easy to miss, so it can be hard to follow at first. And 2 - I think the powerups weren't handled very well either. Just lots of random powers that didn't get introduced. I liked it, but I hope future movies have bigger budgets and less cheesy music!
Still making my way through the episode, but if you're looking for a cozy indie game I'd highly recommend Lil Gator Game. It's basically A Short Hike meets Legend of Zelda. That and Slap City were my favorite Nindies of 2022 😁👍
1:04:55 I'm not an expert,...but my guess is it's tied to the movies theaters, how many times they show the movie per day, and probably percent of ticket sold each showing. of course it'll be sold out the first few days so that'll be 100% sold tickets. A few days later it'll dwindle down to an average, blah blah blah. I'm sure they have historical stats that can tell them the projected $$$ to be made
I've also been using the RogersBase style excel sheet, and it's been amazing so far. I added 7 categories to rank the games by (Such as gameplay, story, quality of life, etc...) and I added weights to each category (For example, the score I give to gameplay accounts for 30% of the entire score, whereas quality of life only accounts for 7.5% of the entire score). I grade harsly and almost purely subjectively, but it's a great way to see what games I've played this year. So far Poral is winning with a 92.5.
1:03:02 I’ve just accepted that I am not going to see eye to eye with critics on one hand nor movie fandoms on the other. I can’t tell you how many times I’ve left the theater thinking that the movie was awesome only to have that joy crushed by critics or fans (or both, like when I watched the hobbit trilogy, and my defense of it is very similar to Krysta’a defense of SMB). I did feel like I was left wanting by the Mario movie but I totally think it deserves at least a decent score (and sequels!!). I have heard people actually say in other communities that they feel obligated to complain louder for something that is (in their opinion) overhyped because if they don’t they’ll get drowned out… but it ends up feeling so hostile!
I was curious and looked Rotten Tomatoes up, looks like things must have leveled off by now because I’m seeing quite a few critics give it a fair shake. I’m happy to see that but I’m still curious what those early reviews you mentioned were being so nasty about.
I wouldn't take what the critics say about the Super Mario Bros. movie very seriously; each of those reviews just read like the "author" asked ChatGPT to "write a review of the Mario movie in the voice of a first-year film student." When they can't see the story in front of their faces, they are automatically irrelevant.

I find it especially hilarious that so many reviewers criticized the Mario movie for not having much of a story or character development, yet every single John Wick movie has over 85% on the Tomatometer lmao. It's like, have you every PLAYED a Mario game in your life? They're not exactly known for their complex stories lol.
The film studio only gets to keep around 50% of the global box office. Those 100 Mio. probably don't count the marketing costs, which are probably between 50-100 million, so the film probably has broken even by now.
Only thing that would've made the lead up to this movie better would've been seeing Miyamoto flanked by what seemed like his best buds, Iwata and Reggie at press events.

I remember the Sony leaks when they were the ones trying to make a deal to make a Mario movie. What could have been. Also the 100 million price tag is just the money they used to make the movie. Prints and advertisements isn't included in that number. Also a 50-50 split is unheard of in Hollywood. Nintendo definitely got a great deal with Universal.

Kit: Does anyone actually like Avatar? Yes, there an entire fandom of us. WE like Avatar cause its a great movie and franchise. I dont know why people act like Avatar is some bad movie to dump on. It's super annoying.
Avatar is so popular because the theater experience is unlike any home theater experience, so people go see before it leaves the theater. The VFX have evolved so well people can't tell what they are looking at is real or CGI.
I'm not sure what they could take from this movie to improve the games, it most certainly isn't the story, expressive characters?, well they can do that without the new character designs and they've been full of personality in the RPG games too, the only thing you could probably take is the voices and make them the new voices of the cast in the Mario games, which I would definitely not like personally.

When they make box office predictions, the estimate the day of based on all data they have. Similar movies in similar genres playing in similar times of the year, all taking into account tge previous two days of box office gross and the pre-sales for that day. The actuals don't come in until like Tuesday morning for the previous weekend.
Man, sometimes they really frustrate me. For one, Krysta said a really horrible game is a 6/10. There’s plenty of 6/10 games that are still really fun! Not every game needs to be a 10/10. Then they also complained about a lack of “mainstream” indie game releases this year. There are tons of indie games always releasing. Put in any effort and you can find great ones. It doesn’t need to be mainstream, it doesn’t need to be the popular game everyone is playing, in order for it to be fun and good.

The movie was totally fine, I thought it could have been better just! Most of the dialogue references made me cringe, but I loved the background ones. I feel like if they dropped the Donkey Kong stuff and expanded the rest of it, it would have been so much better.
Actually Nintendo is definitely overstepping when it comes to claiming videos showcasing mods to their games. There is now a long-standing precedent set to consider video game footage a transformative work that falls under fair use. Showing modded gameplay footage would then just be a subset of gameplay footage, because obviously if unmodded gameplay is acceptable then the same gameplay with custom made changes must be too. If anyone actually had the time and means to defending this in court against Nintendo they would likely win, because companies often lose cases where there's a clear history of allowing something beforehand. For a similar comparison, imagine someone showing off their hand-painted Nintendo console collection in a video. Does Nintendo own the rights to that video because they are showing the Nintendo-owned IP of the product? No, of course not. This also isn't too far off from the emulator argument. If Nintendo tried to act against an emulator, like Dolphin for example, they would have zero legal grounds for it. Doesn't mean they wouldn't still try throwing their weight to bully small project owners.
You have a fundamental misunderstanding of the actual terms of copyright, fair use, and the majority of your comment extrapolates on these legal terms in such a way that its honestly laughable. Modding is not allowed because it is a ToS violation on two separate Terms of Service, the one for the Nintendo Switch console (the same thing that voids your warranty for modification of it) and the one for the software itself. On just those grounds alone modding is a clear violation of those and anyone trying to defend their right to infringe upon those Terms in court (especially with as flimsy a defense as 'fair use') would be laughed out of court and fined to the utmost discretion of the judge. But also, you claim this is a long-standing precedent but that requires an actual court case to have occurred on this subject, and no such case has ever been litigated. Let's Plays and related video game videos still exist in a nebulous legal grey area that has not been decisively decided on, but most professionals opinions side with the original IP license holders (though who knows maybe a judge will see it on the side of the content creator, the point is though its yet to be fought). But furthermore, showing modded gameplay footage would never fall under fair use; the opposite is in fact true: none of the fair use tenants hold and many are violated. Particular is that 99.9% of the code used in the modded version still belongs to Nintendo. So there is no legal right to distribute the code, and by linking to and making content advertising the mod you are now complicit. So the claim that if anyone took Nintendo to court about this they would win? There exists no permutation of our current reality where that would ever occur. You then proceed to give a "similar comparison" that is by no means a logical comparison at all: you go from poorly describing fair use to describing a situation that doesn't touch on fair use at all. Nintendo couldn't own the rights (which is not something that happens in this situation anyways but I digress) to this hypothetical video because of fair use, they don't have a claim on that video because you're not even showing IP - which are intangible goods by definition - you are showing a tangible product that you clearly own. A physical thing like a console cannot be IP. Fair use doesn't apply here as it is not IP Nintendo has also never - and furthermore, will never - attempt to litigate Dolphin or any other emulator team because emulation was actually ruled on as being fair use in numerous court cases (funnily enough, none actually litigated by Nintendo, there were 2 Sony cases about it and the critical one used as precedence was a Sega case). This is a stark contrast to the current legal status of Let's Plays/video content in general. However there do exist exact guidelines on which emulators could be shot down; even though the courts have upheld that reverse engineering consoles to produce emulators is legal, actually stealing console code and uploading that into an emulator code base is expressly illegal. Emulator developers are smarter than that though, so they write their own code. But there does exist legal grounds for take down of an emulator. It really helps to actually understand what you're talking about before making a statement of "actually..."

Terms of Service are there to essentially, state that the owner of said platform can enforce rules as they see fit including their right to revoke or restrict access. The rest of the book you apparently felt like typing up is full of just as many holes. First, you think the word precedent has to mean court case precedent. It doesn't. There are multiple types of precedent that are valuable. One such is prior behavior, and it is used in defenses where something is allowed for years by an entity but they have a sudden reversal. This only works when there's a clear acknowledgement from the entity for some of the occurrences. (Nintendo working with content creators is the precedent here). This exists so you can't just let someone keep doing something 100 times, so that you can sue later down the line for 100x the amount and claim 100 infringements. Next you falsely define mods as being 99.9% code owned by Nintendo. Once again showing your complete lack of knowledge here. Modding tooling are specifically written to get around this. The way it works is mods are simply the changes to code bundled together as a patch. Modding tools apply this patch to the image you provide to it. The idea is you can create a backup image of your own game copy yourself, then apply the mod patch to that image. This is 100% legal and has 0% Nintendo-owned code is shared. This has been the way rom hacking has been handled for decades so that they remain safe from removal. For some reason you state that there's no such thing as physical IP? Really weird false claim to make. Intellectual property does not have to be intangible, IP is the ownership of the creation and is certainly extended to physical goods. No idea how you came to the conclusion that it's not included. Your whole response is just full of uneducated opinions.

You two are giving way too much power of the opinions of the film critics of Rotten Tomatoes (RT). They are film critics, they have a strict criteria of things that make a film, a film. The Mario movie has NOT had the best launch ever for an animated movie. These headlines are sensationalist, Mario launched on a Wednesday, Frozen 2 on a Friday, they're comparing 5 days of Mario to 3 days of Frozen. However, the Mario movie did in fact have a mind-blowing launch, shattering every projection, I was really wrong about this, I thought it would make 600 Million theater lifetime at the absolute most.

Still making my way through the episode, but if you're looking for a cozy indie game I'd highly recommend Lil Gator Game. It's basically A Short Hike meets Legend of Zelda. That and Slap City were my favorite Nindies of 2022 😁👍

1:04:55 I'm not an expert,...but my guess is it's tied to the movies theaters, how many times they show the movie per day, and probably percent of ticket sold each showing. of course it'll be sold out the first few days so that'll be 100% sold tickets. A few days later it'll dwindle down to an average, blah blah blah. I'm sure they have historical stats that can tell them the projected $$$ to be made
I've also been using the RogersBase style excel sheet, and it's been amazing so far. I added 7 categories to rank the games by (Such as gameplay, story, quality of life, etc...) and I added weights to each category (For example, the score I give to gameplay accounts for 30% of the entire score, whereas quality of life only accounts for 7.5% of the entire score). I grade harsly and almost purely subjectively, but it's a great way to see what games I've played this year. So far Poral is winning with a 92.5.

I can’t tell you how many times I’ve left the theater thinking that the movie was awesome only to have that joy crushed by critics or fans (or both, like when I watched the hobbit trilogy, and my defense of it is very similar to Krysta’a defense of SMB).
I did feel like I was left wanting by the Mario movie but I totally think it deserves at least a decent score (and sequels!!). I have heard people actually say in other communities that they feel obligated to complain louder for something that is (in their opinion) overhyped because if they don’t they’ll get drowned out… but it ends up feeling so hostile!
I was curious and looked Rotten Tomatoes up, looks like things must have leveled off by now because I’m seeing quite a few critics give it a fair shake. I’m happy to see that but I’m still curious what those early reviews you mentioned were being so nasty about.

Avatar is so popular because the theater experience is unlike any home theater experience, so people go see before it leaves the theater. The VFX have evolved so well people can't tell what they are looking at is real or CGI.
I'm not sure what they could take from this movie to improve the games, it most certainly isn't the story, expressive characters?, well they can do that without the new character designs and they've been full of personality in the RPG games too, the only thing you could probably take is the voices and make them the new voices of the cast in the Mario games, which I would definitely not like personally.

When they make box office predictions, the estimate the day of based on all data they have. Similar movies in similar genres playing in similar times of the year, all taking into account tge previous two days of box office gross and the pre-sales for that day. The actuals don't come in until like Tuesday morning for the previous weekend.
Man, sometimes they really frustrate me. For one, Krysta said a really horrible game is a 6/10. There’s plenty of 6/10 games that are still really fun! Not every game needs to be a 10/10. Then they also complained about a lack of “mainstream” indie game releases this year. There are tons of indie games always releasing. Put in any effort and you can find great ones. It doesn’t need to be mainstream, it doesn’t need to be the popular game everyone is playing, in order for it to be fun and good.

Actually Nintendo is definitely overstepping when it comes to claiming videos showcasing mods to their games. There is now a long-standing precedent set to consider video game footage a transformative work that falls under fair use. Showing modded gameplay footage would then just be a subset of gameplay footage, because obviously if unmodded gameplay is acceptable then the same gameplay with custom made changes must be too. If anyone actually had the time and means to defending this in court against Nintendo they would likely win, because companies often lose cases where there's a clear history of allowing something beforehand.
For a similar comparison, imagine someone showing off their hand-painted Nintendo console collection in a video. Does Nintendo own the rights to that video because they are showing the Nintendo-owned IP of the product? No, of course not. This also isn't too far off from the emulator argument. If Nintendo tried to act against an emulator, like Dolphin for example, they would have zero legal grounds for it. Doesn't mean they wouldn't still try throwing their weight to bully small project owners.
You have a fundamental misunderstanding of the actual terms of copyright, fair use, and the majority of your comment extrapolates on these legal terms in such a way that its honestly laughable. Modding is not allowed because it is a ToS violation on two separate Terms of Service, the one for the Nintendo Switch console (the same thing that voids your warranty for modification of it) and the one for the software itself. On just those grounds alone modding is a clear violation of those and anyone trying to defend their right to infringe upon those Terms in court (especially with as flimsy a defense as 'fair use') would be laughed out of court and fined to the utmost discretion of the judge.
But also, you claim this is a long-standing precedent but that requires an actual court case to have occurred on this subject, and no such case has ever been litigated. Let's Plays and related video game videos still exist in a nebulous legal grey area that has not been decisively decided on, but most professionals opinions side with the original IP license holders (though who knows maybe a judge will see it on the side of the content creator, the point is though its yet to be fought). But furthermore, showing modded gameplay footage would never fall under fair use; the opposite is in fact true: none of the fair use tenants hold and many are violated. Particular is that 99.9% of the code used in the modded version still belongs to Nintendo. So there is no legal right to distribute the code, and by linking to and making content advertising the mod you are now complicit. So the claim that if anyone took Nintendo to court about this they would win? There exists no permutation of our current reality where that would ever occur.
You then proceed to give a "similar comparison" that is by no means a logical comparison at all: you go from poorly describing fair use to describing a situation that doesn't touch on fair use at all. Nintendo couldn't own the rights (which is not something that happens in this situation anyways but I digress) to this hypothetical video because of fair use, they don't have a claim on that video because you're not even showing IP - which are intangible goods by definition - you are showing a tangible product that you clearly own. A physical thing like a console cannot be IP. Fair use doesn't apply here as it is not IP
Nintendo has also never - and furthermore, will never - attempt to litigate Dolphin or any other emulator team because emulation was actually ruled on as being fair use in numerous court cases (funnily enough, none actually litigated by Nintendo, there were 2 Sony cases about it and the critical one used as precedence was a Sega case). This is a stark contrast to the current legal status of Let's Plays/video content in general. However there do exist exact guidelines on which emulators could be shot down; even though the courts have upheld that reverse engineering consoles to produce emulators is legal, actually stealing console code and uploading that into an emulator code base is expressly illegal. Emulator developers are smarter than that though, so they write their own code. But there does exist legal grounds for take down of an emulator.
It really helps to actually understand what you're talking about before making a statement of "actually..."

ToS is an agreement for whatever community or platform it is written for as within the confines of their ownership. ToS is NOT a legal agreement or related to the law whatsoever. Terms of Service are there to essentially, state that the owner of said platform can enforce rules as they see fit including their right to revoke or restrict access.
The rest of the book you apparently felt like typing up is full of just as many holes.
First, you think the word precedent has to mean court case precedent. It doesn't. There are multiple types of precedent that are valuable. One such is prior behavior, and it is used in defenses where something is allowed for years by an entity but they have a sudden reversal. This only works when there's a clear acknowledgement from the entity for some of the occurrences. (Nintendo working with content creators is the precedent here). This exists so you can't just let someone keep doing something 100 times, so that you can sue later down the line for 100x the amount and claim 100 infringements.
Next you falsely define mods as being 99.9% code owned by Nintendo. Once again showing your complete lack of knowledge here. Modding tooling are specifically written to get around this. The way it works is mods are simply the changes to code bundled together as a patch. Modding tools apply this patch to the image you provide to it. The idea is you can create a backup image of your own game copy yourself, then apply the mod patch to that image. This is 100% legal and has 0% Nintendo-owned code is shared. This has been the way rom hacking has been handled for decades so that they remain safe from removal.

Intellectual property does not have to be intangible, IP is the ownership of the creation and is certainly extended to physical goods. No idea how you came to the conclusion that it's not included.

IN the 2000-early 2010s ROM Hacking absolutely was about the sharing of patched ROMs. This wasn't even just an SMW Central thing as most major translation patches a la Aeon Genesis were packaged with the ROM code. At best, this innovation in mod loader type executables is half a decade old leaning towards a full decade but certainly not multiple decades. You also (correctly) describe mods as changes to the code, but the critical inference you're lacking there is that changing code does not mean it now belongs to you. The opposite in fact, you're now performing the expressly illegal act of modifying (hence mod) their legally protected code base. This is what the illegality of mods is primarily about. We have no legal claim to distribute these derived modifications of the code. Whether you do so yourself or via a mod loader, the core action done here is still illegal. This does not change even if you rip the ROM image yourself from a cartridge that you own. Funny who's showing "lack of knowledge" here.

You two are giving way too much power of the opinions of the film critics of Rotten Tomatoes (RT). They are film critics, they have a strict criteria of things that make a film, a film. These headlines are sensationalist, Mario launched on a Wednesday, Frozen 2 on a Friday, they're comparing 5 days of Mario to 3 days of Frozen.
However, the Mario movie did in fact have a mind-blowing launch, shattering every projection, I was really wrong about this, I thought it would make 600 Million theater lifetime at the absolute most.
