Receiving a Zoning Variance in NYC

  • A zoning variance is a special approval to develop a property in a manner that is not 100% in compliance with the applicable zoning codes. In NYC these are discretionary applications that must be approved by the board of standards and appeals.
    In this video I will review the requirements and process for obtaining a zoning variance from the BSA and use one of our projects that was approved as an example. The example project is a Townhouse development in Astoria Queens within an R5 Zoning district. The zoning resolution required a side yard, but we were able to obtain a zoning variance and develop without a side yard.

      DOB approval will be easy in comparison to BSA.

    Jorge, thanks for your video. You had skipped over the hardship caused by owner section. Our property sold it's air rights 50 years ago which capped our FAR to what existed at the time. Hindsight is 20/20 but it was a stupid deal. Now we want to add a 210 square foot storage area to our rear yard but may not be able to do so without a variance. Does this qualify as a hardship caused by owner?

      No. Article 7, 72-21 (d) ..."the practical difficulties or unnecessary hardship claimed as a ground for a variance have not been created by the owner or by a predecessor in title; ****however, where all other required findings are made, the purchase of a zoning lot subject to the restrictions sought to be varied shall not itself constitute a self-created hardship;"

    Jorge, why does it take 2 years for this process? We have a site in the Bronx comprised of 5 lots (an entire block) in Mott Haven that we are trying to develop. Any advise?

      It could be less than 2 years if you need a variance but it won't be much less.

    How often do developers in NYC pursue/receive zoning variances? I know in Boston virtually EVERY project requires a variance. I've been trying to understand how this process works in other cities around the US.

      I do not have any statistics for you, but in NYC a Variance is a long, complicated, expensive, and uncertain process.

    What’s kind of discouraging is you’re at the mercy of these peoples’ moods and biases even with their laws and statutes in place.
