They aren't racist. The company made a mistake and they should pay up.
If they'd accidentally put another white man's sperm in her she'd never have known and just lived her life. There may not be racism on her part but race has a part in this. As a minority herself she should get that. Racism doesn't have to be at the heart of a race issue in order for a person of color to feel hurt.

Gem_Gem7 But the intrinsic issue isn’t the baby being mixed race. If the non-biological mother were black, I’m sure they would have actively wanted a mixed-race child. I’m adopted and it is easier when adopted children look as much like the parents as possible. It’s tedious and kind of invasive always having to explain it.

If she were only upset about the mistake, though, it would be a private lawsuit, without the traumatizing coverage (and dramatic teary interviews) this kid is going to discover online someday.

It's not about the baby, they clearly said they love their baby and they do not care about the race. They are suing because of the mistake (CAUSE IT IS) from the sperm bank. You are paying an enormous amount of money for something very important, you are carefully choosing the donor for months just to know that they mixed it up and you do not know the background of the donor? I'm sorry, but that is pretty serious and they should be held accountable. You do not know if the donor had any illnesses that could be passed to the babies born with his sperm. Think about it again, it's not racism.
@Ms. Oyeogbe It's definitely an inconvenience and they weren't ready for this to happen. I'm sure they don't mind moving somewhere else for their kid's well-being but it's still something they didn't expect. So they spent a lot of money on the pregnancy and now they have to spend more in order to move out. I'd be furious.
@@721rena its not racist, if it were two black people and they picked and paid for a particular sperm from a black donor and they were impregnated by white sperm that would be likely as much of an issue. Just like if two people one white (the one to get pregnant) and a black person picked and paid for black sperm and they were given white it would likely be as much of an issue. It is about negligence, responsibility and accountability.

For some biracial children they have a difficult time fitting in. I am black but biracial passing and I've dealt with problems on both sides of the spectrum. She's not racist for what she's doing. It's very hard for adopted kids too or kids that don't look like their parents... But to add to that her parents are a LGBT couple.. I'm not against any of these things but a lot of these things add to hardship for child and parent. It's definitely something you have to be prepared for.

That was what I was thinking. Like what if you had a specific individual (your brother) donate so your partner could get pregnant and they mixed up the samples. That is clearly malpractice. How is this different? You can still love the child, but still feel there needs to be consequences for the mistake .

Regardless of what race the father is, I would feel violated if the wrong sperm was put in me. They give you portfolios and background checks on the potential candidates; she obviously didn't get to look at this guy's.
@@sanjon2778 actually, with ivf they usually meet formally and the receivers get a detailed portfolio of the donor's history, health, appearance, background, and more essential information. It's not fair to the couple at all what happened and the clinic performed malpractice.

@@josiep1547 - I'm pretty sure she can still get access to all of the information about their current donor once the clinic informed her of the mistake. I don't see why they couldn't meet the current sperm donor if they wanted to. Also, that sperm donor also went threw the same background check and process and the other one, so I'm pretty sure his information should be accessible. Their daughter is 2 years old; they have probably already met with the current sperm donor or at least know more about him than just his race I would hope.
@@Arri7979 it's still malpractice and if the biological mother had any genetic issues which are recessive and could be passed on, it's her choice if she wants to avoid those being expressed in her child. Take Tay-Sachs for example, recessive and people who carry the gene often have to be careful about who they have children with.

Im shocked that theyre only suing for 50k... Kids cost an avg of 233k. I'd sue for 300k and use it towards getting my kid a better house, college savings, life insurance and Disneyworld. Idk how moving to another neighborhood with only 50k is going to do.
Aventicity They mean over a few years. Raising a child for 18 years is expensive and you continue to spend on them even after that stage. 50k is peanuts, that doesn’t cover anything in the grand scheme of things
@Aventicity No. Usually in our current society raising any child is expensive. Data shows that to raise a child until they are a legal adult it can cost upwards to 300,000 dollars. This changes based on the type of parents, how involved the child is in activities and their diet. But usually it is around 250,000-300,000

Hey! People who are calling them “racist” let me explain why that logic doesn’t make sense. They said it themselves, they love their little girl. The problem is that they were mislead about their donor - they didn’t have the opportunity to thoroughly screen him. They knew nothing about him (e.g. health issues). This mistake could have well costed them their child. This type of thing was a huge problem a while back because men were donating without disclosing health issues (e.g. mental illnesses like schizophrenia and life-debilitating ailments).

I don't blame her. That her daughter and she loves her dearly but the sperm bank made a HUGE mistake that shouldn't go unseen. Just bc she is unhappy with the spermbank itself, doesn't mean she's unhappy with her precious daughter.

Think of what all could play into this other than just the color of the girls skin. It’s not always about the color of the person. Sperm was out in her from someone who she didn’t know the medical history of. That’s a pretty big enough deal to sue to me. The color of the girls skin only simply pointed out the fact that the company made a mistake that definitely shouldn’t go unnoticed.
If these women raise that beautiful little girl with love, she'll understand as an adult. Choosing a sperm donor is such a lengthy, incredibly personal process. She has different DNA, a different family medical history, etc. Good on them for suing, hopefully it will prevent this from happening to someone else.

When I made the post, I looked at it from the position of the beginning of it all for her. However, looking back at it, this girl is a few years old already. She does the best for her child, according to her own POV. The daughter will see this and feel she is a burden for the mother. Maybe, she senses it now.
If two Chinese (East Asian) couple requested sperm from their own race of East Asian- and received an African child, biracial child, a European child- they would be upset. This is a justified complaint and the clinic needs to be held responsible.

angi linaballerina Being a mixed person myself I can tell you it's not easy finding someone to do my hair, white people don't have any idea what to do and black people kinda know what to do but they mainly rely on braids so after awhile we found Dominicans to do my hair and they're really good! Thankfully we have similar enough hair so they knew how to handle my hair. But not every mix person have the same type of hair because they could leave variously on the scale.

Until that moment I had no idea how clueless we tend to be as white people. These kids said that time after time, their caucasian sides of families were not prepared to address both sides of their heritage, and acted like their blackness didn't exist. I know we think it's racist of her to complain, and I don't know what her best answer would be, but I hope she gets to know some people who can help her make sure that that child feels respected for everything she is, and knows some black people, too. We tend to be two segregated as it is. Opportunities are not given equally to everybody and that's one thing we are just now coming to realize. I would love some feedback from biracial people who could answer this with their own first-hand experiences. Anyone?

Plus, accepting of lesbianism does not necessarily meaning accepting of biracial children you know. Those are 2 different things. One thing I know is people who are very accepting and nonprejudicial about some things can be the reverse on other issues. I also get the haircut issue. My daughter grew up with a biracial friend who in her case, her parents had been married when she was born. Her mother, 20 years ago had to pay $40 and up for her haircuts as her hair was a mass of beautiful curls, but was so bushy it took a lot of razor thinning out for her hair to look presentable; and her mother did this because she understood her 13 year old daughter did not want to wear her hair in braids like she was still a little girl.

I share your view that yes, even if their intention is right in filing this case and its clear that they love their baby, i cant imagine how their daughter will feel about this when she finds out. They will have to explain it to her good and well. But then again, there really is medical malpractice in this case. And that is not ok and it should not happen again. @@yanii7245 - You do realize not just anyone can be a sperm donor right? Many clinics have specific requirements and qualifications a donor must pass before he can donate his sperm. Now, I don't know the specific standards this clinic had, but many clinics will not accept sperm from an unhealthy or sick male, a male that is too old, or a male who may have a history of addiction to drugs that could affect the health of his sperm. Again, I'm not sure about this clinic specifically, but I'm pretty sure this clinic has standards. Why assume the worse of this sperm donor? They could look up his file if they were concerned with his background past his race.

There are salons near me that will not do ethnic hair - not just black people's hair, but Hispanic too. There are shops that only do ethnic hair and that's where black people go for sure. They have told me that white people do not know how to do their hair. I am not sure about the why not of that, but I'll take their word for it. Whatever makes them happy.

I grew up mixed race in a white family. Even though my family never made a big deal about me not being white I was INCREDIBLY insecure because I didn't look like them. My hair is not like theirs. First off, that little girl is gorgeous. Second of all, her lawsuit is valid, what she is asking for isn't outrageous given the cost of ivf and a donors sperm, and she's doing it for the right reasons wanting to move to an area where their girl can be around a more diverse and less judgemental community. I'm late to the party but I don't agree. Has nothing to do Not being wanted at all. A truly good mother would do everything possible to ensure the child has the best and right out the gate. Accommodations must be made immediately so to avoid the child feels like an outcast, even as simple as a haircut. It's crucial she is brought up in area where it's diverse and mixed and is able to feel she can identify with other kids that look like her, even just one and in Midwest, from what mom says, there is none. These unexpected new responsibilities have now been placed upon her and this is where the company should now have to pay for it so the child will be well rounded and well adjusted with no serious insecurities due to this mix up. But there are valid reasons to sue. What if they had chosen that specific donor also for health reasons? The sperm bank mixing up the vials could have resulted in an inherited genetic disorder or other complications. There's a reason that people have to _choose_ a sperm donor instead of being given the next available vial of sperm.
Also, given that they did, in fact, move to a more diverse neighbourhood, I don't think the girl will be very mad at her mother. Sure, it's not the most pleasant backstory, but the mother seems like she's thought about the issues in this situation a lot, so she's probably going to be quite good at explaining it to her daughter.
Yes she loves her daughter but as she said, even getting that child haircuts is more expensive. Mixed hair is not like black hair or white hair. it takes a lot more maintenance. I know over 20 years ago my friend paid $40 and more for her daughter's hair cuts because although her daughter's hair was a beautiful mass of curls it was very bushy and i took a lot of thinning out by razor which cost a lot of money. She also tried relaxing her daughter's hair chemically but it broke off terribly because the chemicals were to strong since her hair was not "black" hair. Once a girl gets in her teen years she is not going to like having to wear her hair in braids all the time because Mom can't afford to get her hair thinned. Then there was a whole other issue with this poor girl. when her mother remarried her step father was white and her real father had little to nil contact so this girl grew up not knowing how to be "black" since all her family, relatives,etc.that she had contact with were white. when she married, her husband was like her, mixed but in his case raised by white grandparents. Those two are happy together so far, but they both have identity issues so who knows what the future holds for them.

She could have got way more and she should get way more, because after the attorney fees she will only leave with half that, which is probably about what it cost to have in vitro and buy the sperm in the first place. Hence after paying for having the baby she won’t really make anything off the lawsuit. She will just come out of it with a free child basically.
Honestly in vitro fertilization is very costly, and anyone who works in health care knows how much we try to avoid making mistakes by double checking etc ...the baby is beautiful and somewhat lucky to have been born to more open minded parents who won't mistreat her based on her color. But she is right to sue, this kind of mistakes should not happen, because the true sufferer would only be the baby.

A little water (blot with towel)/a little oil (almond oil, argan oil are the best for mixed hair) or leave-in conditioner or curl activator (Cantu is the best or Nature's Best brands)/brush her hair or comb (wide tooth)/ and put in sectioned braids or pony tail...voila!
When she is older she can decide to cut it or not..I just realized they don't have to travel far for this, they just do not know how to care for her (just yet)...🙏

Being an African American. I can understand what they r going through. When u haven't been raised in a diverse environment it's hard to adapt. When u take a black kid and all they know is being around African Americans and take them and move them to an all white school it would be hard to adapt. It all depends on how a person was raised and being taught to have an open mind as well. Am I accusing this woman of not being open minded no but I'm sure it's a culture shock. U can see it on her face she can't deny her own child but this is not what she signed up for. We are living in 2018 and people still look at biracial couples as if they r weird for being together. When u have an all white family no one stares when u have an all black or Asian ect race no one looks really. But as soon as a different race has a child that doesn't fit the race they are walking with at that time people stare and if u r not use to that it makes u feel uncomfortable. Not all African Americans are prejudice not all Caucasians are prejudice. But their are some that pass judgement give looks to a white person or black person when they are out of their element that's the best way I can describe that. But the same is done to other races when they r in a place that u don't normally see them. And the looks u get. Sometimes it's hard to embrace what u don't know or don't or haven't been taught to understand. And to be flung into a world that u weren't raised in it's I'm sure hard for them. I have been a baby sitter for Caucasian children and I had gotten so many stares so many questions why I had those children. I had to learn how to comb their hair how make it lay down. That was different. So I don't pass judgement on this lady at all. This is a culture shock and she didn't sign up for that. But that is her baby she will love her regardless.
I get it. They messed up but I think at this point she really shouldn’t be suing and especially making this public. Because like it or not this will have an impact on the child’s psych when she finds out her parents fought and demanded money from the people who “messed up” and gave her to them instead of a white baby. Her parent’s faces and her own skin will be a constant reminder. Didn’t have to be. But the fact that they’re suing is them publicly saying she was a mistake.
Tbh I like money. I may have done the same thing given the circumstance but I would’ve kept it super hush hush. I would definitely never want my daughter to find out what I did. Maybe you missed the part when they talked about moving to a more "Ethnic neighborhood " meaning that they're in a white neighbourhood and having a mix child does not sit well amongst certain folks. Many inconvinient adjustments have to be made to ensure proper upbringing and safety of that child. And since they payed a lot of money and didn't get what they payed for is only fair and a right to demand compensation.They clearly love their child but is not going to be easy, since racism is always raising it's ugly head.

I have two mixed nephews whom I love and adore. My son is half Mexican and I'm white and Hawaiian. Thankfully here in South Louisiana no-one cares about race for the most part. I'm a mixed race woman and I completely understand. When you get that kind of money, you should get what you paid for. Also, people going to those lengths to have a child typically want one that in some way resembles them or their partner. People have to think with our emotions. Humans are emotional beings, and we can't be deprived of that. With that said, emotion is not the opposite of logic, we use them together, balanced, so that we can come to an intelligent conclusion. Their daughter will grow up with low self esteem and feel unloved because of this. Children are very delicate and special, you handle them with care, they must love themselves, otherwise they will develop into sociopaths with personality disorders that cannot function properly.

I hate that this Blk child ended up where it wasn't wanted. That's the fault of the sperm bank, not the YT couple. The sperm bank should pay for the mix-up. But it sucks being in a family who sued a company simply just because you exist. It may not be racist, but it shows very low character and a lack of concern for the baby.
