Harley-Davidson said that they reserve the right to pursue legal action against any competitor who produces a sound that's similar to one of their bikes. Well, unfortunately for them, a court has already ruled the Harley cannot own the sound that their bikes make.
Do you mean you want to register a domain name that had once been registered as a trademark but is now a dead trademark? Or are you talking about registering a trademark identical to the one that states it's a dead trademark?
Then it shouldn't be a problem-as long as the domain name is available. There is a small risk that the business still operates, they just neglected to renew their trademark. But that risk is very small.
Was one of several beyond ch!ckensh!t d!ck moves by Harley like when they lobbied and got massive tarrifs on motorcycles 750cc and above EVEN on genres (sport bikes for example) that Harley didn't even BUILD! Also Harley whined cried and threatened to quit racing when Honda started beating them in the ONLY motorcycle racing cat agora that Harley could compete in (Flat Track that is while EVERY other form of racing they are totally not competitive in because they refuse to spend money and effort to make faster better bikes than the competition) Harley actually got the AMA to force Honda to put tiny restrictors in their intakes so that Harley could keep winning....so naturally Honda pulled out of flat track because I mean who wants to race when the rules are Harley gets to win. I was a fan of flat track until that moment now I am a Harley hater for these reasons and many more....simply being an American company does not earn them in a pass in my book

A court is just that, " *A* court". It may have limited HD's trademark rights in specific instances, but it did not eliminate them altogether.
