- A primer on FMLA and PFL for those who want to take PATERNITY LEAVE in the Golden State of CALIFORNIA.
During these 2 weeks of paternity leave, I want to try to daily vlog to share how I'll be spending my paternity leave. Will you come along? We'll see how it goes.
PRO TIP I forgot to mention: Take at least 1 PTO day or work 1 day during the pay period so you stay on payroll (and thus keep your medical benefits). Otherwise, you will have to be put on leave (i.e. no benefits).
Cliffnotes:
1. PFL is a state benefit - CALIFORNIA ONLY (well, other states may offer it, but I can only speak for California).
2. FMLA offers JOB PROTECTION, PFL offers MONEY
3. To participate in FMLA, you need to have been at your employer for at least 1 year (exact amount in link below).
4. You can participate in PFL whenever, as long as you have been paying into CA's EDD fund (see link below).
5. To enjoy in state-funded payments (~66% of your salary) and have a job when you get back, wait a year
6. You need to use both benefits before your child turns 1
7. You can split the time into weeks (use judgment with your employer)

I wanna aply for it since my baby was born Nov 29 but i went back on the 30, and been going in and out of work intermittently i miss one pr teo days but when i apply it doest give me the option to put the rest of the dates i missed it only asking when you started and when you wanna return to work
From what I remember, you can't only do chunks of weeks at a time. I don't remember being able to do one or two days at a time.
I’m working a job for 8 years and after doing so much for them they couldn’t allow me to take a week off before my child is born since we not legally married . I hope will never have to work a for a fuck up and shit project manager

Very nice, this is the only video I've found that talks about not qualifying for FMLA due to not working 12 months. My husband's request at work has already been denied because our daughter's due date (not born yet) is literally 2 weeks before his 1 yr anniversary at the company but at least now I know that he can apply after that day passes.

where is the FMLA form site? because the one you link it only a book
As far as I know, there is no form or application form to fill out. If you look at page 7 and 8 of that PDF, it will tell you what to do (notify your employer and they will usher the process from there)!

do you have an HR contact you can go to at your company? That would be the best way to go because it might be nuanced for every company. What if I wanted to use my sick time off hours. I have about 48 hours and after I use them I apply for PFL? Do you think it would be a safe move? I have a fear of losing my job over something like that. Ive been with the company for 3 1/2 years.

Yep, you should! Unless you don't want to take time off right away. But you do need to do it within 12 months of your baby being born or else you won't be able to take it anymore.

Thanks for this helpful video. You mentioned you can “couple” FMLA and PFL, but I thought you can’t have both at the same time? Once my PFL is up after 6 wks, would I then apply for FMLA for another 12 weeks unpaid?
FMLA is at the federal level (US), PFL is at the state level. FMLA is job protection (not money), and PFL is money (but doesn't protect your job). They have different prerequisites, but can be used at the same time.
So if I do not have the 1,250 hours required for fmla, will I then not qualify for baby bonding?

Yeah, you can't start on "day 1"...not sure why it works like that.

Hi. I am stuck with my back against the wall, so I will be a dad this month January 25th, and I have been working at my company for exactly 1 year and 4 days. Now I have 69 hours accrued vacation time. Do I use that paid time off or can I just not use that paid time off and apply for EDD for the 6 weeks paid family leave?

Hi New Dads! I came across this video and I was wondering when did you file for your claim? Did you submit it online on your first day taking your bonding time? Also, when you apply is their a waiting period? I didn't know new fathers get 12 weeks bonding. I thought it was only 6 weeks... well now 8 weeks as of July 1st when the new law took affect. Thanks for your help!
Yes - I don't think the website lets you submit your claim until your child is born. As of the time I made the video, we got 6 weeks of paid leave from Paid Family Leave (EDD from the State) and 12 weeks of FMLA (job security from the Federal gov). So in the end, you would get 6 weeks of paid leave and 6 weeks of unpaid leave. But times are different now, especially with covid, so I would take that into consideration. For example, you might need to think through your job(s) as companies might be downsizing. Either way, congrats and best wishes to you and your family!

Nah just start a new one. Just a heads up if you used the debit card option, it will just get refilled (I kept waiting for them to mail me a new one)
Question. If my job does a lot of prevailing jobs, would that be my highest quarterly pay or regular rate? Also that extra tip, how does that bonus work? U won't get pay your regular rate but get a bonus withing does 8 weeks plus time off?

I am hesitant to fill this form out and send it in for fear that it will stop my claim and I won't be able to take my last three weeks. Help! Any information would be great. so, I have a question regarding FMLA. If I well understood, if I start a new job in August 1st 2021, and my baby was born in June 1st 2022, I am only entitled to take FMLA only for 10 months , is that correct ? can you please share the link to the federal government documentation or rule for that? My current employer said to me that I am not entitled for FMLA since my baby was born before I had 1 year anniversary with the company.

They had me fill out a form! More specifically, they filled it out and I just read/signed it.
Hi, I have already taken 4 weeks of PFL and now I want to take rest of the 4 weeks. I received a form from EDD when I applied for 4 weeks and they asked me to fill and send over the form when I need to apply for remaining period. My question is can I apply online for the remaining period or do I need to fill and send the form for applying.
I believe you can do it online, I don't recall having to send a physical form for the 2nd chunk of my pfl.

I don't think you technically "have to" give them anything but I would give them (HR) a heads up. There might be some company-specific things the HR department needs to fill out. My understanding is that if you contributed $300 to the State Disability Insurance (CASDI on your paycheck), then you can receive PFL. Seeing that you have been at the company for 10 months, you are right at the cutoff, but I think you'll still be eligible. It doesn't hurt to file and if you get declined, then so be it. But I think you'll qualify.
By the way, congrats on becoming a new dad!
Hi I am pregnant and due mid of October and my husband wanted to get Paid family leave, but he works in the 🍓 fields in Salinas CA but he opens his Unemployment by the end of November every year because end of season for 🍓.. would he still be able to file up for Paid family leave maybe two weeks ? Or so and then open his Unemployment ?

Congrats on the baby! Unfortunately I don't know the answer to that. I would *guess* that PFL and unemployment are not related but I would try to call in and ask if you haven't already done that. Good luck!
You should look into CFRA- California Family Rights Act. Job protection for bonding for parents, including non-biological (same sex). Also SF has a 100% paid leave rule.

You'll have to check with your employer bc some companies will file on your behalf (I think) so they are paying the difference of your 6 weeks PFL to get to 8 weeks of pay.
Or it could mean they fully pay for 8 weeks and you might be able to file for another 6 for a total of 14 weeks.

Hi @Some Better - I am not familiar with having to take the one week off unpaid and then six weeks. My understanding is that if you contributed $300 to the State Disability Insurance (CASDI on your paycheck), then you can receive PFL right away. Regarding when you can start, you can file on "Day 1" of your paternity leave, but you can't do it before then. They will pay starting Day 1 but the actual money won't arrive at your house for 1-2 weeks, so you'll have to find out how to manage for that time. Let me know if that makes sense!

I’m currently pregnant and I was wondering if my bf is on paid vacation or sick hours right when our baby is born and he applies for paternity leave the day he’s born will he still qualify or will it have some sort of effect from him getting paid since he’s already getting paid at the moment from sick/vacation hrs sorry if I sound dumb I’m just now knowing about this.
No need to apologize! I don't think there's any issue with what you described (about him being on vacation) but there are requirements around how long he's been at the job and how much he has contributed to SDI Tax. My understanding is that it is not taxable for CA state tax but is taxable for US taxes

So my baby girl will be here on July 19(Friday) I plan to use PTO for the following week while I wait for the EDD stuff. It’s just that 2-3 week turn around time that sucks since I’m paid weekly. I also plan to save some FMLA to bond around the holidays. Congrats on your little one and happy Father’s Day!

Hey Juan, first of all, sorry about your fears around taking time off to bond with your newborn. That stinks! I'd recommend you to look up "FMLA" - it's a federal program (law?) regarding job protection. With that, you should be ok to use your sick time to supplement PFL. From my experience, employers actually want you to use sick time/PTO before using disability. Good luck!
PFL is a wage loss program, if you receive sick leave full wages then those days will be denied. If your employer integrates (meaning they use your sick leave to pay you 40% instead of 100%) then it'd be ok

Hey great information I know this video is 2 years ago but I'm having a baby in November and I have 2 jobs so can I still apply for all of this my main job is prolly giving me 2 weeks and my other part time job might possibly give me up to 12 weeks becuz we are union and also gotta work about 1250 hours for the year( which I think I have ) so I just need a little help on what to do. Ive gotten hired at both jobs at the same time so I've been working two jobs for about 2 years now after December
From what I understand, this benefit is at the state and federal level so the number of jobs doesn't get taken into consideration. I would ask the HR or logistics rep at your company on how to handle it. They will probably point you in the right direction!

Yeah, you just have to wait till when you actually take it off. I remember that being off but it was the way it is for whatever reason.

With PFL, do benefits still stay in place (eg 401k and HSA contribution, health insurance )? I’m a little confused as these things are taken out of my paycheck. But with PFL there doesn’t appear to be a “paycheck”.
Benefits do not stay in place unless you get a paycheck. For my first leave, I took two weeks in between two pay periods, so 401k and HSA were still taken out. For this leave, I'm taking four weeks, so there will be a two week period in which I will not make a 401k contribution, and in fact will need to double pay for medical benefits when I get back. Hope this helps!
New Dads Thanks for the info. Another question, do you have to use PFL in full calendar work weeks? Or can you offset it. Say I want to take 2 weeks off. For example Tuesday through Friday (4 days). Then Monday to following Monday (6 days)? Technically that’s would be 2 weeks, but not Monday through Friday x 2. Sorry if this is confusing.
As far as I know, you can offset as long as it's 5 consecutive working days, so your proposal would work.
Question, for pfl do you apply whenn baby is born or do you apply before?
You submit on the first day your leave begins. You have 41 days to submit: edd.ca.gov/Disability/PFL_Claim_Process.htm

When does PFL start ?? Idk if you know this info but I started my Disability Insurance for maternity leave starting at 4 weeks before my due date and after my due date I have 6 weeks to recover I’m currently on my 3 week recovery after childbirth. So does PFl or Paid bonding Leave is the 6 weeks after birth or is it additional 6 weeks after my disability insurance is over ??

For PFL how does that work if you want to spread out your 8 weeks of 3/4 pay?

You basically submit two claims, one for 3 weeks now, and another whenever you're ready to take 3 more weeks.

It usually takes 3 weeks according to the edd website: www.edd.ca.gov/disability/FAQ_PFL_Benefits.htm. Are you sure you provided all the documents they asked for? Did your receive a letter from edd with your weekly estimated payments?

@@waxsonre yep that's what I remember doing. Keep in mind, if you did the debit card option, they won't send you a new card, they'll just add funds to the existing account. I kept waiting for a new card!
