The person filing a claim against the agency how's the preponderance of the evidence standard whereas the agency has the heavier burden of showing through clear and convincing evidence that they would have done the same thing

Extremely useful information for the Gov't workers. It would be very helpful if to could get a consultation with you( or a retainer) before getting much deeper into the MSPB process unarmed.

Great video. What needs to be addressed is why employees have no recourse when wrongdoings occur. Typically employees are terminated and without a salary, and coming up with $5-$10k dollars for retainers and agencies know this which is why 90% of complaints go in favor of agencies.

Maybe the whole thing should be saving 1-5 percent of salary per year for a defense. After probationary period, you’ll have some some money saved up Afro a defense

Some information here is misleading. You can sue for compensatory damages with the MSPB if discrimination is an affirmative defense in your case.

I’m on indefinite suspension right now and have been for 2 years, without pay. Reason given, “in way of the discrimination case you filed”. How do I know this you may ask? They told me this in writing. Happen to know on an attorney that will represent me? Thanks in advance.
