I wold like to know if I was awarded a tended receiving the award letter April 2023 and he MoU in December 2023 attend numerous meeting and requesting how many candidates will be on the program and I was kept been told its demand driven. We had a dry run in February in 2024 and a huge presentation in the from of the students the DDG and DG etc. During the presentation the students told us the training was done internally in 2022 when we were supposed to do the training. After been told its to start about 288 students as a SMME coming out of COVID we needed bridging finance which we we trying to get with various institutions.They indicated our Company registration number was incorrect with a number swapped and that we needed a PO number upon raising this we received a letter of the our tender was in the process of cancellation and this without and consultation/mediation. Please can you advise on my rights.
Difficult to understand all the issues here. If the award letter had any conditions in it such as subject to bridging finance, subject to issue of a purchase order, subject to MOU being signed etc, and any of the conditions were not fulfilled/satisfied, then there is no award.

I almost got scammed, they had ordered almost 50 items for 10k each, very promising, with sbd forms with letterheads but after watching the video I realized that it was a scam as they had provided a specific code and had meticulously specified what they wanted which was only available at one supplier in SA who was also very professional and provided a prompt quotation with free delivery too. Its sad that businesses are scammed everyday, Its really said and one doesnt know where this ends

Current legislation PFMA 16A.4 states: Establishment of supply chain management unit: “The accounting officer or accounting authority must establish a separate supply chain management unit within the office of that institution’s chief financial officer, to implement the institution’s supply chain management system”. This may change under the new Public Procurement Bill.
wow, Adv Ntsaluba nailed it, the alignment of organisational strategy to this process that SCM is undertaking. So listening to colleagues now, it is clear that SCM is making decisions around what is the transformation agenda of organisations without the core functions of the organisations taking part. it is going to be interesting. lets hope that whatever is developed will infact be in line with the APP's and the pronouncements that the political principals make out in the public.
Section 217 (2) and (3) of the Constitution states: “2. Subsection (1) does not prevent the organs of state or institutions referred to in that subsection from implementing a procurement policy providing for: a. categories of preference in the allocation of contracts; and b. the protection or advancement of persons, or categories of persons, disadvantaged by unfair discrimination. 3. National legislation must prescribe a framework within which the policy referred to in subsection (2) must be implemented.” In terms of section 9(2) of the Constitution, it is stated that “Legislative and other measures designed to protect or advance persons, or categories of persons, disadvantaged by unfair discrimination may be taken”, but it does not advise as to whether one category of persons will receive a more preferential status than the other when such legislation is enacted. The Constitution in Section (9) provides an all-inclusive list of categories of persons and that the Act only chose to include three of those categories and that each one carries an equal status. (“race”, “gender” and “disability”) Section 2(1) (d) of the Procurement Act clearly state that 'specific goals'' include two things. The first is the promotion of previously disadvantaged persons (which is B-BBEE), and the second is implementing RDP programmes. The reference to protection or advancement of persons, or categories of persons disadvantaged by unfair discrimination refers to B-BBEEE and the primary purpose of the BBBEE Act and the Codes is to address the legacy of apartheid and promote the economic participation of Black People in the South African economy. Section 10(1) (b) of the BBBEE Act, stated in peremptory terms, obliges every organ of the state to apply any relevant BBBEE code in the development and implementation of its preferential procurement policy. Section 2(1)(d) does not make a distinction as to whether one category of persons should be afforded a higher consideration or preference status within the allocation of points for “Specific Goals”. With the organs of state now charged with the responsibility to implement their own procurement policies, the biggest challenge will be the correct interpretation and application of preference points for each “Specific Goal” as listed in section 2(1)(d) of the Preferential Procurement Policy Framework Act of 2000. Giving more points for an HDI, based on the person’s race and award fewer points for a person being a woman or disabled constitute discrimination. The presiding then begs the following question, is the discrimination fair or unfair? The answer to the above will determine if the policy is in line with S9(3) of the Constitution which states that “S9(3) The state may not unfairly discriminate directly or indirectly against anyone on one or more grounds, including race, gender, sex, pregnancy, marital status, ethnic or social origin, colour, sexual orientation, age, disability, religion, conscience, belief, culture, language and birth.” By: Vuyo Ninzi Date: 20 November 2022 NB* these are my personal views on the current raging debate in the country and should not be attributed to any organisation. The attempt is to enrich debate and also to try and assist in finding a solution to this uncertainty going to 16 January 2023.

Great session. I like how Walter set the scene and context of a tender validity period in the procurement process. It is not just a thumb-shucked number of days but linked to planning the whole tender process (pretender process). If procurement professionals took planning seriously as it should and use historic intelligece, we could minimise challenges, such as in this case.

On 30 May 2022, The Constitution Court confirmed that the suspension period initiated by the Supreme Court of Appeal continued from 16 February 2022. The 2017 Preferential Procurement Regulations therefore are valid and must be complied with until 25 January 2023.

The organs of state have complete discretion on what they include in their Preference Policies and must not be limited by the Regulations. Organs of State can include functionality in their policies
Prof, is it not now "necessary or expedient" for the minister to draft and issue preliminary regulations to cure the position from the time of the judgment till the lapsing of the invalidity period prescribed by the judgment?
Good question Thabani. This will certainly be challenged i the feedback to National Treasury on the Draft 2022 Regs.

Based on a number of points of view, it seems that the suspension period instituted by the SCA kicked in last week when the CC handed down its judgement. Informally I have heard that the minister is considering asking the CC for clarity on this. It may be that the status quo therefore remains.
