My uncle had this happen to him one time. He lived in Pennsylvania and was gone for a month. He came home and squatters had moved in and changed the locks. He went to the shed in the back yard that still had his padlock on it and got his chainsaw. He removed the back door from the house with that chainsaw and for some reason the house emptied out within about 20 seconds. They never came back.
And the laws haven't changed. Oh yeah, the church took the squatters side, saying I was being cruel. They stole me blind and it cost thousands of $$$$$ and months to get the bastards out of my house. There are people living in motels who can't go back to their own home due to squatters' rights.

I was supposed to move into a home I rented. I had already switched the utilities into my name and when I showed up the resident said he decided not to move. The landlord, a friend of mine, didn't know anything about that. He confronted the resident who said he wasn't leaving and that my friend would have to take him to court. The next day four big guys showed up after the resident left for work. They moved all of the resident's belongings out onto the curb and helped me move in. The locks were changed and we all waited for the resident. He showed up, got mad and started threatening until the four big guys walked out. My friend said something to him quietly and his face went white. I never saw him again after that. It's nice to have friends who know powerful people in low places!

I've gone through this myself. On the day we went to court the people in the house never showed up in court and we got the eviction notice paperwork. Went to the house and they were GONE. And the house was trashed. Took us 2 weeks to clean it all up and re-paint and ... what a pain. The courts are upside down.
I wonder if setting your house as the physical address for an LLC you set up makes it count as a worse, or more actionable crime... it's insane this is ok. It's basically burglary where the burglars take the extra step and change the locks
They break in when you're away and start forging documents and sometimes even paying property taxes to get their names on the local records. Then it could be extremely difficult to get rid of them depending on the jurisdiction.

The court system is broken..it happened to me in Florida and took months to get them out and trashed the house with absolutely no accountability on the squatters...this needs to be fixed

It's more complicated than that. In criminal cases, often times it's a plea deal even if you are innocent. That's state or federal. When it comes to civil matters....it gets even murkier. Truth is, sometimes the moving party is favored (the gov't, landlord, plaintiff) and sometimes the defendant (criminal, squatter et al) are favored. It's not an all or one proposition.

I heard of a case when squatters invaded and held a home owned by a dog trainer. He came back that night with friends and 6 dogs who were turned loose in the house. Nobody ever invaded his house after that or anyone’s on the street. The Sheriff’s Dept cannot match this result and it’s what we the law abiding citizens need. Fast justice.

Honestly you can't blame the judge. He can only interpret the law as it currently exists. And apparently that state allowed some group of lunatics to write such outrageous bullshit into state law. In light of that the judicial branch can only interpret the law, and law enforcement only enforce the law, as it's written. Don't blame the judge or the police. Change the insane law. In Louisiana we would call such squatters "burglars" and they would be treated as such. I had a woman I barely knew and her boyfriend move into my home and getting them to leave turned into a nightmare. I told her she could stay two-weeks but it turned into 4 months and they laughed at me when I told them they had to leave. The cops couldn't do anything. I was appalled at the number of people who are in this situation.
Did you have to go through the eviction process, or did you make it unbearable to live there, to get them out. Blaring music into their room 24/7 does wonders.

No really. Look up squatters rights. They are technically looked at as tenants not paying rent and an eviction process through the court system. Each state is different, the the general process of getting rid of them is the same.

I had a woman renting my mom's house with a lease. As soon as my mom past away she stopped paying rent. It took me 21 months to get her out. My attorney drug his feet. In the mean time I was told not to go to the property and let the court handle it. Finally after all that time she was evicted and moved out on may 5th 2014. She took everything in the house including the light bulbs. The house was destroyed and all the doors busted and kicked in. Then found out from neighbors she and her son were selling crack and pot out of the house. No you tell me if the system is btoken. They are protected!!!!!!!!

Here's how it works: If you break into a bank and steal money, you are a thief. HOWEVER, if you break into a bank with a lawn chair, a microwave and a mattress, you are free to take whatever you want and can stay there for 8 weeks. At the end of those 8 weeks, you'll be given a stern talking to and as much time as you need to collect everything that you feel you need to take with you. No judgement.
I would personally have my paper work and everything I need to prove that is my place in the car and call in some friends and break into my own home and force the pathetic squatters out while doing so having someone change my locks if police come show them my paper work and inform I was defending my property from those trespassing on private property
If the police are presented with 2 sets of paperwork one a good forgery and the other yours, you and your friends go to jail. They will just arrest the people not in possession of the property if there is violence. The idea is that if some one does this to you while you are in possession of the home you are protected. They are just exploiting a system designed to protect property owners, only here it serves the opposite purpose. Con artists are not dumb, they know how to manipulate the system. Your best bet is media coverage if you can get it. Con artist are generally not fond of publicity.
This is why a realtor friend of mine always has someone waiting at houses as the old homeowners move out. That way no one has the ability to go squat before the new owners move in. She did, however, have one case where the old homeowners refused to vacate and the new owners had to take them to court for eviction. Luckily that went pretty fast and there was no damage to the house.
I recently had to deal with squatters that got into one of our vacant rental units (Orlando area). Police did finally extract them at gunpoint, but the mess they left behind ( including spent syringes) was all mine to deal with.
In the U.K. there would have to be proof they broke in. Without witnesses, they will just say the door was already open and it would not be possible to prove otherwise.

True, it is breaking and entering. You can indeed evict them. However, if you wait a super long time to evict them (like two years), they can gain legal possession through "adverse possession." These laws exist in all 50 states, they are designed to promote the productive use of land. The theory is that if you're too lazy to check up on your own property for two years, you deserve to lose it to someone who cares more about it than you do.
As frustrating as it is when eviction of squatters takes so long, those due process rights also protect the innocent. Dishonest landlords can't get away with calling the police and claiming that tenants with a lease are squatters.
I kicked squatters out of my father in-law’s house. Rented a dumpster, put all their shit in it and hauled it off. They told me what I did was illegal and brought the police. The cops came out and told them it’s a civil matter and took off.
Most landlords are afraid of getting sued and they want to keep all of their actions legal. The truth is that these pieces of 💩 don’t have the money or for an attorney and they want to stay as far away from court as possible.

In some state you can legally move into an empty house and make it yours and if the owner finds out you still got 3 months before police can forcibly evict you so any damage you have done to the house u don't have to pay, now you can repeat this again and again till you have enough money to buy your house. This is the strategy government have thrown out to public so that everyone can get their own house one day :)

It's the same concept everywhere. The squatters pretend to be tenants. They print out/buy a generic lease and fill it out (basically making an illegal contact the homeowner knows nothing about). Once homeowner finally figures out someone's living there, they have to prove they never signed a lease (aka a legally binding contact) with the squatters and go through the eviction process as if they're normal tenants. The reason I think it takes so long is because there are scumbag landlords out there too and some would abuse a law that would allow them to boot real tenants when they actually signed a lease. The whole situation sucks, honestly. 🤷🏽

You do realize that they were living there for years and paying all the utilities and property taxes? In my state to have squatters’ rights you must live in the house for at least 15 years while taking care of the property. That’s why you must evict them. It’s not like someone broke into your home while you were shopping and now you have to evict them. It’s when you abandoned the property then someone moves in without letting you know. The problem lies with the owner letting them live there for years and letting them pay for the property taxes, that’s why they have rights. Basically it’s living in a house rent free. It can easily be avoided if the proterty owner doesn’t abandon it for years.
@@TheKingOfTrolling If the owner cut the utilities off, it's because they didn't want to pay fees on an empty house which is their right. They may have wanted to rent it out later, their choice. And you don't know if the trespassers were paying the annual taxes and school taxes or not. The tax notices would have been delivered to that address but in the OWNERS name. And it sure didn't look like they were living there for years, as all they had to sleep on was mattresses. Just because someone is not living on a property they own doesn't mean they have "abandoned" it - they may have plans for it. It's not your option to say, one way or other. It's theirs.

If you come home to the house, you legally own find Intruders inside you take care of The Intruders, and then you call the cops. It's not squatting it's 100% theft. Since the city or state allows us to go on, I think the homeowners should be allowed to sue the state for any damages that occur.
In our town, all you have to do is call the utility department. They will send someone out. Without a valid lease by the home owner they can not have gas or water, even if they pay the bill. The bill has to be accompanied by a signed lease from the homeowner. Without that it is called "theft of services" and they will go out and shut the water and gas off.
In florida the squaters will call code enforcement on themselves to force the owner to turn on and pay for services/ utilites. I was in this position and I could pay $50 per day lien against my property or I could pay $350 per month in utilites. I paid for the water while they squatted and they let it run intentionally.
exactly. This is why you always have to have somebody watching the house. With a few days squatters can get the utilities put their name and your locks changed and they have set up residency. But before they do those things they are simply trespassing and can't even claim squatter's rights and you are fully within you're right to shoot them if they're in your house, and you have reason to believe you are unsafe.
What I believe the story leaves out is, I think they were renters who stopped paying the rent. Someone just breaking in and living there would be trespassing, plain and simple. Bad renters are a HUGE pain in the ass to deal with in situations like this.
Screw the courts street justice works better for people like this. Law favors criminals over the citizens. This happened to my brother once. He cut power and water to the house, made it so only the owner could re-activate it. They still did not leave. He waited for them to park their cars in the driver way and he parked a filled concrete truck(AKA scrap heap - when enough concrete dries in a concrete truck, the vehicle is totaled) in front of the driveway, effectively making their cars useless. That is what made them get out. They tried to get the concrete truck removed but he called every tow company in town and told them he is the owner of the house, if the tow it, he will sue them and have them charged with auto theft. They listened to the threat, sure enough the squatters called every tow truck company in town, and got turned down. One day later they packed up everything they had and left. But my brother made them clean the whole house before they left, or else he would leave the truck there and make their cars useless. Afterall it is hard to get to work, move, or even get around without a car. His house is 4 miles from a bus stop, so walking to take a bus was a bad option. Not impossible, but a pain in the ass in 80 to 110 degree weather, the house is in Arizona.

@@johnluke6122 They are not tenants, they are squitters. There is a difference, legal law is garbage on the issue and confuses the two in most states. But a squatter comes into an abandoned house and just moves in, like they own it for free. Tenants pay rent and sign a contract. If a tenant does what you talked about they can get kicked out for breach of contract in the rental. If you own the house or place yourself, no one can say anything about you living in your own shit. If you rent a property and leave it like you mentioned then you will lose your security deposit when you move out. They can even sue you in a civil lawsuit for damages to the property over the security deposit.
I wonder if as the owner you could go and remove the front and back door, windows, etc and just say you're renovating. Have a crew come in and disable the furnace under the pretense of fixing it.

The same problem exists in Spain. If you don't report the squatters within 48 hours you need to go to court. Newest development is that you hire an anti squatter team. They simply wait for the squatters to leave the house - go shopping or whatever - and then they reoccupy and prevent the squatters from reentering the house.
Sounds brilliant, and not doubt they'd get very quick results if the members of the anti-squatter team were the size of the local motor cycle gang members.

If I come home from work and somebody is IN my home he clearly has broken into it since he has no key and my lock cannot be pulled out with the usual methods since I have a 2020 built house with RC3 security class doors and windows! so I will call the police and report a burglar! what is he gling to do?! he CANNOT show the police the ownership papers of the land - since the plot of land and it's number and stuff is unknowm to them! and only see-able for me as the owner or people who are able to have insight like authorities! In the process some squatters (gained access) and when I was notified showed me faked paperwork from an address I had literally years ago that said they were renting from me. I initially called the police but they wouldn’t come deal with it. So I did. A couple weeks later they were arrested on other charges and their taking over of our home was added to their sentencing. Somebody that has access to personal information is (helping) these dirtbags
I pray in advance for the soul of anyone who attempts to move into my home while I'm away. If they refuse to leave, then I will remove the threat of arrest from the table. The only remaining options will be a closed casket wake or cremation.

My brother went through it. He rented an apartment in his house. She stopped paying rent. He lost thousands of dollars. FINALLY after almost a year, she had to leave. He had to get a lawyer and go to court. And she still didn't pay him back. The system favors the criminals.
There is a new business starting up "Squatters for hire". It's a group of ex-military that you pay and let move in your property with the sole purpose of removing squatters. You would be amazed at how fast they leave.

My uncle had this happen to him one time. He lived in Pennsylvania and was gone for a month. He came home and squatters had moved in and changed the locks. He went to the shed in the back yard that still had his padlock on it and got his chainsaw. He removed the back door from the house with that chainsaw and for some reason the house emptied out within about 20 seconds. They never came back.
This made my day. Uncle was fixin' to go chainsaw on that ass 🤣.

I was supposed to move into a home I rented. I had already switched the utilities into my name and when I showed up the resident said he decided not to move. The landlord, a friend of mine, didn't know anything about that. He confronted the resident who said he wasn't leaving and that my friend would have to take him to court. The next day four big guys showed up after the resident left for work. They moved all of the resident's belongings out onto the curb and helped me move in. The locks were changed and we all waited for the resident. He showed up, got mad and started threatening until the four big guys walked out. My friend said something to him quietly and his face went white. I never saw him again after that. It's nice to have friends who know powerful people in low places!

I've gone through this myself. On the day we went to court the people in the house never showed up in court and we got the eviction notice paperwork. Went to the house and they were GONE. And the house was trashed. Took us 2 weeks to clean it all up and re-paint and ... what a pain. The courts are upside down.

Truth is, sometimes the moving party is favored (the gov't, landlord, plaintiff) and sometimes the defendant (criminal, squatter et al) are favored. It's not an all or one proposition.

I heard of a case when squatters invaded and held a home owned by a dog trainer. He came back that night with friends and 6 dogs who were turned loose in the house. Nobody ever invaded his house after that or anyone’s on the street. The Sheriff’s Dept cannot match this result and it’s what we the law abiding citizens need. Fast justice.

I had a woman I barely knew and her boyfriend move into my home and getting them to leave turned into a nightmare. I told her she could stay two-weeks but it turned into 4 months and they laughed at me when I told them they had to leave. The cops couldn't do anything. I was appalled at the number of people who are in this situation.

I had a woman renting my mom's house with a lease. As soon as my mom past away she stopped paying rent. It took me 21 months to get her out. My attorney drug his feet. In the mean time I was told not to go to the property and let the court handle it. Finally after all that time she was evicted and moved out on may 5th 2014. She took everything in the house including the light bulbs. The house was destroyed and all the doors busted and kicked in. Then found out from neighbors she and her son were selling crack and pot out of the house. No you tell me if the system is btoken. They are protected!!!!!!!!

YES - the displaced home-"OWNERS" that the judge decided AGAINST in their court/jurisdiction.
Here's how it works: If you break into a bank and steal money, you are a thief. HOWEVER, if you break into a bank with a lawn chair, a microwave and a mattress, you are free to take whatever you want and can stay there for 8 weeks. At the end of those 8 weeks, you'll be given a stern talking to and as much time as you need to collect everything that you feel you need to take with you. No judgement.

If the police are presented with 2 sets of paperwork one a good forgery and the other yours, you and your friends go to jail. They will just arrest the people not in possession of the property if there is violence. The idea is that if some one does this to you while you are in possession of the home you are protected. They are just exploiting a system designed to protect property owners, only here it serves the opposite purpose. Con artists are not dumb, they know how to manipulate the system. Your best bet is media coverage if you can get it. Con artist are generally not fond of publicity.

This is why a realtor friend of mine always has someone waiting at houses as the old homeowners move out. That way no one has the ability to go squat before the new owners move in.
She did, however, have one case where the old homeowners refused to vacate and the new owners had to take them to court for eviction. Luckily that went pretty fast and there was no damage to the house.

I recently had to deal with squatters that got into one of our vacant rental units (Orlando area). Police did finally extract them at gunpoint, but the mess they left behind ( including spent syringes) was all mine to deal with.
In the U.K. there would have to be proof they broke in. Without witnesses, they will just say the door was already open and it would not be possible to prove otherwise.

Laws need to be changed. How stranger's can just take over people's homes like this is unacceptable. It has happened to friends of ours and it took forever and the did thousands of dollars in damage. It's criminal!!!

True, it is breaking and entering. You can indeed evict them. However, if you wait a super long time to evict them (like two years), they can gain legal possession through "adverse possession." These laws exist in all 50 states, they are designed to promote the productive use of land. The theory is that if you're too lazy to check up on your own property for two years, you deserve to lose it to someone who cares more about it than you do.
As frustrating as it is when eviction of squatters takes so long, those due process rights also protect the innocent. Dishonest landlords can't get away with calling the police and claiming that tenants with a lease are squatters.
They should really come up with a law protecting people against these kind of crimes.

I kicked squatters out of my father in-law’s house. Rented a dumpster, put all their shit in it and hauled it off. They told me what I did was illegal and brought the police. The cops came out and told them it’s a civil matter and took off.

I'm shocked that the laws on squatters hasn't changed over the years. For people to have to treat squatters as if they're tenants is beyond ridiculous. In some state you can legally move into an empty house and make it yours and if the owner finds out you still got 3 months before police can forcibly evict you so any damage you have done to the house u don't have to pay, now you can repeat this again and again till you have enough money to buy your house. This is the strategy government have thrown out to public so that everyone can get their own house one day :)

It's the same concept everywhere. The squatters pretend to be tenants. They print out/buy a generic lease and fill it out (basically making an illegal contact the homeowner knows nothing about). Once homeowner finally figures out someone's living there, they have to prove they never signed a lease (aka a legally binding contact) with the squatters and go through the eviction process as if they're normal tenants. The reason I think it takes so long is because there are scumbag landlords out there too and some would abuse a law that would allow them to boot real tenants when they actually signed a lease. The whole situation sucks, honestly. 🤷🏽

You do realize that they were living there for years and paying all the utilities and property taxes? In my state to have squatters’ rights you must live in the house for at least 15 years while taking care of the property. That’s why you must evict them. It’s not like someone broke into your home while you were shopping and now you have to evict them. It’s when you abandoned the property then someone moves in without letting you know. The problem lies with the owner letting them live there for years and letting them pay for the property taxes, that’s why they have rights. Basically it’s living in a house rent free. It can easily be avoided if the proterty owner doesn’t abandon it for years.

@@TheKingOfTrolling If the owner cut the utilities off, it's because they didn't want to pay fees on an empty house which is their right. They may have wanted to rent it out later, their choice. And you don't know if the trespassers were paying the annual taxes and school taxes or not. The tax notices would have been delivered to that address but in the OWNERS name. And it sure didn't look like they were living there for years, as all they had to sleep on was mattresses. Just because someone is not living on a property they own doesn't mean they have "abandoned" it - they may have plans for it. It's not your option to say, one way or other. It's theirs.

If you come home to the house, you legally own find Intruders inside you take care of The Intruders, and then you call the cops. It's not squatting it's 100% theft. Since the city or state allows us to go on, I think the homeowners should be allowed to sue the state for any damages that occur.

In our town, all you have to do is call the utility department. They will send someone out. Without a valid lease by the home owner they can not have gas or water, even if they pay the bill. The bill has to be accompanied by a signed lease from the homeowner. Without that it is called "theft of services" and they will go out and shut the water and gas off.
Those losers will still remain in the house, though.

In florida the squaters will call code enforcement on themselves to force the owner to turn on and pay for services/ utilites. I was in this position and I could pay $50 per day lien against my property or I could pay $350 per month in utilites. I paid for the water while they squatted and they let it run intentionally.

But before they do those things they are simply trespassing and can't even claim squatter's rights and you are fully within you're right to shoot them if they're in your house, and you have reason to believe you are unsafe.

Screw the courts street justice works better for people like this. Law favors criminals over the citizens. This happened to my brother once. He cut power and water to the house, made it so only the owner could re-activate it. They still did not leave. He waited for them to park their cars in the driver way and he parked a filled concrete truck(AKA scrap heap - when enough concrete dries in a concrete truck, the vehicle is totaled) in front of the driveway, effectively making their cars useless. That is what made them get out. They tried to get the concrete truck removed but he called every tow company in town and told them he is the owner of the house, if the tow it, he will sue them and have them charged with auto theft. They listened to the threat, sure enough the squatters called every tow truck company in town, and got turned down. One day later they packed up everything they had and left. But my brother made them clean the whole house before they left, or else he would leave the truck there and make their cars useless. Afterall it is hard to get to work, move, or even get around without a car. His house is 4 miles from a bus stop, so walking to take a bus was a bad option. Not impossible, but a pain in the ass in 80 to 110 degree weather, the house is in Arizona.

But a squatter comes into an abandoned house and just moves in, like they own it for free. Tenants pay rent and sign a contract. If a tenant does what you talked about they can get kicked out for breach of contract in the rental. If you own the house or place yourself, no one can say anything about you living in your own shit. If you rent a property and leave it like you mentioned then you will lose your security deposit when you move out. They can even sue you in a civil lawsuit for damages to the property over the security deposit.

The same problem exists in Spain. If you don't report the squatters within 48 hours you need to go to court. Newest development is that you hire an anti squatter team. They simply wait for the squatters to leave the house - go shopping or whatever - and then they reoccupy and prevent the squatters from reentering the house.

Our situation. We were moving out of one house and into another. In the process some squatters (gained access) and when I was notified showed me faked paperwork from an address I had literally years ago that said they were renting from me. I initially called the police but they wouldn’t come deal with it. So I did. A couple weeks later they were arrested on other charges and their taking over of our home was added to their sentencing. Somebody that has access to personal information is (helping) these dirtbags

My brother went through it. He rented an apartment in his house. She stopped paying rent. He lost thousands of dollars. FINALLY after almost a year, she had to leave. He had to get a lawyer and go to court. And she still didn't pay him back. The system favors the criminals.
