Using methods that are not legislated

South Africa's public sector currently has some flexibility to use methods that have not been described in legislation. This discussion opens with a summary of the legislation that exists under the PFMA and then walks through the requirements to use methods that are not specifically mentioned in PFMA regulations nor Instructions. Shaun Scott takes a view of the conditions described in PFMA and PPPFA before providing a summary of the conditions for using methods such as contests, competitive dialogue, two stage bidding etc.
