Dubious? Outright illegal in many ways, discriminatory, and incredibly intrusive. The misogyny of this employer is off the chart!

RE: Identity theft from the incarcerated crack-head.
They are right, OP needs a good lawyer. But he's not suing the crack-head, that guy has no money. The state will add charges of identity theft and he will be punished for it. Instead, OP is suing the police department, the municipality and the state who failed to do their due diligence in booking him. The State fucked up, and OP lost their income and their home, there are considerable damages directly resulting from their negligence. And it's not going to be an easy fight in court, you need a good lawyer. And this issue will take years to resolve fully.
I hate to say it, but this is why you need to prioritize having an emergency fund. While this is an uncommon occurrence, shit like this can happen. Financially, it's no different than any other job loss, and you need to be prepared for that. You can't rely on unemployment payments, you need to have savings, even if you have to live out of your car for a few months to build those savings. All OP can do now is scrape by on credit, building considerable debt with interest payments that will not be recoverable. You need to have 6 months worth of your normal expenses in savings, minimum. If you don't, life can blindside you like this, and by no fault of your own, you can end up in a situation that is near impossible to recover from. It's a matter of survival. Living paycheck to paycheck can sustain you for a long time, but it will destroy you eventually.

    RE: Pedo Band Teacher
Everyone needs to understand their own roles and confine their actions to those roles.
OP's priority is protecting HER son. She needs to do that by any means possible, but that is the extent of her obligation and authority.
The police hold bad guys accountable. That is how they "protect". They, along with the Courts, Prisons, Mental Health Services etc work to find the people who did bad things and make sure they don't get away with it. But the bad things need to have happened, they are NOT a preventative force, they are reactionary, and there isn't a lot for them to react to here.
The School District needs to protect the school and the children.
Everyone has their own role to play in the administration of justice. And remember, he is innocent until proven guilty. I'm not defending the guy, the odds are he's a creep. But I could envision a scenario where another student gets their hands on his phone and sends messages from his account as a "Prank", or other scenarios like that. It's not likely, but it is possible. His possible innocence however is the duty of the school, the detective, the prosecutor, the judge and his defense to establish, NOT OP. So she does not need to be concerned with that, her job is to raise the alarm.
The other commentor is right, the police may be trying to get more evidence, and tipping your hand now could undermine that and actually help him get away with it. But tell the school district anyway. I would say this to them:
"Here are the texts my underage son allegedly received from one of your teachers. {include a copy of the messages}. I have contacted police and they are investigating {give case number}. You should consult with the district's legal counsel before confronting this issue with the teacher, and they should talk to the detective on this case before taking any action, so your actions do not compromise the police investigation. However, I understand you have a duty to the students and will need to respond appropriately. I would ask that you review your policies and take whatever preventative measures your legal counsel advises to prevent this in the future."
DO NOT blast him on Social Media. That throws everything into chaos, makes everyone a liability. If charges are filed against him, the news will catch wind of it, and it will spread from there. Let the school district know you are giving them a heads up in advance of such potential charges so they can circle the wagons now and brace for it. OP has no claim against the school district, as her son doesn't attend there and they have no duty to him. But if this happens with one of their own students, it could get messy for them. But they need to take their cues from their own legal counsel in concert with the detective on the case. Remind them that if they fire him and tip their hand about the investigation, he will likely leave the jurisdiction before the investigation concludes, and will get away with it, potentially becoming a risk to other kids. It needs to be handled delicately. And again, however unlikely, it is possible that he is innocent and there's more to this they don't know yet. Acting too hastily can bite everyone in the ass.
Once the police and the school district are informed, OP's job is done. But impress upon the school the importance of handling this with law enforcement's involvement, as administrators can be a bit myopic at times and react badly.
