I can see selling from person to person but you bought this from a legit auction company. The auction failed to do their job and since you have the documents and are asking for them to look into this, why would they charge you? If it’s stolen, you can prove you bought it from auction company and they may be in the hook.
yea but you have the proper paper trail. any public defender would tell you the DA would never pursue a case with a payment/dealer history like yours.. to put this in perspective... i just had a felony assault charge thrown out of court and my case was much harder to prove than yours.. don't sweat it man. just take care of it.
Can you apply for an Abandoned Vehicle Title? I live in Arizona and when I purchased a vehicle from California via an auction, all I had was a bill of sale. I applied for an abandoned vehicle title and then obtained a bonded title. Paid $250 and was able to have it titled and registered. Sold the vehicle 3 years later without an issue.
Randy, I used to work for an auction company, and if they sold a car and there was an issue with the title , then it was the auction companies responsibility to fix the problem or buy the car back , it's not the buyers duty to fix the issue, otherwise you can sue them if they don't fix the issue
He’s right if they didn’t have the right to sell the car the need to unwind the deal. Not having a valid title means they have no valid ability to sell it.
As a 23 trooper/detective, I totally disagree with you about being charged with possession of stolen property. I have had many people I have encountered with what turned out to be stolen property. I take into account the totality of the circumstances. If you have the documentation we would never charge you and no prosecutor is going to waste their time to prosecute. Now the property will be seized pending investigation. We deal with this stuff all the time…especially ATVs.
He needs to take it directly to the police department on a trailer or call them out to his property with all of the documents from the auction house. Not turning it in will cause jail time.
It makes sense. Sometimes you have no way of knowing if you are buying something that was previously stolen. I'm sure we all have bought something stolen at some point and never knew it. Most of us honest people wouldn't buy stolen goods if we were aware of the fact.

There should be a partial vin located between the two fender aprons on each side above the shock tower, they are hidden by the fenders. Check if that partial vin matches the current one. Hopefully this helps best of luck!

You aren't going to get charged with possession of stolen property and you know it. What will happen is if the car is stolen, they will have to seize the vehicle and you are out all the money you paid for it and put into it, and you know that as well.
Could your insurance agent check the status of the title? I believe they have access to a system that will let them know if the VIN is reported as stolen.
FIY there should be a hose running from the oil filler cap to the base of the air filter. This allows filtered air to enter the crankcase when the PCV valve opens. If you don't want to add a hose, you can replace the cap with one that has a filter in it. The VIN number should be stamped in other locations on the car - you might want to see if they all match. I wonder what is on the Carfax report for this car as far as sales.
Man, that’s rough on that Mustang. 😅 But, luckily i bought my car from a son and his mother with a clean title, i only needed their out of state licenses copied to file and signatures on a bill of sale to get my title ownership on vehicle. Hope you get that resolved!

I had a 1973 Mercury Cougar XR7 that has the exact body as yours, just egg shell blue. You put the right cam in that 351 4V and it’ll make 400+hp. I had the 2v version and that car was 346whp with a cam and intake. Nice car man. Hope everything works out.

In EVERY situation… If a dealer, or person for that matter actually bought something they “Thought” could be stolen.. And they brought it to OUR attention first, then at NO TIME was that person in trouble. But only because they brought it to OUR attention first. That just shows honesty.. Now, with that said, if we found out something was possibly stolen, and that person did NOT bring it to our attention first, absolutely they got in trouble for receiving stolen property. Yes there’s a chance you’re gonna lose that money if you report it.. but if you don’t, and they find out, you’re gonna lose a hell of a lot more than that. It wouldn’t take an officer 5 minutes to type in that vin and tell you immediately if it’s entered into NCIC or not.

Good luck Randy, Copart screwed me with a situation similar to yours. Bought a dodge charger hellcat from them, drivetrain came back stolen when I went to highway patrol and they took the car. Copart denied all responsibility and I lost $35,000.
You know whats crazy if it's ACV auction. That's like the fifth title problem you've had with them. That I recall. If i was you i would definitely look into that legally.
If you haven’t already (which im assuming you have), try reaching out to individual counties DMVs in Colorado, that’s where a title transfer takes place here. Personally found Boulder County to be pretty helpful.
As it's been stated several times already as a former law enforcement officer as long as you report the vehicle as maybe being stolen as soon as you found out you will not be charged with a crime. You most definitely want to report it to the law enforcement as soon as possible. If anything law enforcement could do the hard work for you free of charge
Hire a Private Investigator, they have ways to get around what you're dealing with in the state of Colorado. The auction company is certainly liable for selling stolen goods too. However, the legal owner would probably be willing to relinquish the title. Good Luck.
I bought a 300k mile Durango in Mississippi for cash, it had a duplicate title without a lien listed. I went to title it and it had a title loan hold (not the right term) on it... Luckily the previous owner did pay it off, but the title loan place forgot to remove the hold. What sucked was that the previous owner had to go show the title company their receipt so they would then remove the hold. They could have just ghosted me and left me hanging, which I guarantee would have happened if they did what you said and got a duplicate title within hours of getting the title loan. I read it's incredibly common in Mississippi, and it's basically buyer beware there. Luckily my situation worked out, but for many, it doesn't.
Randy, maybe put it up on your lift and check other locations on the body or frame for the VIN ??? thinking they changed the VIN it should also be on the frame and the body somewhere. if not i guess it becomes a yard ornament!! maybe a company sign???
The Cavalier would be a great 1st car for Nick. Can you do a title search on the 73 Mustang, I still think this falls back on the selling auction, I'd pursue that possibility (legally) if needed.
I think there is a difference between knowingly possessing and concealing stolen property, and doing so unknowingly. Randy has proof he bought the car from an auction. He has a title, albeit a fake one. I would have a hard time believing anyone would prosecute him for possession/concealment if he immediately contacted law enforcement as soon as he became aware there is a problem and the car could potentially be stolen. Now if he keeps it a few more weeks, knowing there is a problem and it could be stolen, and doesn't tell them and then gets caught in possession of it and it turns out to be stolen, then he absolutely could be in deep trouble at that point. I told him in another comment that the best thing he can do is seek legal counsel on it.

Hi randy I'm not sure if this will help as I Don't know if you do this in the US but in the UK they stamp the vin in the floor pan by the drivers seat if the us do you should be able to pull the carpet up to see if they have welded a fake vin in hope this help and hope you get it sorted soon
When I used to work at a dealer we used to drive cars with title of destruction all the time we just put dealer tags on it and when we're done we sent it overseas
I've never considered that lol. If you were ever to have an accident driving a CD car on public roads your dealership would be in real trouble. Insurance for the dealer won't cover an accident because the car is uninsurable / not legal for street use. Then you'd have the state to deal with since driving a CD car is illegal, and using the dealer tag to conceal this would be a whole other issue. Not a good idea. If you even get pulled over by police and they run the VIN the car gets impounded and you'd be lucky if the police don't contact the Motor Vehicle Commission to report your dealer.
You're paranoid. If you have paperwork showing you bought it and from whom, you're clear. The car will be seized and worse case you are out the money. But you can recover the money from the company/auction house who sold it to you.
Randy in the State of NY they don't issue titlesforany vehicle over 25 years old. NY only issues transferable registrations that some state won't accept. This is why it would still show a Colorado title on file
My buddy who lives in Texas gave me a car for free, needed fixed up to run. I trailered it here to Oklahoma. Thought I got it running took it for a short spin around the block and it blew the new head gasket. A couple weeks later I went to switch the title over and get it registered in my name. Had no issue getting the tag and all that. But months went by and no title in the mail. So I looked online and at the time it said things were delayed across the board because they had a shortage of title paper, went into the tag office to figure out when I'd get the title and they tell me since it is from out of state they need to inspect it before the state will release the title. The car is sitting in my driveway with no title because I haven't gotten it fixed yet to be able to drive up there....

You bought the car legitimately, you had a reasonable expectation that you were buying a car that had valid provenance. You are not going to be in any trouble for "receiving stolen property." They'll take the car, and you may be out the 13k, unless you can get the auction co to refund, but that's as bad as it will get for you. In fact, I thin you may even be able to hold them responsible for not vetting the paperwork on the car and giving you the car with an invalid title. So, no, you won't have an issue.
Randy, you're not going to jail for possessing that car if it turns out to be stolen. You have an obvious legitimate reason for possessing it and can prove it's not criminal. Worst case scenario, the cops have to take possession of it and turn it over to the actual owner. You would have to sue the auction site for compensation.
How could an auction company, especially a legitimate one? Have all the history on it and still possibly sell a stolen vehicle with a bogus title is beyond comprehension. Wouldn't they be responsible for paying any legal fees and the $13000 if the car turns out to be stolen, not Randy, this whole situation is preposterous.
Randy, in Texas, if there is a problem with a title, the place you need to go is the County Tax Office. The title places you went don't have any authority to do the things you need to have done.
Maybe this could be an opportunity to travel to NY with MWM and get it sorted out truck and trailer with the stang on the back maybe? if you can get more content out if this situation hopefully you can make enough so you looked the whole 13k

You have two options call a officer to check the vin or go back to the auction house you got the car from and have them fix the title problem as they have breached the warranty of title. Also someone mentioned this steve latho video dealer sells man stolen car which police take.the video i was thinking of is the warrenty on one under stands and at 10:37 he goes into warranty of title. If you have time check them out as they may help in your title quest.
call an insurance broker in colorado and ask to do a title search. say you are looking at buying it and want to make sure there isnt a lein. ive done that in california
If you have bought the car from auction, then they are responsible for your paper. You don't have to worry. You paid indemnity fees. That cover everything goes wrong.

Are you able to check the vin numbers before purchase with DMV ? Do you take pictures of vin numbers from salvage cars you hold interest? Could save you the headaches of waiting for the titles and not making an impulse decision. Perhaps you can get a closeup photo from dash on potential cars unseen before buying

There should be some website that you can run the Vin with and find out if it is stolen.

Hi randy I'm not sure if this will help as I Don't know if you do this in the US but in the UK they stamp the vin in the floor pan by the drivers seat if the us do you should be able to pull the carpet up to see if they have welded a fake vin in hope this help and hope you get it sorted soon
When I used to work at a dealer we used to drive cars with title of destruction all the time we just put dealer tags on it and when we're done we sent it overseas
I've never considered that lol. If you were ever to have an accident driving a CD car on public roads your dealership would be in real trouble. Insurance for the dealer won't cover an accident because the car is uninsurable / not legal for street use. Then you'd have the state to deal with since driving a CD car is illegal, and using the dealer tag to conceal this would be a whole other issue. Not a good idea. If you even get pulled over by police and they run the VIN the car gets impounded and you'd be lucky if the police don't contact the Motor Vehicle Commission to report your dealer.
You're paranoid. If you have paperwork showing you bought it and from whom, you're clear. The car will be seized and worse case you are out the money. But you can recover the money from the company/auction house who sold it to you.

Randy in the State of NY they don't issue titlesforany vehicle over 25 years old. NY only issues transferable registrations that some state won't accept. This is why it would still show a Colorado title on file

there should be another Vin Number in a certain area on the Mustang that should be on the das board on the 73 Mustang

My buddy who lives in Texas gave me a car for free, needed fixed up to run. I trailered it here to Oklahoma. Thought I got it running took it for a short spin around the block and it blew the new head gasket. A couple weeks later I went to switch the title over and get it registered in my name. Had no issue getting the tag and all that. But months went by and no title in the mail. So I looked online and at the time it said things were delayed across the board because they had a shortage of title paper, went into the tag office to figure out when I'd get the title and they tell me since it is from out of state they need to inspect it before the state will release the title. The car is sitting in my driveway with no title because I haven't gotten it fixed yet to be able to drive up there....
@AutoAuctionRebuilds The best advice I can think of is to hire a lawyer. That can save your bacon, even if that 73 Mustang ends up being taken.

You bought the car legitimately, you had a reasonable expectation that you were buying a car that had valid provenance. You are not going to be in any trouble for "receiving stolen property." They'll take the car, and you may be out the 13k, unless you can get the auction co to refund, but that's as bad as it will get for you. In fact, I thin you may even be able to hold them responsible for not vetting the paperwork on the car and giving you the car with an invalid title. So, no, you won't have an issue.

Randy, you're not going to jail for possessing that car if it turns out to be stolen. You have an obvious legitimate reason for possessing it and can prove it's not criminal. Worst case scenario, the cops have to take possession of it and turn it over to the actual owner. You would have to sue the auction site for compensation.

How could an auction company, especially a legitimate one? Have all the history on it and still possibly sell a stolen vehicle with a bogus title is beyond comprehension. Wouldn't they be responsible for paying any legal fees and the $13000 if the car turns out to be stolen, not Randy, this whole situation is preposterous.
Randy, in Texas, if there is a problem with a title, the place you need to go is the County Tax Office. The title places you went don't have any authority to do the things you need to have done.

In Colorado you can do a VIN check where they do inspections. It's a 25 dollar fee
My husband has his dealer licenses in Kentucky. If you accidentally buy a stolen car you can lose your dealer licenses here.

You have two options call a officer to check the vin or go back to the auction house you got the car from and have them fix the title problem as they have breached the warranty of title. Also someone mentioned this steve latho video dealer sells man stolen car which police take.the video i was thinking of is the warrenty on one under stands and at 10:37 he goes into warranty of title. If you have time check them out as they may help in your title quest.

Try Oklahoma Auto Title Service. They claim they're able to provide a rejection letter. Might be worth a look.
call an insurance broker in colorado and ask to do a title search. say you are looking at buying it and want to make sure there isnt a lein. ive done that in california
If you have bought the car from auction, then they are responsible for your paper. You don't have to worry. You paid indemnity fees. That cover everything goes wrong.

Are you able to check the vin numbers before purchase with DMV ?
Do you take pictures of vin numbers from salvage cars you hold interest? Could save you the headaches of waiting for the titles and not making an impulse decision. Perhaps you can get a closeup photo from dash on potential cars unseen before buying
