I'm not saying wrong things have been done here, but for a crime to be committed, the action a person undertakes must be in contravention of some part of the criminal code. It's a real shame. The information is all out there. Inquiry after Inquiry, but the voting public doesn't see a fraction of it (and doesn't have the time to go looking!). This stuff doesn't get 'clicks' from a mass audience though so no incentive for the media to devote the time it seems.

Imagine a private business being able to ignore draft advice on a professional legal opinion and just going ahead with a project. The fines and lawsuits following actions like that would be astronomical and also lead to criminal investigations, the same needs to happen here.

Private corporations the world over do exactly this and do get away with it. Its with this kind of legal happenings that the EU has been able to remove millions of dollars from tech companies who know full well they are breaking the law. The thing you need to take into account in this situation is that the fine in question is often added into the price of doing business and barely ever resembles the profits that were made. Quite simply, our Government were acting in the same fashion.

In what would have been a fairly average day to day job for a lawyer in DSS this scheme of Robo Debt would have been a huge blip for a DSS lawyer and Anne Pulford either has the worst memory for a lawyer in history, was lackadaisical in her job or is just covering her own arse. Fascinating that previous legal case/s have stated that the ATO is NOT a legal entity...yet there's testimony representing the ATO in a Royal Commission...but there's criticism for not ensuring procedure. Look how far we've come.

Although the High Court accepted that the Australian Taxation Office is not a legal entity, the High Court explicitly stated that this fact is of no relevance to the tax liabilities that were challenged in that case because it's the Commissioner/Deputy of Taxation at play. Brilliant - this kind of coverage should be the norm rather than the exception. We cannot rely on any mainstream media outlets to provide this kind of coverage featuring predominantly the evidence given. Rather, they give more “analysis” which is another way of saying “spin the evidence” to give it whatever political bias they require. I’m amazed at the “I dunno” responses of senior (well paid) staff - including lawyers.
The practice of “draft legal advice” is a two way bet by solicitors. This should not be allowed. Solicitors have been asked to advise on the law. By sending a “draft” reply is not deserving of acceptance or payment and is an obfuscation of the facts. There is a lot of obfuscation in this testimony of witnesses and the department advisors. Who does accept their primary accountability. Surprising the Dept administrators can get away with this.

It's truly re-assuring to see the absolute competence of counsel and the commissioner. Thank god we have these people, just a shame they are cleaning up the absolute mess of the asshats who implemented the scheme.
Beyond disappointing and absolutely shameful, how these people keep their jobs is a joke. The most disturbing thing about this is how much it highlights the normal and widespread dodgy practices within these departments. Paying for expensive legal advice the choosing to disregard it because it might get in the way wtf is that about? How is that even legal what a joke.
I wonder what the total costs are for all the legal advice these departments seek when they outsource to expensive firms, legal advice that then never gets used because they don't like what it says. Then these same people go and hunt down small amounts of money from disadvantaged and vulnerable people in the community, in an immoral and illegal way, that might not have done anything wrong WTAF how are there no consequence for this?

This is why every entity that is funded by tax payers need to have recording of every conversation and every decision point. I’m so sick of hearing I don’t recall. This was actually discovered statistically in research following the Leveson Enquiry in the UK. Top policemen, politicians and newspaper executives had no recollection of issues that had happened weeks or months in the past, but ordinary people could remember things on the same day quite clearly. I think if a bureaucrat, executive or company director answers that they can't recall any specifics of even having written an email, even after they have been shown the very email, and after it has been shown in court that it quite clearly affected their job in significant ways, that person should be barred from holding any future position and should basically be deemed mentally incompetent by the state.
Anne Pulford has a very leaky recollection for a supposed lawyer. She strikes me as keeping her job is the most important thing, forgetting things helps.

Brilliant - this kind of coverage should be the norm rather than the exception. We cannot rely on any mainstream media outlets to provide this kind of coverage featuring predominantly the evidence given. Rather, they give more “analysis” which is another way of saying “spin the evidence” to give it whatever political bias they require. I’m amazed at the “I dunno” responses of senior (well paid) staff - including lawyers.

The practice of “draft legal advice” is a two way bet by solicitors. This should not be allowed. Solicitors have been asked to advise on the law. By sending a “draft” reply is not deserving of acceptance or payment and is an obfuscation of the facts. There is a lot of obfuscation in this testimony of witnesses and the department advisors. Who does accept their primary accountability. Surprising the Dept administrators can get away with this.

It's truly re-assuring to see the absolute competence of counsel and the commissioner. Thank god we have these people, just a shame they are cleaning up the absolute mess of the asshats who implemented the scheme.
Beyond disappointing and absolutely shameful, how these people keep their jobs is a joke.
The most disturbing thing about this is how much it highlights the normal and widespread dodgy practices within these departments.
Paying for expensive legal advice the choosing to disregard it because it might get in the way wtf is that about? How is that even legal what a joke.
Need more , shows that these hardly care about doing the job they were supposed to do .

I wonder what the total costs are for all the legal advice these departments seek when they outsource to expensive firms, legal advice that then never gets used because they don't like what it says.
Then these same people go and hunt down small amounts of money from disadvantaged and vulnerable people in the community, in an immoral and illegal way, that might not have done anything wrong WTAF how are there no consequence for this?
excellent presentation. Reveals a series of adminstrative holes, huge holes in fact in department actions/responses to matters of high legal and political importance. Evidence from the Tax office rep is pretty frightening ie the ATO 'assumes' other departments actions in their use of ATO data, are legal...ASSUMES good grief

The Public servants are the system, its no excuse to simply follow it and flys in the face of the traditions of the British system of institutions that our entire public service is based on. Trying to shed reflects poorly on these people and all should be held partially responsible for their weaseling.

And now we see that classic "I can't recall" strategy from the guilty. The innocent recall clearly, but the guilty strangely can't remember...
This was actually discovered statistically in research following the Leveson Enquiry in the UK. Top policemen, politicians and newspaper executives had no recollection of issues that had happened weeks or months in the past, but ordinary people could remember things on the same day quite clearly.
I think if a bureaucrat, executive or company director answers that they can't recall any specifics of even having written an email, even after they have been shown the very email, and after it has been shown in court that it quite clearly affected their job in significant ways, that person should be barred from holding any future position and should basically be deemed mentally incompetent by the state.
My debt was $7000, higher than the actual money i had received in total...????????????? and the onus was on me to prove i didnt owe it???

Anne Pulford has a very leaky recollection for a supposed lawyer. She strikes me as keeping her job is the most important thing, forgetting things helps.
Either that or someone's holding her relatives hostage.
